TO: Mayor Brian Pugh and the Village Board of Trustees FROM: Chairman Simon, Waterfront Advisory Committee RE: Referral from Village Board for a Local Waterfront Revitalization Program (LWRP) Consistency review for Local Law Introductory 5 of 2024 to update Chapter 206, Telecommunications Towers, of the Village Code to provide for the regulation of wireless facilities in the Village (Revised). DATE: May 21, 2024 On May 20th, 2024, the Waterfront Advisory Committee (WAC) reviewed for consistency with the Village’s Local Waterfront Revitalization Program (LWRP) the referral listed above. Based on the Committee’s review of the 44 LWRP policies, the Waterfront Advisory Committee made a recommendation of consistency with the LWRP. The WAC reviewed the Coastal Assessment Form and had no changes. The WAC reviewed the Short Environmental Assessment Form and had no changes. The committee reviewed the 44 LWRP policies and determined that the following policy is relevant: POLICY 5: Encourage the location of development in areas where public services and facilities essential to such development are adequate. POLICY 6: Expedite permit procedures in order to facilitate the siting of development activities at suitable locations. POLICY 19: Protect, maintain, and increase the level and types of access to public water- related recreation resources and facilities. As further described in sub-policies 19A, 19B and 19D. POLICY 25: Protect, restore or enhance natural and man-made resources which are not identified as being of statewide significance, but which contribute to the overall scenic quality of the coastal area. POLICY 37A: Control of the development of hilltops, and steep slopes should be exerted in order to prevent erosion and minimize runoff and flooding from new construction. PROJECT 5: Improve Echo Canoe Launch and Village-Owned Land at the Southern End of the Train Station Parking Lot. This project supports the continued improvement of this recreational area to enhance public access to the Croton River and Bay and the Hudson River. A cell tower was proposed adjacant to Echo Canoe Launch, but was relocated north to its current location. PROJECT 10: Undertake Management and Capital Improvement Plan for Village Parks, Trails, Open Spaces and Memorials. The purpose of this project is for the Village to create a conceptual plan that will examine how to best utilize Gouveia Park, a 15.63 – acre site acquired by the Village. Any conceptual plan for the park should also address tower-based wireless facilities. The proposed local law provides enhanced regulations for wireless facilities to balance the need for wireless services and the protection of the environment. It is for the reasons contained in this memorandum that the WAC issues its recommendation of consistency.
