Meeting of the Board of Trustees of the Village of Croton-on-Hudson, NY, held on
Monday, October 30, 2023, in the Georgianna Grant Meeting Room at the Stanley
Kellerhouse Municipal Building, Van Wyck Street, Croton-on-Hudson, NY 10520.
The following official was absent:

1. CALL TO ORDER
Mayor Pugh called the meeting to order at 7:00pm and led everyone in the
Pledge of Allegiance.
Trustee Simon made a motion to approve the following Fiscal Year Vouchers,
claims numbered 23242505 through 23242729. The Motion was seconded by
Trustee Gallelli and approved with a 5-0 Vote.

3. PUBLIC HEARING
A motion to open the Public Hearing to consider the Special Permit renewal
application from Verizon Wireless to collocate a personal wireless facility at 1
Van Wyck Street was made by Trustee Simon. Motion was seconded by
Trustee Nicholson and approved with a 4-0 vote.
There being no comments to come before the Board a motion to close the
Public Hearing was made by Trustee Horowitz. Motion was seconded by
Trustee Simon and approved with a 4-0 vote.

On motion of TRUSTEE SIMON, seconded by TRUSTEE HOROWITZ, the following
resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New
York with a 4-0 vote.
WHEREAS on December 3, 2018, the Board of Trustees unanimously adopted a resolution
issuing a special permit to New York SMA Limited Partnership, d/b/a Verizon Wireless, for
the collocation of a personal wireless facility at 1 Van Wyck Street, and
WHEREAS the special permit was issued with a number of conditions as recommended by
the Village Engineer and Planning Board, and
WHEREAS, the permit expires on December 3, 2023, and must be renewed in accordance
with the Telecommunications Chapter of the Village Code; and
WHEREAS the Village has received a request for renewal from Verizon Wireless
and the associated special permit application fee, and
WHEREAS a Public Hearing on the special permit application was opened and
closed on October 30, 2023,
NOW THEREFORE BE IT RESOLVED the Village Board of Trustees does hereby renew the
special permit held by New York SMA Limited Partnership d/b/a Verizon Wireless for the
for the collocation of a personal wireless facility at 1 Van Wyck Street, with the following
conditions:
(1)
This permit expires on December 3, 2028, and must be renewed in accordance
with the Telecommunications Chapter of the Village Code.
(2)
The Telecommunications facility shall at all times during the life of the facility
comply with the applicable FCC regulations pertaining to radio frequency
emissions, including such regulations as applicable to cumulative radio frequency
emissions. Any necessary mitigation measures to ensure compliance shall follow
FCC requirements, procedures and protocols.
(3)
The tower, including mounted equipment, guy wires, anchors, and all tower
support structures in the attic, be inspected annually by a qualified individual and
a report on the inspection results be submitted to the Village within 30 days of the
inspection.

(4)
In accordance with section 206-5(B) of the Village Code, antennas shall be subject
to state and federal regulations pertaining to nonionizing radiation and other
health hazards related to such facilities. The owner of the antenna shall submit to
the Board of Trustees evidence of compliance with the FCC standards on a yearly
basis. If new, more restrictive standards are adopted, the antennas shall be made
to comply, or continued operations may be restricted or prohibited by the Board of
Trustees. The cost of verification of compliance shall be borne by the owner and
operator of the personal wireless facility.
(5)
Verizon Wireless is advised that the Village may switch to a different Emergency
Services communication system in the future and that the Verizon Wireless system
must be operated to prohibit interference, including implementation of any FCC
rebanding plan, to current and future Village wireless systems.
(6)
Any additional monthly cost charged by the Village’s fire alarm company for the
fire/smoke detector and strobe/horn in the facility shall be paid by Verizon
Wireless. The lease agreement with Verizon Wireless shall be amended to reflect
the payment of this additional cost if required by the Village via written notification
to Verizon Wireless.

As required in the Telecommunications Chapter of the Village Code, the applicant
must post a bond in an amount to be determined by the Village Engineer to cover
the costs of removing and disposing of the tower, antenna and associated
facilities. In the event that a tower is not removed within 90 days of the cessation
of operations at a site, the tower and associated facilities may be removed by the
Village and the costs of removal assessed against the property, the bond or both.
(8)
Proper radio frequency and antenna location warning signs be posted and
maintained at the PWS facility compound at 1 Van Wyck Street.
Trustee Simon stated that the Village is working with a consultant with respect to
upgrading cell service throughout the Village, and one of the things they are looking at is
the potential of using “small cell” technologies that could be placed on light polls and
asked what Verizon’s view is toward this type of technology.

Representative from Snyder and Snyder stated that Verizon has definitely expanded their
network using “small cell” technology and they have entered into Franchise Agreements
with several municipalities across Westchester and will bring this back to Verizon.

Trustee Simon thanked the Telecommunications Committee for their hard work
in putting this survey together and looks forward to the public’s response.
Trustee Horowitz stated that the survey asks the community to rate cellular
service throughout the Village, but her service changes throughout the Village,
some places it is great and some places it does not exist and believes this is a
difficult question to answer. Trustee Horowitz also asked what the scenario
would be with respect to the question about accepting a Monopole if no
alternatives are available.
Village Manager Healy stated that some of the other technologies are more
expensive, and companies may not be willing to invest in them, but after we
have received the surveys back from the community, the Board will have the
opportunity to discuss it in more detail.

d. Draft Letter from Village Manager Bryan Healy to the New York State Office
of Cannabis Management responding to the notification for a dispensary to be
located at 440 South Riverside Avenue.

On motion by Trustee Simon and seconded by Trustee Nicholson, the Board of
Trustees approved suspending the Rules of Procedure to allow the applicant’s
attorney to address the Board. Motion was approved with a 4-0 vote.
Andy Schriever of the Law Firm of Prince Lobell stated that he understands
there are some concerns regarding parking and traffic. Mr. Schriever advised
that his client has met with a traffic consultant who will be able to address
some of those concerns and suggested that the Board request a thirty-day
extension to send in their comments to the Cannabis Board. Mr. Schriever
directed everyone to the NYS Office of Cannabis Management Website which
gives an overview of the process.

Trustee Nicholson asked if the applicant would have to go before the Planning
Board and if Mr. Schriever knows if the Cannabis Board will be limiting the
number of licenses in Westchester. Trustee Nicholson expressed her concern
that this particular location would become a destination and could be a problem
for this area if there were no other establishments in our surrounding
communities.
Mr. Schriever stated that because the location is currently not a retail store, the
applicant would need to go before the Planning Board. Mr. Schriever directed
the Board to the Cannabis Board’s Website under Frequently Asked Questions
regarding the number of licenses being issued in Westchester.
Village Attorney Whitehead stated that the applicant cannot submit their
application until the thirty-day notice period has ended. Village Attorney

Whitehead added that her law firm has been dealing with this in other
municipalities, the Office of Cannabis Management has been trying to get this
rolled out before they even had their regulations in place and there has been a
lot of problems with the roll-out.
Trustee Nicholson stated that she believes the public should have the
opportunity to address their concerns, and that we make the public aware that
there will be a continuation of this discussion going forward.
Trustee Horowitz asked if there will be a formal public hearing.
Village Attorney Whitehead stated that there are no requirements for a formal
public hearing, the requirement is that they file a notice advising a municipality
that they will be filing an application, and the Board has the opportunity to
provide comments to the Office of Cannabis Management. Village Attorney
Whitehead reminded everyone that they would only have to appear before the
Planning Board if there was a change of use for the location they are
considering.
Village Manager Healy asked that the Board approve him sending a letter to the
Office of Cannabis Management requesting a thirty-day extension for their Board
to submit their comments.
On motion by Trustee Simon, seconded by Trustee Horowitz, the Board
approved Village Manager Healy to request a thirty-day extension with respect
to the application for a Cannabis dispensary at 440 South Riverside Avenue.
Motion was approved with a 3-1 vote, Trustee Nicholson voting Nay.
6. PUBLIC COMMENTS ON AGENDA ITEMS:
Marilyn Grantner, 115 Cleveland Drive, Croton on Hudson, suggested that
the Board consider holding a meeting in a place where parents could bring
their children when the Board discusses the Local Law revising regulations
for accessory apartments and permit accessory cottages.
Ed Riely, 110 Truesdale Drive, Croton on Hudson, addressed his concerns
with the process of congressional redistricting, objects to the way the
Statement of Inclusivity was created, behind closed doors, without public
input, and believes that people with different political beliefs are being
harassed in this community.

Ray Logiudici, 41 Whelan Avenue, Croton on Hudson, stated that he is glad
that the Village opted into allowing a Cannabis Dispensary in Croton and
supports the application.
Comments received via E-mail:
Michael Corveddu, 199 Broadway, Tarrytown, New York, states in his email
dated October 30, 2023, that he strongly supports Tom Moore’s application
for a Cannabis dispensary in Croton, prior to moving to Tarrytown he was a
Croton resident for over twenty years and a former football teammate of
Tom Moore.
Tyler Dorien, 2 Elm Street, Croton on Hudson, states in his email dated
October 30, 2023, he wholeheartedly supports opening a Cannabis
dispensary in the Shoprite shopping center.
Vincent Guido, 23 Beekman Avenue, Croton on Hudson, states in his email
dated October 30, 2023, that he supports the opening of a Cannabis
dispensary at the Shoprite shopping center,
Daniel Bennett, 40 Van Wyck Street, Croton on Hudson, states in his email
dated October 30, 2023, that the applicant needs to include in their letter to
the Board that there is a children’s dance studio that holds programs for
children staring at age 1 ½, their letter mentions Shoprite, multiple medical
practices, a restaurant and a sport club, but not the dance studio.
Joe Tralli, 188 Windsor Road, Fishkill, NY, states in his email dated October
30, 2023, that he supports a Cannabis dispensary in Croton.
Tyler Keppler, no address given, states in his email dated October 30, 2023,
that he supports a Cannabis dispensary in Croton.
7. PREVIOUSLY APPROVED RESOLUTIONS

mutual understanding by ensuring all people, regardless of race, religion, disability,
sexual orientation, gender identity, national origin or immigration status may live free

NOW THEREFORE BE IT RESOLVED that the Statement of Inclusivity of October 23, 2023,
is approved and adopted in order to foster and advance the goals of making the Village of
Croton-on-Hudson a just, equitable, diverse and inclusive community.

The Village of Croton-on-Hudson affirms the human rights of all who visit, work or live in
our Village. We aim to be an inclusive and safe place for all people regardless of race,
ethnicity, nationality, gender identity, sexual identity, faith, disability, language,
socioeconomic status and immigration status.
8. RESOLUTIONS:
Resolution 220 of 2023
On motion of TRUSTEE SIMON, seconded by TRUSTEE HOROWITZ, the following
resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New
York with a 4-0 vote.
WHEREAS as a general rule, the Village makes payment to vendors by check, and
WHEREAS some payments are required to be made by wire, and
WHEREAS because of the increase in wire transfer fraud, it is prudent to have a written
policy in place that governs the procedures for Electronic Funds Transfers (EFTs), and
WHEREAS at the recommendation of the Village’s insurance company, the Village
Treasurer has prepared an Electronic Funds Transfer (EFT) Policy,
NOW THEREFORE BE IT RESOLVED that the Board of Trustees hereby adopts the
attached Electronic Funds Transfer (EFT) Policy for the Village of Croton-on-Hudson.

On motion of TRUSTEE SIMON, seconded by TRUSTEE SIMON, the following resolution
was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New York with
a 4-0 vote.

WHEREAS the Village of Croton-on-Hudson is interested in pursuing grant funding for
projects that improve access to public transportation, create new and enhance existing
bicycle and pedestrian facilities, and create safer routes to schools, and
WHEREAS the 2023 round of the Transportation Alternatives Program (TAP),
administered by the New York State Department of Transportation (NYSDOT), provides
grant funding for a variety of transportation-related projects which increase options for
non-vehicular transportation, with a minimum grant request of $500,000, and
WHEREAS due to the complex and technical requirements of the grant, the Village of
Croton-on-Hudson desires to contract with a professional grant writer to assist in the
preparation of the application, and
WHEREAS C.T. Male Associates of Latham, New York, has prepared a proposal for grant
application preparation services in the amount of $5,600, and
NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby accepts the
proposal from C.T. Male Associates in an amount not to exceed $5,600, and
BE IT FURTHER RESOLVED that funding for this expense will be available in the 2023-
2024 General Fund Budget in the following account:

On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE NICHOLSON, the following
resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New
York with a 4-0 vote.
WHEREAS the Village would like to amend and update the definition of family as stated in
Chapter 230, Zoning, of the Code of the Village of Croton-on-Hudson, and
WHEREAS the Village Board is considering taking an action to adopt Local Law
Introductory No. 19 of 2023 which has been drafted for such purposes, and
WHEREAS the Village has completed Part 1 of a Short Environmental Assessment Form
(EAF) and a Coastal Assessment Form (CAF), and

On motion of TRUSTEE HOROWITZ seconded by TRUSTEE NICHOLSON, the following
resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New
York with a 4-0 vote.
WHEREAS the 2023-2024 Enacted State Budget amended the tax law to clarify which
income tax year applies when determining income eligibility for the senior citizens tax
exemption, and
WHEREAS the Village of Croton-on-Hudson must amend Chapter 204 of the Village Code,
Taxation, to reflect the state’s amendment, and
WHEREAS Local Law Introductory No. 20 of 2023 has been drafted for such purposes,
NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby schedules a
Public Hearing on Monday, November 13, 2023, at 7:00 PM in the Georgianna Grant
Meeting Room of the Stanley H. Kellerhouse Municipal Building to consider Local Law
Introductory No. 20 of 2023 to amend Chapter 204 of the Village Code, Taxation, to
clarify which income tax year applies when determining income eligibility for the senior

On motion of TRUSTEE SIMON, seconded by TRUSTEE HOROWITZ, the following
resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New
York with a 4-0 vote.
WHEREAS on November 16, 2020, the Village Board of Trustees issued a special permit
to M & J Auto Repair Corp. to operate a motor vehicle repair garage at 485 S. Riverside
Avenue, and

WHEREAS this permit expires on November 15, 2023, and must be renewed in
accordance with the Zoning Chapter of the Village Code, and
WHEREAS the Village Board of Trustees has received an application from Marco Ordonez
of M & J Auto Repair Corp. to renew the special permit to operate a motor vehicle repair
garage and modify the special permit to include an existing 6' x 12' shed to store various
equipment and supplies; and
WHEREAS renewal and modification of the special permit is a Type II action under the
New York State Environmental Quality Review Act, which does not require an
environmental review,
NOW THEREFORE BE IT RESOLVED that the Village Board hereby refers the special
permit application to the Village Planning Board in accordance with Village law, and
BE IT FURTHER RESOLVED that the Village Board of Trustees hereby schedules a Public
Hearing on November 13, 2023, at 7:00 PM in the Georgianna Grant Meeting Room of
the Stanley H. Kellerhouse Municipal Building to consider the application from Marco

On motion of TRUSTEE SIMON, seconded by TRUSTEE HOROWITZ, the following
resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New
York with a 4-0 vote.
WHEREAS on January 6, 2020, the Village Board of Trustees created the Croton Housing
Task Force, which was charged with examining all aspects of housing in Croton-on-
Hudson with special attention to affordability and the issues raised by the 2019
Westchester County Housing Needs Assessment, and
WHEREAS in November of 2021, the Croton Housing Task Force released a report
containing recommendations to address housing stock and housing affordability issues in
the Village of Croton-on-Hudson, and
WHEREAS one such recommendation outlined in the Croton Housing Task Force Report
was to consider modifying the Village’s Zoning Code to facilitate additional legal

accessory dwelling units (ADUs), thereby creating additional affordable housing options
through a more efficient use of existing housing stock, and
WHEREAS the Village Board of Trustees has since conducted numerous Work Session
discussions on the topic and has incorporated feedback from the Croton Housing Task
Force; the Westchester County Department of Planning Accessory Dwelling Unit (ADU)
Model Ordinance; the Pace Land Use Law Center; the Village Planning Board, and local
residents, and
WHEREAS following these discussions, the Village would like to amend Chapter 230,
Zoning, of the Village Code to update regulations related to accessory apartments and
permit accessory cottages in residential districts, and
WHEREAS Local Law Introductory No. 21 of 2023 has been drafted for such purposes,
NOW, THEREFORE BE IT RESOLVED:
1. The Village Board hereby determines that the Proposed Action is an
Unlisted action and declares itself to be the Lead Agency for SEQRA
purposes,
2. The Village Board hereby issues the Environmental Assessment Form (EAF)
and Coastal Assessment Form (CAF) which it has before it in connection
with the Proposed Action,
3. The Village Board hereby refers to the Village Planning Board the Draft
Law for a report back to the Village Board in accordance with Village law,
4. The Village Board hereby refers the Draft Law, the EAF and the CAF to the
Village Waterfront Advisory Committee for a recommendation back to the
Village Board in accordance with Village Law,
5. The Village Board hereby refers the Draft Law, the EAF and the CAF to the
Westchester County Planning Board for review in accordance with law,
6. The Village Board hereby directs Village staff to make any other circulations
and notifications regarding the Proposed Action as may be required by law.

On motion of TRUSTEE HOROWIZ, seconded by TRUSTEE SIMON, the following resolution
was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New York with
a 4-0 vote.
WHEREAS there are a number of capital projects that have been completed and reviewed
through the Village’s annual third-party audit, and
WHEREAS the Village Treasurer recommends closing the capital accounts associated with

NOW THEREFORE BE IT RESOLVED: that the Board of Trustees authorizes the Village
Treasurer to close the above listed accounts as of May 31, 2023, and return $27,403 to
the Debt Service Fund and $2,363 to the General Fund; and
BE IT FURTHER RESOLVED: that $27,901 shall be reclassified from Projects 17334,
19350, 20364, 21377, 22389, and 23438 to Project 24462; and
BE IT FURTHER RESOLVED: that the Village Board hereby rescinds Resolution #165-
2023, which was adopted on July 10, 2023.
Resolution 227 of 2023
On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE SIMON, the following
resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New
York with a 4-0 vote.
WHEREAS police services were requested for various events and functions during this
fiscal year, and
WHEREAS police officers are assigned to these events and functions to conduct traffic
control, as well as to ensure safety for residents and visitors to the Village, and
WHEREAS the organizations have agreed to pay the cost of the overtime for these
officers, and
WHEREAS New York State and Westchester County have also provided grant funds to
cover special details,
NOW THEREFORE BE IT RESOLVED that the Village Treasurer is authorized to amend the
General Fund 2023-2024 budget in the amount of $45,432.55:

Resolution 228 of 2023
On motion of TRUSTEE SIMON, seconded by TRUSTEE HOROWITZ, the following
resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New
York with a 4-0 vote.
WHEREAS the STOP-DWI High Visibility Engagement Campaign Program is an overtime,
added, patrol effort to enforce the New York State Vehicle and Traffic Laws against
intoxicated and impaired driving (DWI/DWAI) in Westchester County, and
WHEREAS the Croton-on-Hudson Police Department wishes to participate in this program,
and
WHEREAS the Village may seek reimbursement from the County for an amount not to
exceed $10,000 for costs related to this program, and
WHEREAS the commencement date of this agreement is October 1, 2023, and terminates
on September 30, 2024,
NOW THEREFORE BE IT RESOLVED that the Board of Trustees hereby authorizes the
Village Manager to execute the STOP-DWI High Visibility Engagement Campaign Program
Inter-Municipal Agreement with Westchester County for the period between October 1,
2023, and September 30, 2024.
9. PUBLIC COMMENTS ON NON-AGENDA ITEMS
Marilyn Grantner, 115 Cleveland Drive, Croton on Hudson, asked that the Board
consider painting yellow lines fifteen feet on either side of a fire hydrant to give
people a better idea of how close they are to a fire hydrant.

Village Manager Healy advised that we have over four hundred fire hydrants
throughout the Village, and it might be very labor intensive, but he will be happy
to discuss it with our Department of Public Works Superintendent and maybe we
can consider doing this in some of the problem areas.
Ed Riely, 110 Truesdale Drive, Croton on Hudson, talked about issues relating to
our current administration regarding inflation, objected to the Statement of
Inclusivity and asked for the names of those that proposed this statement, objects
that Ad Hoc Committee meetings are not posted on the Village’s website so that
community members can attend, asked that the local Village election be moved to
March, and addressed illegal immigration and its effect on housing.
Tony Granger, Half Moon Bay, Croton on Hudson, requested that names and
addresses of those responding to the telecommunication survey be included. Mr.
Granger stated that he is concerned we may be going down a slippery slope with
respect to the Statement of Inclusivity because there may be other groups that will
look to be included and be invited to a seat at the table. Mr. Granger addressed
other issues that can be heard by logging onto the Village’s website.

10. APPROVAL OF MINUTES:
Motion to approve the minutes as amended of the Regular Meeting held on
September 26, 2023, was made by Trustee Simon. The motion was seconded by
Trustee Horowitz and approved with a 4-0 vote.

11. REPORTS
Trustee Nicholson wished everyone a happy Halloween and thanked everyone in
the community for supporting the Goblin Walk and making it an enormous success.
Trustee Simon advised that the Planning Board met on October 17th, and they
continue to work with the developers of 352 South Riverside, the Bicycle and
Pedestrian Committee met on October 18th and talked about the new Grant
opportunity, Columbian Hook and Ladder held their annual barbeque last Saturday,

on October 22nd the Welcome Wagon held a reception at Senasqua Park for new
residents, on November 13th the second meeting of our All Business Group will
meet, he will be attending a meeting next week that Congressman Pat Ryan has
put together regarding Hudson River barges, advised that there has been two
interfaith gatherings in the community regarding the incidents that occurred in
Israel as well as a discussion of the growing antisemitism.
Trustee Horowitz advised that on October 24th an “Old Croton Aqueduct in Art” talk
was held at the Croton Library and thanked Cornelia Cotton for her presentation,
this past Thursday she, Carolyn Whiting, and Nenad Bach went to the 41-51
construction site and were able to get into original building and wrote messages as
part of the 125th Anniversary Time Capsule project, thanked all those that
participated in the Goblin Walk as well as the Dog Parade, first Riverview Jazz
Concert Series is scheduled for Sunday, November 12th, and our local Audubon
Society held a Webinar last week on how to create bird feeders in your backyards.
There being no further business to come before the Board a motion to close the
meeting was made by Trustee Simon. The motion was seconded by Trustee
Horowitz and approved with a 4-0 vote. The meeting was adjourned at 8:27pm
