Dear Mr. Hernandez,
Please be advised that this letter serves as a stop work order for construction activity occurring in the
New York State Right of Way (ROW). All activity in the New York State Department of Transportation
(NYSDOT) Right of Way requires a valid NYSDOT Highway Work Permit pursuant to Section 1220-C of the
New York State Vehicle and Traffic Law and Article 3, Section 52 of the New York State Highway Law.
A Highway Work Permit, 2020 08 88080, issued on 12/29/2020 and expired on 5/15/2021 provided for
the installation of a temporary construction entrance and removal of all construction materials, debris
and cinder block wall in the State Right of Way. The wall has not been removed. Additional permanent
stone knee walls, stairs and drainage structures have been constructed in the State Right of Way
without a valid Highway Work Permit or a Use and Occupancy/Surplus Property permit. These
structures cannot remain in place and will need to be removed from the NYSDOT ROW.
All construction activity within the NYSDOT ROW shall cease, and all equipment and materials currently
in the State ROW shall be removed except for safety fencing and supports. A Highway Work Permit with
NYSDOT approved plans shall be obtained prior to restarting any work in the State Right of Way.
