A retaining wall dispute on Nordica Drive took center stage at the December 9 Planning Board meeting, where members unanimously approved an amended site plan for a homeowner whose landscaping deviated from previously approved plans—drawing a formal complaint from an adjacent neighbor.
Mark Franzoso appeared before the board seeking retroactive approval for retaining walls and steps built along the south side of his property at 23 Nordica Drive, as well as an enclosed wall on the north side. The walls, constructed after his new single-family home was erected, ended up closer to the property lines than what the board had originally approved in June 2023.
"I dealt with the property and tried to make it look as nice as possible," Franzoso told the board.
Village Engineer Vincent Salanitro confirmed that while the walls deviated from the approved plan, they remain compliant with zoning requirements. "I am comfortable with the walls, as currently built," Salanitro said.
The changes prompted a letter from the Levin Law Group, representing neighbor Russell H. Davies at 27 Nordica Drive, alleging ongoing violations of Village Code Section 230-170. Village Attorney Dan Pozin noted that approving the amended site plan would resolve the concerns raised in the letter. Pozin also emphasized that a final inspection would still be required before a certificate of occupancy could be issued.
Board member John Ghegan took a practical interest in the site conditions, asking Franzoso to relocate a portable toilet that was parked near a fire hydrant. Franzoso said he was cleaning up the property and expected to finish plantings in the spring.
In other business, the board updated its Rules and Procedures, most notably establishing a noon deadline on the day before a meeting for written public comments to be included in backup materials. The board also removed time limits for applicants speaking on agenda items not subject to public hearings, and clarified that the deputy chairperson will preside in the chairperson's absence. Regular meetings are now formally set for the second and fourth Tuesdays of each month.
Residents who wish to submit written comments to the Planning Board should ensure they are submitted by noon the day before a meeting to guarantee inclusion in the board's review materials.
