Dear Ms. Street:
The New York State Department of Transportation (NYSDOT) is progressing a project with locations
within the designated New York State Coastal Zone Management Area (CZMA); several locations are
within the limits of Local Waterfront Revitalization Program (LWRP) areas, Scenic Area of Statewide
Significance (SASS), and Significant Coastal Habitats. Attached is a table of the locations within the
coastal zone. A GIS shapefile or Google Earth KMZ file of all of the locations is available upon
request. This letter serves as Federal Aid Notification.
The project will consist of cleaning/washing bridges and sealing decks as needed to remove debris
and protect against corrosive substances. This project is part of the Regional annual bridge
washing/deck sealing program which requires that each structure be cleaned, and concrete bridge
decks be sealed periodically. All work will occur within the existing highway right-of-way, there will be
no excavation, and there will be no changes to the bridges.
Attached is the standard specification that will be followed regarding concrete sealing, which
discusses the methodology of cleaning and sealing activities. Additionally, item specification
641.510XYZ16 will be included in the contract which states “All sand, dirt, cinders, and other trash
and debris collected from the bridge shall be disposed of at a suitable off-site disposal facility in
accordance with the provisions of §107-10 Managing Surplus Material & Waste.” The environmental
protection notes for this contract are not yet written but they will be very similar to the notes from the
previous contract, which are attached.
The project will comply with the policies of the CZMA Program and the LWRP areas.
The project is federally funded through the Federal Highway Administration. No federal permits are
required. The project is being progressed as a NEPA Class II action and SEQRA Type II action in
accordance with the Department’s implementing the regulations of SEQR (17 NYCRR Part 15).
Based on the above and enclosed information, we respectfully request that NYSDOS render a general
concurrence decision regarding the release of federal funding in support of the project. If you have any

559-1 DESCRIPTION. The work in this section shall include work required for protective coatings of
concrete.
559-1.01 Scope. Apply a protective sealer to concrete surfaces to slow down/reduce the ingress of water
and chlorides into the concrete at locations indicated on the plans or as directed by the Engineer.
559-1.02 Definitions
A. Penetrating Type Protective Sealers – A Penetrating Sealer is a type of sealer that is applied to a
concrete surface and has the ability to penetrate the surface and chemically bond to the concrete.
These are used on both new and existing concrete bridge decks and traffic bearing surfaces to include,
but not limited to: approach slabs, bridge deck overlays, and sidewalks. Penetrating Sealers are also
used on new structural concrete and precast concrete elements that are subject to water and/or
chloride exposure and require long term protection.
B. Coating Type Protective Sealers – A Coating Sealer is a type of sealer that is applied to the
surface of existing concrete when a uniform appearance is required. These are two part systems which
consist of a primer coat followed by a top coat. Coating Sealers are used on new and existing concrete
surfaces when an aesthetic appearance is desired, as they can hide stained or underlying repair areas
while providing protection to the concrete.
559-2 MATERIALS
559-2.01 Protective Sealing of Structural Concrete
The protective sealers to be used on concrete surfaces shall be on the Approved List and meet the
requirements of one of the following subsections:

Coating Type Protective Sealers
The protective sealer required for use on all traffic and/or pedestrian bearing surfaces shall be a
Penetrating Type Protective Sealer which has a 100% solids content as noted on the Approved List.
Penetrating Type Protective Sealer manufactured after April 1, 2022 shall be tinted with a fugitive dye
such that the sealer is readily distinguishable upon the concrete surface for at least 4 hours after
application but shall become inconspicuous within 7 days after application.
559-3 CONSTRUCTION DETAILS
559-3.01 Protective Sealing of Structural Concrete
A. General. Provide the Engineer with the Sealer Manufacturer's written instructions for application
and the proposed method of surface preparation and sealer application at least 7 days prior to the start
of work. Only one brand and specific type of sealer off the Approved List will be allowed for use on
each individual element of a project (i.e., each pier, bridge deck, abutment, etc.). Follow all sealer
manufacturer’s written instructions except as modified herein.
B. Surface Preparation. For both new and existing concrete applications, care shall be taken while
preparing and cleaning the surfaces to be sealed to ensure that all contaminants are satisfactorily
removed without undue damage to the concrete surface or exposure of coarse aggregate.

Contaminants may include but not be limited to grime, dirt, laitance, efflorescence, curing
compounds, standing water, oil, paint, or other foreign particles which may prevent penetration or
adhesion of the sealer. Prepare the surface for sealing by utilizing a procedure with appropriate
equipment that will satisfactorily complete this work, in accordance with the sealer manufacturer’s
written instructions and subject to the approval of the Engineer. Surface preparation methods usually
consist of either: sand, shot, or water blasting with a minimum water blast pressure of 7,000 psi.
Upon completion of the cleaning process, the concrete surface shall be free of any remaining residue.
All surface preparation work shall be completed and approved by the Engineer, prior to sealer
application.
1. New Bridge Decks and Bridge Deck Overlays. All required surface texturing, saw cut
grooving, diamond grinding, and construction of barriers, parapets, and walks shall be completed
prior to the surface being prepared for sealing. All new concrete bridge decks and bridge deck
overlays to be sealed shall air dry for a minimum of 72 hours after completion of the required
curing period. If the concrete is subjected to rain or moisture from other operations, the drying
period shall be extended 24 hours from the time that the concrete has stopped being wetted. After
the drying period has ended, the concrete surface shall be lightly cleaned in accordance with the
sealer manufacturer’s written instructions followed by vacuum cleaning to prepare the surface
and remove any contaminants or loose particles. If water blasting is utilized, the surface shall be
air dried upon completion for a minimum of 24 hours or as specified in the sealer manufacturer's
written instructions, whichever is longer, before the sealer can be applied. The deck shall be
clean and free of all debris prior to sealer application. If a new bridge deck or bridge deck
overlay is subjected to traffic for 21 days or more prior to sealing, the concrete surface shall be
thoroughly cleaned in accordance with the sealer manufacturer's written instructions before sealer
can be applied.
2. New Structural Concrete. All new structural concrete that is to be sealed shall air dry for 14
days after completion of the required curing period or for the length of time specified in the sealer
manufacturer's written instructions, whichever is longer. If the concrete is subjected to rain or
moisture from other project operations, the drying period shall be extended 24 hours for every
day the concrete is subjected to water. After the drying period has ended, the concrete surface
shall be lightly cleaned in accordance with the sealer manufacturer's written instructions followed
by vacuum cleaning, to prepare the surface and remove any contaminants or loose particles. If
water blasting is utilized, the surface shall be air dried upon completion for a minimum of 24
hours or as specified in the sealer manufacturer's written instructions, whichever is longer, before
the sealer can be applied. The concrete surface shall be clean and free of all debris prior to sealer
application.
3. Existing Structural Concrete and Existing Bridge Decks. Existing concrete surfaces to be
sealed shall be thoroughly cleaned with light sand or shot blasting, in accordance with the sealer
manufacturer's written instructions followed by vacuum cleaning, to prepare the surface and
remove any contaminants or loose particles. Where the use of sand or shot blasting is prohibitive,
water blasting may be allowed, provided the Contractor can demonstrate the ability to provide a
clean, porous surface in accordance with the requirements of the sealer manufacturer’s written
instructions. If the concrete is subjected to rain or moisture from other operations such as water
blasting, upon completion the surface shall be air dried for a minimum of 24 hours or as specified
in the sealer manufacturer's written instructions, whichever is longer, before the sealer can be
applied. Surface preparation of any concrete or bridge deck surfaces with existing coatings known
to be asbestos containing shall be performed subsequent to coating removal and completed in
accordance with Section 210 of the Standard Specifications.

C. Sealer Application
1. Weather Limitations. Sealer materials shall not be applied during wet weather conditions or
when adverse weather conditions are anticipated within 12 hours of the completion of sealer
application or as specified in the sealer manufacturer's written instructions, whichever is longer.
Ambient and surface temperatures shall be a minimum of 40°F and rising during application until
the sealed concrete is dry to the touch. Application by spray methods will not be permitted during
windy conditions if unsatisfactory coverage will result.
2. Yield Check. If penetrating sealer is to be applied in a single coat to a traffic bearing surface,
the Contractor shall demonstrate to the satisfaction of the Engineer that the proposed equipment
and procedure will result in uniform coverage at the application rate specified on the Approved
List before sealer can be applied.
3. Application. The protective sealer shall be used as supplied by the manufacturer without
thinning or alteration with exception of the fugitive dye. Equipment for sealer application shall be
compatible with sealer manufacturer requirements, in good working order, clean of foreign
materials and approved for use by the Engineer. The quantity of sealer material delivered to the
project shall be demonstrated by direct measurement in the presence of the Engineer prior to
commencement of sealing application. Assumptions of volumes of unopened containers will not
be permitted. The sealer shall be applied by brushing, spraying, or rolling, as recommended by
the sealer manufacturer. The direct measurement shall be repeated in the presence of the
Engineer when sealer application work is complete to verify the quantity of sealer applied.
a. For Penetrating Type Protective Sealers – Apply sealer in one or more coats in accordance
with the sealer manufacturer’s written instructions. The total quantity of sealer applied by all
coats shall be equal to the quantity required at the application rate specified on the Approved
List. The application rate for all traffic and pedestrian bearing surfaces shall be 200 ft2/gal.
Additional coats shall be applied perpendicular to the previous coat. Care shall be taken when
applying each coat, such that running or pooling does not occur. The final coat shall be
allowed to dry according to the sealer manufacturer's written instructions before opening to
traffic. On sloping and vertical concrete surfaces, sealer application shall progress from
bottom to top. Care shall be taken to ensure that the entire surface of the concrete is covered,
and all pores filled.
A 1-pint sample of sealer is required to be taken at a random time during sealer
application from the point of application (i.e., from the nozzle of sprayer or spray bar or from
the sealer container where sprayers, brushes or rollers are loaded) for quality assurance
purposes. This sample shall be submitted to the Department’s Central Testing Laboratory
(CTL), to the attention of the Chemistry Lab for evaluation. Additional samples may be
requested by the Department at any time.
b. For Coating Type Protective Sealers – Apply in accordance with the Contract Plans and
the sealer manufacturer's written instructions.
559-4 METHOD OF MEASUREMENT
The quantity to be measured for payment will be in the number of square feet of concrete sealed measured
to the nearest whole square foot.
559-5 BASIS OF PAYMENT

WATER QUALITY STANDARDS
THE NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION HAS
ESTABLISHED WATER QUALITY STANDARDS, WHICH ARE CONTAINED IN PARTS 700
THROUGH 705 OF TITLE 6 OF THE OFFICIAL COMPILATION OF CODES, RULES AND
REGULATIONS OF THE STATE OF NEW YORK. THESE STANDARDS APPLY TO ALL BRIDGE
WASHING LOCATIONS AND INCLUDE, BUT ARE NOT LIMITED TO:
1. THERE SHALL BE NO INCREASE IN TURBIDITY THAT WILL CAUSE A SUBSTANTIAL
VISIBLE CONTRAST TO NATURAL CONDITIONS;
2. THERE SHALL BE NO SUSPENDED, COLLOIDAL AND SETTLEABLE SOLIDS THAT WILL
CAUSE DEPOSITION OR IMPAIR THE WATERS FOR THEIR BEST USAGE; AND
3. THERE SHALL BE NO RESIDUE FROM OIL AND FLOATING SUBSTANCES; VISIBLE OIL
FILM; GLOBULES OR GREASE.
VEGETATION REMOVAL
BRUSH GROWTH ADJACENT TO AND UNDER THE STRUCTURE SHALL BE REMOVED BY
CUTTING VEGETATION FLUSH TO THE GROUND OR AS ORDERED BY THE ENGINEER-IN-
CHARGE. THERE WILL BE NO GRUBBING OF VEGETATION OR STUMPS CAUSING SOIL
DISTURBANCE. ALL WOOD, BRUSH, AND OTHER DEBRIS RESULTING FROM THE WORK
SHALL BE DISPOSED OF AS SPECIFIED IN THE STANDARD SPECIFICATIONS UNDER
SECTION 201 - 3.03, DISPOSAL. THERE WILL BE NO SEPARATE PAYMENT FOR THIS ITEM.
THE COST WILL BE INCLUDED IN THE VARIOUS BID PRICES IN THE CONTRACT.
TREE PROTECTION
THE AREA BENEATH THE DRIP LINE OF ALL TREES WITH A TRUNK DIAMETER OF 3 INCHES
OR GREATER LOCATED OUTSIDE OF THE PROJECT CLEARING LIMITS OR IN PROXIMITY TO
STAGING, STORAGE AND STOCKPILING AREAS SHALL NOT BE DISTURBED. DISTURBANCE
INCLUDES REMOVING TREES, STOCKPILING MATERIAL, STORING EQUIPMENT, OR DRIVING
AND PARKING VEHICLES BENEATH THE DRIP LINE OF TREES.
THE CONTRACTOR SHALL SUBMIT A PLAN TO THE ENGINEER-IN-CHARGE FOR APPROVAL
SHOWING THE PROPOSED STAGING, STORAGE AND STOCKPILE AREAS FOR EACH WORK
SITE PRIOR TO PLACEMENT OF ANY EQUIPMENT OR STAGING OF MATERIALS AT THE
SUBJECT AREA.
TREE REMOVAL AND TRIMMING PROHIBITION
REMOVAL OF TREES WITH A TRUNK DIAMETER OF 3 INCHES OR GREATER AND REMOVAL
OF TREE BRANCHES WITH A DIAMETER OF 3 INCHES OR GREATER AT THE CUT POINT ARE
BOTH PROHIBITED UNLESS COORDINATED AND APPROVED BY THE ENGINEER-IN-CHARGE
IN CONSULTATION WITH THE CONSTRUCTION ENVIRONMENTAL COORDINATOR.
TROUT STREAM PROTECTION NOTES FOR COLUMBIA COUNTY
THE COLUMBIA COUNTY BRIDGE TABLE INDICATES WHICH BRIDGES ARE LOCATED OVER
TROUT STREAMS AND/OR TROUT STOCKING SITES. BRIDGES OVER TROUT STREAMS IN
COLUMBIA COUNTY SHOULD BE WASHED AFTER JUNE 1ST AND PRIOR TO SEPTEMBER 30TH.

AVOID WASHING BRIDGES THAT ARE OVER TROUT STREAMS WHEN DAYTIME AIR
TEMPERATURES ARE 87F OR HIGHER, TO MINIMIZE STRESS ON TROUT.
WASHING BRIDGES OVER WATER
1. TO PREVENT THE UNINTENTIONAL SPREAD OF INVASIVE SPECIES, THE USE OF
MUNICIPAL WATER FOR STRUCTURE CLEANING WHEREVER POSSIBLE IS
RECOMMENDED TO AVOID THE NEED FOR DISINFECTION OF THE EQUIPMENT. IF THE
USE OF MUNICIPAL WATER IS NOT POSSIBLE THE RECOMMENDATION IS THAT
WATER SHOULD BE TAKEN FROM THE STREAM OR WATER FLOWING UNDER THE
BRIDGE. IF WATER IS TAKEN FROM THE STREAM, ALL EQUIPMENT USED SHALL BE
STEAM CLEANED PRIOR TO ENTERING AND RE-ENTERING ANY WATERCOURSE
INCLUDING INTRA-WATERSHED USE. WHENEVER POSSIBLE, BRIDGE WASHING
SHALL TAKE PLACE FROM UPSTREAM TO DOWNSTREAM WITHIN A GIVEN
WATERSHED.
2. WHEN DAYTIME AIR TEMPERATURES ARE 87⁰F OR HIGHER, WATER TEMPERATURES
CAN BE WARM AND TROUT ARE OFTEN STRESSED DURING THESE HOT SUMMER
DAYS. AVOIDING WASHING BRIDGES THAT ARE OVER TROUT STREAMS ON THESE
HIGH TEMPERATURE DAYS TO MINIMIZE THIS TYPE OF STRESS
3. DURING THE COURSE OF CONSTRUCTION, THE CONTRACTOR SHALL CONDUCT
THEIR OPERATIONS IN SUCH A MANNER AS TO PREVENT ANY DAMAGE TO ANY
STREAM FROM POLLUTION BY DEBRIS, SEDIMENTATION, OR OTHER FOREIGN
MATTER, OR FROM THE MANIPULATION OF EQUIPMENT AND/OR MATERIALS IN OR
NEAR SUCH STREAMS. IF THE CONTRACTOR USES THE WATER FROM ANY STREAM,
THE CONTRACTOR SHALL USE AN INTAKE WHICH FILTERS THE WATER AND
PROTECTS AND MAINTAINS THE WATER RIGHTS WITH NO VISIBLE DIFFERENCE IN
VOLUME OF FLOW AND CLARITY OF WATER ABOVE AND BELOW THE INTAKE AND
SUSTAINS FISH LIFE DOWNSTREAM.
4. IF THE CONTRACTOR DECIDES TO USE THE WATERBODY AS A BASE FOR OTHER
WORK, THE CONTRACTOR SHALL FIRST PREPARE A WRITTEN PLAN AND SUBMIT IT
TO THE ENGINEER-IN-CHARGE (EIC) FOR APPROVAL. FOR STREAMS CLASSIFIED AS
AA, A, OR B WITH OR WITHOUT A SUBCLASS OF (T) OR (TS), AND C WITH A
SUBCLASS OF (T) OR (TS), THE ENGINEER-IN-CHARGE SHALL CONSULT WITH THE

SEE THE ENVIRONMENTAL FEATURES TABLES FOR BRIDGE LOCATIONS NEAR STATE-
REGULATED (NYSDEC) FRESHWATER WETLANDS. ARTICLE 24 OF THE ENVIRONMENTAL
CONSERVATION LAW, PURSUANT TO SECTION 24 - 0701(2), PROHIBITS ANY FORM OF
POLLUTION IN OR WITHIN 100 FEET OF STATE REGULATED WETLANDS WITHOUT A PERMIT.
POLLUTION IS DEFINED IN PART 663 OF TITLE 6 OF THE OFFICIAL COMPILATION OF CODES,
RULES AND REGULATIONS OF THE STATE OF NEW YORK AS THE PRESENCE IN THE
ENVIRONMENT OF HUMAN-INDUCED CONDITIONS OR CONTAMINANTS IN QUANTITIES OR
CHARACTERISTICS WHICH ARE OR MAY BE INJURIOUS TO HUMAN, PLANT, OR ANIMAL LIFE
OR PROPERTY.
NO CONSTRUCTION, GRADING, FILLING, EXCAVATING, CLEARING, STOCKPILING, STORING,
STAGING OR OTHER RELATED ACTIVITY SHALL BE PERMITTED WITHIN THE FRESHWATER
WETLAND OR THE 100-FOOT ADJACENT AREA OF STATE REGULATED WETLANDS EXCEPT
AS DESCRIBED IN THIS CONTRACT. ANY ADDITIONAL WORK IN THE WETLAND OR
ADJACENT AREA NOT DESCRIBED IN THIS CONTRACT SHALL NOT BE DONE WITHOUT FIRST
CONTACTING THE ENGINEER-IN-CHARGE.
NOTES FOR BRIDGES OVER ANY STREAMS OR WATER BODIES NOT IN THE NYCDEP
WATERSHED
THE ENVIRONMENTAL FEATURES TABLES INDICATE WHICH BRIDGE LOCATIONS ARE WITHIN
OR OUTSIDE THE NYCDEP WATERSHED. THE FOLLOWING NOTES MUST BE FOLLOWED TO
MINIMIZE THE RISK OF SPREADING AQUATIC INVASIVE SPECIES.
1. WATER USED FOR BRIDGE WASHING AT THESE LOCATIONS SHALL BE FROM EITHER OF
THE TWO FOLLOWING SOURCES:
1. ON-SITE WATER, WHICH IS DEFINED AS WATER TAKEN FROM BENEATH THE
SUBJECT BRIDGE
2. MUNICIPAL WATER
2. ON-SITE WATER CANNOT BE USED FOR BRIDGES OVER THE MAIN STEM OF THE
DELAWARE RIVER; MUNICIPAL WATER MUST BE USED.
3. WHEN ON-SITE WATER IS USED, ALL EQUIPMENT THAT COMES IN CONTACT WITH
THE WATER (INCLUDING, BUT NOT LIMITED TO, BOATS, PLATFORMS, WATER
PUMPING EQUIPMENT, WATER STORAGE TANKS, AND TRAILERS AND TRUCKS THAT
CARRY SUCH STORAGE TANKS) MUST BE DISINFECTED USING A HIGH
TEMPERATURE PRESSURE WASHER (STEAM POWER WASHER) PRIOR TO THE START
OF WORK AND PRIOR TO LEAVING THE BRIDGE SITE. THE EQUIPMENT MUST HAVE
OPERATING SPECIFICATIONS AT A MINIMUM OF 160 DEGREES FAHRENHEIT, 700 PSI,
2 GALLONS PER MINUTE. ALL EQUIPMENT AND TANKS MUST BE COMPLETELY
DEWATERED PRIOR TO DISINFECTION. ANY DEBRIS FOUND ON TRAILERS, ETC.,
MUST BE REMOVED BEFORE BEING DISINFECTED. THE ENTIRE SURFACE AREA
(INTERIOR AND EXTERIOR) OF THE TANK AND EQUIPMENT, INCLUDING, BUT NOT
LIMITED TO, ANY AREA THAT COMES IN CONTACT WITH WATER, SHALL BE
DISINFECTED BY DIRECT CONTACT WITH A HIGH TEMPERATURE PRESSURE

WASHER. DISINFECTION BETWEEN SITES IS NOT REQUIRED WHEN TRAVELING FROM
ONE BRIDGE TO ANOTHER IN A DOWNSTREAM DIRECTION IN THE SAME STREAM
(EXCEPT FOR THE ESOPUS CREEK - SEE #4 ESOPUS CREEK NOTE). DISINFECTION IS
REQUIRED WHEN SWITCHING FROM AN ON-SITE WATER SOURCE TO A MUNICIPAL
WATER SOURCE.
4. THE ESOPUS CREEK IS CONSIDERED TO BE COMPRISED OF THREE REACHES, WHICH
SHALL BE CONSIDERED AS SEPARATE AND DISTINCT STREAMS: THE REACH ABOVE
THE PORTAL (THE PORTAL CROSSES ROUTE 28 AT A POINT 0.2 MILES WEST OF THE
INTERSECTION OF ROUTE 28 WITH BROADSTREET HOLLOW ROAD IN THE TOWN OF
SHANDAKEN, ULSTER COUNTY); THE REACH FROM THE PORTAL TO THE ASHOKAN
DAM; AND THE REACH FROM THE ASHOKAN RESERVOIR TO THE HUDSON RIVER.
DISINFECTION BETWEEN SITES IS NOT REQUIRED WHEN TRAVELING FROM ONE
BRIDGE TO ANOTHER IN A DOWNSTREAM DIRECTION IN THE SAME REACH, BUT
DISINFECTION MUST OCCUR WHEN MOVING BETWEEN STREAM REACHES.
5. WHEN MUNICIPAL WATER IS USED, ALL EQUIPMENT THAT COMES IN CONTACT WITH
THE WATER MUST BE DISINFECTED PRIOR TO THE START OF WORK AND WHEN
SWITCHING FROM AN ON-SITE WATER SOURCE TO A MUNICIPAL WATER SOURCE.
DISINFECTION PROCEDURES ARE OUTLINED IN ITEM C ABOVE. IT IS NOT NECESSARY
TO DISINFECT EQUIPMENT BETWEEN DIFFERENT MUNICIPAL WATER SOURCES.
6. DISINFECTING OPERATIONS ARE PROHIBITED ON LOCATIONS WHERE THE RUNOFF
FROM DISINFECTING WOULD ENTER A STREAM OR WATERBODY.
7. ALTERNATE DISINFECTION METHODS MAY BE AVAILABLE AND WILL REQUIRE PRIOR
APPROVAL BY NYSDEC REGIONAL BUREAU OF FISHERIES AND THE ENGINEER-IN-
CHARGE.
8. THERE IS NO SEPARATE PAYMENT FOR DISINFECTING EQUIPMENT; THE COST WILL
BE INCLUDED IN VARIOUS BID PRICES IN THE CONTRACT.

1. THE CONTRACTOR IS REQUIRED TO STAY WITHIN THE HIGHWAY RIGHT-OF-WAY. THE
CONTRACTOR WILL NOT DEPOSIT ANY DEBRIS ON NYCDEP OWNED LANDS.
2. PRIOR TO THE START OF WORK, THE CONTRACTOR SHALL PROVIDE TO THE ENGINEER-

IN THE WATERSHED. THE EIC SHALL SUBMIT THE SCHEDULE TO THE NYCDEP EAST
AND/OR WEST OF HUDSON CONTACTS UNLESS OTHERWISE NOTED.
3. THE EIC WILL NOTIFY THE NYCDEP CONTACTS AT LEAST ONE (1) WEEK PRIOR TO THE
COMMENCEMENT OF WORK FOR EACH BRIDGE IN THE WATERSHED.
4. FOR ANY WORK REQUIRING THE USE OF WATER, THE WATER SHALL BE FROM EITHER
OF THE TWO FOLLOWING WATER SOURCES:
A. ON-SITE WATER, WHICH IS DEFINED AS WATER TAKEN FROM BENEATH THE
SUBJECT BRIDGE
B. MUNICIPAL WATER
FOR WATER WITHDRAWN FROM ON-SITE SOURCES, THE CONTRACTOR MUST OBTAIN
PRIOR APPROVAL FROM NYCDEP FOR THE PROPOSED WATER WITHDRAWAL METHOD.
5. WHEN ON-SITE WATER IS USED, ALL EQUIPMENT THAT COMES IN CONTACT WITH THE
WATER (INCLUDING, BUT NOT LIMITED TO, BOATS, PLATFORMS, WATER PUMPING
EQUIPMENT, WATER STORAGE TANKS, AND TRAILERS AND TRUCKS THAT CARRY SUCH
STORAGE TANKS) MUST BE DISINFECTED USING A HIGH TEMPERATURE PRESSURE

EQUIPMENT USING THEIR OWN HIGH TEMPERATURE PRESSURE WASHER.
DISINFECTING OPERATIONS MUST OCCUR WITHIN 75 MILES OF THE NYC
WATERSHED, BUT NOT LOCATED ON NEW YORK CITY OWNED LAND.
DISINFECTING OPERATIONS ARE PROHIBITED ON LOCATIONS WHERE THE
RUNOFF FROM DISINFECTING WOULD ENTER A STREAM OR WATERBODY
LOCATED WITHIN THE NEW YORK CITY WATERSHED.
b. EQUIPMENT SHALL BE PROPERLY DISINFECTED BY A THIRD PARTY ENTITY
THAT SPECIALIZES IN HIGH TEMPERATURE PRESSURE WASHING
OPERATIONS. THE THIRD PARTY ENTITY MUST BE LOCATED WITHIN 75 MILES
OF THE NYC WATERSHED.
ALTERNATE DISINFECTION METHODS MAY BE AVAILABLE AND WILL REQUIRE PRIOR
APPROVAL BY THE NYCDEP FISHERIES BIOLOGIST OR NYSDEC REGIONAL BUREAU OF
FISHERIES AND THE ENGINEER-IN-CHARGE.
10. THERE IS NO SEPARATE PAYMENT FOR DISINFECTING EQUIPMENT; THE COST WILL BE
INCLUDED IN VARIOUS BID PRICES IN THE CONTRACT.
11. PRIOR TO PLACING ANY BOATS OR OTHER EQUIPMENT IN A WATERBODY THAT IS
LOCATED IN THE NYC WATERSHED, THE EIC SHALL CONTACT THE NYCDEP LAND
MANAGEMENT OFFICE NEAR THE RESERVOIR OF INTEREST 14 CALENDAR DAYS
PRIOR TO PERFORMING DISINFECTING OPERATIONS TO ARRANGE FOR A NYCDEP
REPRESENTATIVE TO BE PRESENT DURING DISINFECTING OPERATIONS. CONTACT

ANY FUTURE REVISION) WHEN WASHING BRIDGES OVER WATERBODIES OR WETLANDS
WITHIN THE WATERSHED.

NOTES FOR SEALING CONCRETE SURFACES OF BRIDGES OVER WATER BODIES
UTMOST CARE SHALL BE TAKEN TO PREVENT CONTAMINATION OF THE WATERBODY BY
THE SEALER. IF THE MANUFACTURER’S INSTRUCTIONS REQUIRE MIXING OF THE SEALER
PRIOR TO APPLICATION, MIXING SHALL OCCUR AT A MINIMUM HORIZONTAL DISTANCE OF
80 FEET FROM THE EDGE OF THE WATER. THE CONTRACTOR SHALL HAVE AVAILABLE FOR
IMMEDIATE USE MATERIALS SUCH AS SORBENTS OR BOOMS TO SOAK UP OR CONTAIN
ANY ACCIDENTAL SPILLS. PRIOR TO THE APPLICATION OF THE SEALER, ANY OPENINGS IN
THE SURFACE OF THE BRIDGE DECK OR IN THE WALKING SURFACE, SUCH AS SCUPPERS
OR OPEN DRAINS SHALL BE COVERED TO PREVENT CONTAMINATION OF THE WATERBODY.
CARE SHALL BE TAKEN TO PREVENT SPRAY FROM ENTERING THE WATERBODY BY EITHER
SPRAYING OR ROLLING THE SEALER AT THE EDGES AND SIDEWALK AREAS OR BY
PHYSICALLY ISOLATING THE AREA TO BE SPRAYED FROM THE WATERBODY BY THE USE
OF TARPS OR OTHER BARRIER-TYPE MEANS TO THE SATISFACTION OF THE ENGINEER-IN-
CHARGE.

BIRDS NESTING ON OR UNDER STRUCTURES AND PROTECTED BY THE MIGRATORY BIRD
TREATY ACT
A VARIETY OF BIRD SPECIES NEST ON OR UNDER BRIDGES, CULVERTS, AND BUILDINGS
(HEREAFTER REFERRED TO AS SIMPLY “STRUCTURES”). STATE AND FEDERAL LAWS PROTECT
SOME OF THESE BIRD SPECIES (AND THEIR NESTS, EGGS AND YOUNG). UNDER THE
MIGRATORY BIRD TREATY ACT (MBTA), IT IS UNLAWFUL TO INTENTIONALLY OR
UNINTENTIONALLY TAKE, CAPTURE OR KILL ANY MIGRATORY BIRD UNLESS A MIGRATORY
BIRD PERMIT IS FIRST OBTAINED FROM THE U.S. FISH AND WILDLIFE SERVICE. EACH
VIOLATION OF THE MBTA CAN RESULT IN A FINE OF $15,000, IMPRISONMENT FOR SIX MONTHS,
OR BOTH.
MIGRATORY BIRD SPECIES THAT ARE PROTECTED UNDER THE MBTA INCLUDE ALL
WATERFOWL, HERONS, EAGLES, HAWKS, FALCONS, OWLS AND SONGBIRDS (INCLUDING
SWALLOWS, EASTERN PHOEBES AND AMERICAN ROBINS).
MIGRATORY BIRD SPECIES THAT ARE NOT PROTECTED UNDER THE MBTA ARE ROCK DOVES
(DOMESTIC PIGEONS), ENGLISH SPARROWS, EUROPEAN STARLINGS AND MONK PARAKEETS.
ALTHOUGH THESE SPECIES ARE NOT PROTECTED, THEY SHOULD BE TREATED IN A HUMANE
MANNER. THE CONTRACTOR IS ENCOURAGED TO RELOCATE ACTIVE NESTS OF
UNPROTECTED SPECIES INTO NEARBY TREES OR TO TRANSFER THE NESTS TO A WILDLIFE
REHABILITATOR.
BEFORE COMMENCING ANY CONSTRUCTION ACTIVITIES, THE ENGINEER AND CONTRACTOR
SHALL SURVEY THE STRUCTURE(S) FOR BIRD NESTS. IF THE ENGINEER AND CONTRACTOR
OBSERVE BIRD NESTS ON OR UNDER THE STRUCTURE(S), THE FOLLOWING MUST BE
DETERMINED FOR EACH NEST:
1. IS THE NEST ACTIVE (ADULT BIRDS, EGGS OR YOUNG BIRDS IN THE NEST).
2. IS THE NEST INHABITED BY A PROTECTED MIGRATORY BIRD SPECIES.
A NEST SHOULD BE CAREFULLY EXAMINED OR OBSERVED FOR SEVERAL CONSECUTIVE
HOURS TO DETERMINE IF IT IS ACTIVE OR INACTIVE. AN ACTIVE NEST IS INDICATED BY ADULT
BIRDS CONSTRUCTING THE NEST, BIRDS FLYING TO AND FROM THE NEST, SOUNDS OF YOUNG
IN THE NEST, OR BIRD SPECIES MATCHING THE NEST-TYPE FLYING IN THE VICINITY OF THE
NEST. IF NONE OF THESE ACTIVITIES ARE OBSERVED, THE NEST CAN BE ASSUMED TO BE
INACTIVE AND IT CAN BE REMOVED AND STRUCTURE WORK CAN COMMENCE.
IF THE NEST IS DETERMINED TO BE ACTIVE, IT MUST BE CAREFULLY EXAMINED FOR THE
PRESENCE OF YOUNG BIRDS AND EGGS. IF YOUNG BIRDS OR EGGS ARE ABSENT, THE NEST
CAN BE REMOVED ANYTIME AN ADULT BIRD IS NOT PRESENT. WORK SHOULD COMMENCE AS
QUICKLY AS POSSIBLE TO PREVENT BIRDS FROM BEGINNING A SECOND NEST BROOD AT THE
SAME LOCATION.
IF YOUNG BIRDS OR EGGS ARE PRESENT IN THE NEST, IT CANNOT BE REMOVED, DAMAGED OR
DISTURBED UNTIL THE YOUNG BIRDS HAVE FLEDGED (LEAVE THE NEST). AFTER THE YOUNG
HAVE FLEDGED, THE NEST CAN BE REMOVED AND STRUCTURE WORK MAY COMMENCE. WORK
SHOULD COMMENCE AS QUICKLY AS POSSIBLE TO PREVENT BIRDS FROM BEGINNING A
SECOND NEST BROOD AT THE SAME LOCATION.

CONSTRUCTION ACTIVITIES HAVE THE POTENTIAL TO RESULT IN A RELEASE/SPILL OF
PETROLEUM OR OTHER CHEMICALS. IN ADDITION, INDICATORS OF PREVIOUSLY
CONTAMINATED MATERIAL MAY BE ENCOUNTERED DURING CONSTRUCTION ACTIVITIES.
THE CONTRACTOR MUST REPORT ALL PETROLEUM AND CHEMICAL SPILLS TO THE NYS
DEC SPILL HOTLINE (1-800-457-7362) WITHIN 2 HOURS OF DISCOVERY, EXCEPT SPILLS
WHICH MEET ALL THE FOLLOWING CRITERIA:
1.
THE QUANTITY IS KNOWN TO BE LESS THAN 5 GALLONS; AND
2.
THE SPILL IS CONTAINED AND UNDER THE CONTROL OF THE SPILLER; AND
3.
THE SPILL HAS NOT AND WILL NOT REACH THE STATE'S WATER OR ANY LAND; AND
4.
THE SPILL IS CLEANED UP WITHIN 2 HOURS OF DISCOVERY.
A SPILL IS CONSIDERED TO HAVE NOT IMPACTED LAND IF IT OCCURS ON A PAVED
SURFACE SUCH AS ASPHALT OR CONCRETE. A SPILL IN A DIRT OR GRAVEL PARKING LOT
IS CONSIDERED TO HAVE IMPACTED LAND AND IS REPORTABLE.
ALL SPILLS THAT REQUIRE REPORTING TO DEC MUST ALSO BE REPORTED TO THE
ENGINEER-IN-CHARGE AS SOON AS POSSIBLE.

THE CONTRACTOR IS PERMITTED TO WASH THE ABOVE BRIDGES AS LONG AS THE PAINT
RATING IS 4 OR GREATER. AS STATED IN ENGINEERING INSTRUCTION (EI) 19-002, BRIDGES
WITH FLAKING PAINT (PAINT RATING OF 3 OR LESS) SHOULD NOT BE WASHED.
BRIDGE/BAT SURVEY
THE BRIDGE SHALL BE INSPECTED FOR EVIDENCE OF ROOSTING BATS PRIOR TO
COMMENCING ANY WORK. THE INSPECTION SHALL BE COMPLETED BETWEEN APRIL 1ST
AND SEPTEMBER 30TH WITHIN TWO (2) YEARS OF THE START OF WORK ON THE UNDERSIDE
OF THE BRIDGE. THE BRIDGE/BAT SURVEY CAN BE CONDUCTED BY AN INDIVIDUAL FROM
THE GROUND BELOW THE BRIDGE WITH THE USE OF BINOCULARS. INDICATORS INCLUDE
SIGHTINGS, DROPPINGS, STAINING, OR SOUND. ADDITIONAL GUIDANCE IS AVAILABLE IN
THE FOLLOWING DOCUMENT:
