The Village Board is holding a public hearing this evening on Local Law Introductory No. 3 of 2024,
which would repeal Chapter 66 of the Village Code and incorporate it into Chapter 230 of the Village
Code. The Village Board will not be voting on this law tonight.
You may recall that in 2022, the Village undertook the process of reviewing the entire Village Code
for inconsistencies, outdated references and other items which generally needed to be updated. This
review process was undertaken by General Code, the publisher of our Village Code, and they
identified more than 100 items which could potentially be updated. The Village staff has been working
through these items since that time.
One of the items identified was the chapter on Adult Entertainment Use Businesses. It was noted that
“adult entertainment uses are not mentioned anywhere in Chapter 230, Zoning, including the listing
of permitted principal uses or special permit uses for the LI District.” Upon further discussion with
the Village Attorney, it was decided to incorporate the regulations on these businesses directly into
the Zoning Chapter.
The two items which are being changed as part of this incorporation are: the updating of definitions
to reflect the current realities of today (the law was originally adopted in 1994) and the removal of the
prohibitions against these businesses where residential uses are permitted. As has been mentioned by
the Village Attorney previously, municipalities are not permitted to prohibit these businesses
completely; there must be some area in the Village where such business are permitted to operate,
albeit with strict standards. The Village decided long ago that the Light Industrial (LI) District would
permit these businesses. With the addition of the transit-oriented community overlay zoning in the LI
District, it has become necessary to tweak the original language to ensure the Village is not acting
unconstitutionally.
