To: From: Date: September 13, 2024 Re: Local Law Intro 10 of 2024 (Reservation of Parkland) The Zoning Code of the Village of Croton-on-Hudson provides for the reservation of parkland, or the payment of a fee in lieu thereof, on any site plan that includes residential units. Traditionally in the Village, this has usually involved the subdivision of a parcel to create buildable lots. However, the Village has largely become built out in terms of subdividable property. In discussion with the Village Attorney, it was decided to clean up the language in two sections of the Village Code to make clear that the requirements apply to all new developments, irrespective of a development involving a subdivision. In July, the Village Board referred the local law to the Village Planning Board, Waterfront Advisory Committee (WAC) and the Westchester County Planning Board. The WAC made a recommendation of consistency to the Village Board and the Westchester County Planning Board found the matter to be a decision for local determination. The Village Planning Board recommended two changes to the draft local law, both of which have been found to be acceptable. Please let me know if you have any questions regarding the above.
