THIS AGREEMENT made by and between the TOWN OF OSSINING, a municipal corporation with its place of business at 16 Croton Avenue, Ossining, New York 10562 ( hereinafter referred to as " the Town") and the VILLAGE OF CROTON- ON- HUDSON, a municipal corporation with its principal place of business at 1 Van Wyck Street, Croton- on-Hudson, New York 10520 hereinafter referred to as " the Village), it is hereby agreed as follows: Whereas, a new bikeway/ walkway has been constructed by the New York State Department of Transportation as part of the Croton River Bridge Replacement Project; and Whereas, it is incumbent on the part of both the Village and the Town to provide ongoing maintenance to the bikeway/walkway to include the responsibility for the bikeway/ walkway lights, snow removal, litter removal, maintenance of the asphalt and the areas off of the asphalt, and Whereas, the Village and the Town have determined that it would be most efficient to have one government responsible to provide the snow removal and light maintenance; and Whereas, it is the desire of the Town and Village to enter into this Agreement pursuant to the provisions of the General Municipal Law whereby only the Village shall be responsible for the snow removal and maintenance of the street lights for the entire walkway and each municipality shall be responsible for all other maintenance and repair work within each municipality' s respective boundaries, NOW THEREFORE, IT IS AGREED AS FOLLOWS: 1. That the Town and the Village hereby agree that for the period of five years from the date hereof, the Village shall be responsible for walkway light repair and snow removal of the entire walkway. The Town and Village further agree that each municipality shall be responsible for all other repairs and maintenance within their respective boundaries. 2. That the Town will pay the Village, not later than January 31 of each year, for the performance of these services within the area of the Town the following amount per year: No later than January 31, 2015 $ 2, 444 No later than January 31, 2016 $ 2, 566 No later than January 31, 2017 $ 2, 694 No later than January 31, 2018 $ 2, 829 No later than January 31, 2019 $ 2, 970 MAR 3 0 2015 j) ULINE R.
