Regular Meeting of the Board of Trustees of the Village of Croton-on-Hudson, NY, held on Wednesday, April 9, 2025, in the Georgianna Grant Meeting Room at the Stanley Kellerhouse Municipal Building, Van Wyck Street, Croton-on-Hudson, NY 10520. 1. Mayor Pugh called the meeting to order at 7:00pm and led everyone in the Pledge of Allegiance. Mayor Pugh asked for a moment of silence on the passing of former Trustee William Ryder. 2. PRESENTTION: a. Presentation by Dan Welsh, Program Director from Sustainable Westchester on the Upcoming Westchester Power CCA Program Renewal for Croton-on-Hudson. APPROVAL OF VOUCHERS Trustee Simon made a motion to approve the following Fiscal Year Vouchers, Claims numbered 24254454-242544646. The Motion was seconded by Trustee Nicholson and approved with a 5-0 Vote. $494,929.91 Water Fund $25,776.32 Sewer Fund $4,892.75 Capital Fund $111,509.64 Trust Fund $4,018.50 4. Subin Trustee Politi Village Treasurer Genette Toone Trustee Slippen Village Board of Trustees April 9, 2025 On motion by Trustee Simon and seconded by Trustee Nicholson the Board of Trustees of the Village of Croton-on-Hudson approved the Consent Agenda. Motion was approved with a 5-0 vote. Trustee Simon thanked the Croton Rotary Club on their donation of two redbud trees to be planted at the COVID-19 Memorial Grove and Susan O’Keefe of Baked by Susan who has offered to donate pies, t-shirts, gift certificates and supplies for the annual pie eating contest at Summerfest. Trustee Nicholson asked how the use of gas-powered blowers are going to be handled with respect to our landscaping services. Village Manager Healy explained that the existing contract was negotiated in 2023, when we were getting ready to renew the current agreement, they agreed to abide by the Village’s ban on gas-powered blowers for six months of the year that the ban is in effect with the exception of some of our larger fields and parks. Village Manager Healy explained that this is the third and final year of this contract and when we go out to bid next year, we will rewrite the bid to reflect the restrictions on the use of gas-powered blowers. 6. Resolution #67-2025 Village Board of Trustees April 9, 2025 On motion of TRUSTEE SIMON and seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton- on-Hudson, New York with a 5-0 vote. WHEREAS in 1872, J. Sterling Morton proposed to the Nebraska Board of Agriculture that a special day be set aside for the planting of trees, and WHEREAS Arbor Day is now observed throughout the nation and the world, and WHEREAS trees provide an abundance of environmental and aesthetic advantages to citizens and wildlife, wherever they are found, and WHEREAS trees in our Village increase property values, enhance the economic vitality of business areas, and beautify our community, and WHEREAS the Village of Croton-on-Hudson has been recognized as a Tree City USA by the National Arbor Day Foundation since 1984 and desires to continue its tree-planting program, NOW THEREFORE BE IT RESOLVED that the Village of Croton-on-Hudson, on behalf of the Village Board of Trustees, does hereby proclaim April 25, 2025, as “Arbor Day”, and BE IT FURTHER RESOLVED that all residents of the Village of Croton-on-Hudson are urged to support efforts to preserve our urban forests, cool our streets, clean our air, reduce our carbon footprint and improve our overall state of wellbeing. Resolution #68-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS on May 6, 2023, the Village of Croton-on-Hudson awarded Bid #3-2023 for tree services to New England Property Maintenance, Inc. of Mahopac, New York, at a unit bid price of $2,300, and WHEREAS the contract terms included an option to renew on an annual basis for two additional one-year intervals, and WHEREAS Frank Balbi, Superintendent of Public Works, recommends extending the contract by one year in accordance with the terms outlined in the bid, Village Board of Trustees April 9, 2025 NOW THEREFORE BE IT RESOLVED that the Board of Trustees hereby authorizes the Village Manager to award the contract for tree trimming and removal services to New England Property Maintenance, Inc. of Mahopac, New York for a one-year extension beginning June 1, 2025, through May 31, 2026, and BE IT FURTHER RESOLVED that all pricing and conditions as submitted in Bid #3- 2023 shall remain the same for the upcoming extension period. Resolution #69-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS on May 6, 2023, the Village Board of Trustees awarded Bid #2-2023 for lawn maintenance services to La Teja Contractors and Landscaping, Inc., of Ossining, New York in the amount of $46,485, and WHEREAS the contract terms included an option to renew on an annual basis for two additional one-year intervals, and WHEREAS La Teja has submitted a request to extend the bid for the period of June 1, 2025, through May 31, 2026, as permitted, and WHEREAS Frank Balbi, Superintendent of Public Works, has recommended that the bid be extended for the above period, NOW THEREFORE BE IT RESOLVED that the Village Manager is hereby authorized to execute an extension with La Teja Contractors and Landscaping, Inc., for the Village’s lawn maintenance program, and BE IT FURTHER RESOLVED that all pricing and conditions as submitted in Bid #2- 2023 shall remain the same for the upcoming extension period. Resolution #70-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS the Village has received a request from Camp Nabby of Mohegan Lake, New York, to use the parking spaces along South Riverside Avenue reserved for Croton-Harmon Train Station parking for pick-up and drop-off of campers, and Village Board of Trustees April 9, 2025 WHEREAS Camp Nabby has agreed to pay $30 per day, or $1,170 for the camp season, for use of the parking spaces, NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby authorize the Village Manager to execute the agreement with Camp Nabby to authorize the use of the parking spaces along South Riverside Avenue reserved for Croton-Harmon Train Station parking in the amount of $1,170 for the period beginning June 30, 2025, through August 21, 2025. c. Approval of Minutes Motion to approve the minutes, as amended, of the Regular Meeting held on March 26, 2025, was made by Trustee Simon. The motion was seconded by Trustee Nicholson and approved with a 5-0 vote. Motion to approve the minutes of the Executive Session held on March 26, 2025, was made by Trustee Simon. The motion was seconded by Trustee Nicholson and approved with a 5-0 vote. Motion to approve the minutes of the Work Session held on April 2, 2025, was made by Trustee Simon. Resolution #71-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS the Village Board of Trustees has introduced Local Law Introductory No. 3 of 2025 to amend Chapter 116, Environmental Review, of the Village Code to update the list of additional Type II actions, and WHEREAS on February 26, 2025, the Village Board of Trustees declared itself Lead Agency for SEQRA purposes, and Village Board of Trustees April 9, 2025 WHEREAS on March 26, 2025, the Village Board of Trustees undertook the process and review described in detail in Parts 2 and 3 of the Short EAF “Determination of Significance” attached hereto, and WHEREAS the Village Board held a public hearing to consider Local Law Introductory No. 3 of 2025, which was opened and closed on March 26, 2025, and WHEREAS the Village Board has received a recommendation of consistency from the Waterfront Advisory Committee with the Village’s Local Waterfront Revitalization Program, and WHEREAS the Village Board must make its own determination of consistency with the LWRP policy standards and conditions, and WHEREAS on March 26, 2025, the Village Board reviewed the LWRP policy standards and conditions, NOW THEREFORE, BE IT RESOLVED as follows: The Village Board of Trustees makes the following findings regarding the applicability of the LWRP policies and the consistency of the Proposed Action with those policies and conditions of the LWRP which it found applicable: Policy 6: Expedite permit procedures in order to facilitate the siting of development activities at suitable locations. The remaining policies and conditions of the LWRP not specifically discussed above, were reviewed and found not to be applicable, and BE IT FURTHER RESOLVED that based upon the above, the Village Board of Trustees confirms its determination that the Proposed Action, the adoption of a local law to update the list of additional Type II actions, complies with the policy standards and conditions set forth in the Village’s LWRP, and BE IT FURTHER RESOLVED that the Village Board of Trustees hereby issues and adopts the EAF Parts 2 and 3 Determination of Significance attached hereto and adopts a Negative Declaration in connection with this action, and BE IT FURTHER RESOLVED that the Village Board of Trustees hereby adopts Local Law Introductory No. 3 of 2025 to amend Chapter 116, Environmental Review, of the Village Code to update the list of additional Type II actions, which upon adoption becomes Local Law No. 6 of 2025. April 9, 2025 DISCUSSION: Trustee Simon stated that by expanding the TYPE II categories it will allow the Board to do the work in a more efficient manner. Resolution #72-2025 – Resolution Held Over WHEREAS the New York State Village Law provides that volunteer fire company and fire department elections take place in the month of April, and WHEREAS the Croton-on-Hudson Volunteer Fire Department and the fire companies which make up the department conduct their elections in December, and WHEREAS Assemblywoman Dana Levenberg has introduced bill AXX in the State Assembly to authorize the elections to continue in December, and WHEREAS State Senator Peter Harckham has introduced companion bill S7201 in the State Senate regarding same, and WHEREAS the Village is required to formally submit a home rule request to the legislature, NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby requests permission to have the elections for the Croton-on-Hudson Volunteer Fire Department and its associated fire companies take place in December, and BE IT FURTHER RESOLVED that a copy of this home rule request be sent to State Assemblywoman Dana Levenberg and State Senator Peter Harckham. Resolution #73-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS in 2021, the EMS facility at 44 Wayne Street was deemed uninhabitable due to mold and structural issues, requiring the relocation of EMS services to a temporary space at the Harmon Firehouse, and WHEREAS following a comprehensive review and design process involving Sullivan Architecture, P.C., it was determined that an addition to the Harmon Firehouse would serve as a permanent solution for the EMS facility, and Village Board of Trustees April 9, 2025 WHEREAS the Village of Croton-on-Hudson solicited sealed bids for a fire suppression system under Bid No. 1-2025, and WHEREAS no bids were received by the deadline of February 11, 2025, and WHEREAS the Village of Croton-on-Hudson resubmitted the solicitation under Bid No. 5-2025, and WHEREAS one bid was submitted by the deadline of April 3, 2025, and WHEREAS the bid received was from AGI Fire Protection of Pleasant Valley, New York, in the amount of $87,500, and WHEREAS Superintendent of Public Works Frank Balbi has reviewed the submitted bid and has recommended awarding the contract to AGI Fire Protection, NOW THEREFORE BE IT RESOLVED that the Village Manager is hereby authorized to award Bid No. 5-2025 to AGI Fire Protection of Pleasant Valley, New York, in the amount of $87,500, and BE IT FURTHER RESOLVED that funding for this project has been allocated in capital accounts H3410.2000.11223 and H4540.2102.23445. Village Manager Healy explained that this bid is not just for the sprinkler system for the addition, but for the entire firehouse. Resolution 74-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS the Village has received a proposal from New England Traffic Solutions of Glastonbury, Connecticut, to enhance the coordination of the traffic signals along Croton Point Avenue, and WHEREAS the cost for such enhancements shall not exceed $7,350 and shall be covered by the developer of 1 Croton Point Avenue, and WHEREA, Frank Balbi, Superintendent of Public Works, has recommended that the proposal be accepted, Village Board of Trustees April 9, 2025 NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby authorize the Village Manager to accept the proposal from New England Traffic Solutions of Glastonbury, Connecticut, at the not-to-exceed price of $7,350. DISCUSSION Trustee Simon stated that this is excellent news, many residents have been asking for this for quite some time, and while this may not be one hundred percent of what everyone wanted, if they do what is outlined in their letter, it should make a good number of our residents very happy and help with the 1 Croton Point Avenue project as well. WHEREAS the Village of Croton-on-Hudson is a party to a waterline agreement and easement related to property located at 71 Quaker Bridge Road, and WHEREAS the Village has provided water service to this residence, and 68 Quaker Bridge Road, for many years through a water line under the Croton River, and WHEREAS the property owner at 71 Quaker Bridge Road has since drilled a well on the property to provide water supply for the property, and WHEREAS the individual waterline for 71 Quaker Bridge Road has been permanently capped, NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby authorize the Village Manager to execute the declaration of transfer of title and termination of easement and agreement for the property located at 71 Quaker Bridge Road. Resolution #76-2025 Village Board of Trustees April 9, 2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS the Westchester County Board of Elections (“the BOE”) uses various educational, municipal and non-profit buildings each year for primary and general elections, and WHEREAS the Village agreed to let the Harmon Firehouse, Chemical Engine Company and the Stanley H. Kellerhouse Municipal Building be used as polling sites, and WHEREAS the Village also agreed to let the Stanley H. Kellerhouse Municipal Building be used as an Early Voting site, and WHEREAS the Village incurs costs related to overtime for opening and closing the building for the poll workers, and WHEREAS the BOE has submitted payment to the Village to cover the staff overtime, NOW THEREFORE BE IT RESOLVED that the Village Treasurer is authorized to amend the 2024-2025 General Fund Budget as follows: A1410.1200 Clerk-Personnel Srvcs OT $2,649.01 GENERAL REVENUES Increase A1000.2413 Rental – Election Site $2,649.01 Resolution #77-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS the Village undertook the repaving of Nordica Drive for Con Edison after its gas-main installation last year, and WHEREAS the Village replaced defective sidewalks in the Sunset Drive and Lexington Drive neighborhood last year, and Village Board of Trustees April 9, 2025 WHEREAS the Village provided fuel for the temporary lights under the solar canopies at the train station, and WHEREAS the Village had its contractor undertake the shoveling of sidewalks when necessary to allow safe passage by pedestrians, and WHEREAS all of the above costs have been reimbursed or billed to the appropriate parties, NOW THEREFORE BE IT RESOLVED that the Village Treasurer is authorized to amend the 2024-2025 General Fund Budget as follows: H5110.2106.24462 General Road Repair $58,400.00 A5142.4000 Snow – Contractual $ 1,832.25 A7110.4000 Parks – Contractual $11,703.16 GENERAL REVENUES Increase A5110.1710 DPW Charges $71,935.41 8. PUBLIC COMMENT – NON-AGENDA ITEMS: Michael Mamone, 19 Young Avenue, Croton on Hudson, asked that the dog ordinance and reckless driving be enforced throughout the Village, asked for a Residential Parking Permit System in his neighborhood, objected to receiving a violation for having two boats in his driveway, it does not make sense that you cannot have more than one boat in your driveway, and suggested that the Code be re-written. 9. REPORTS: Trustee Slippen advised that she attended the Library Board meeting where they talked about upcoming events as well as some Capital Improvements, the book and bake sale will be held on May 17 and 18th, attended the Arts and Humanities Advisory Council meeting where they discussed projects they are working on, April 17th a compost bin and rain-barrel sale will be held in Valhalla, last week CET held a special program for 2nd graders following the reading of Charlie and the Chocolate Factory. April 9, 2025 Trustee Politi advised that she attended the IDEA Advisory Committee meeting where they talked about their upcoming events as well as their continued discussion on immigration, attended the Croton Business Council meeting where they continued to talk about ways in which we can help to support our local businesses. Trustee Nicholson stated that she, along with the Mayor and Trustee Simon, attended the Croton Little League Parade, listened in on the Planning Board meeting where they talked about Special Permits and the shifting of responsibilities, Spring Family Fun will be held at 5pm this Friday at Vassallo Park, the Yacht Club will be talking about the History of Croton Point on Friday evening with a nature hike on Sunday, April 13th, the Clean Committee will hold a cleanup on South Riverside and at the Duck Pond, on April 23rd, a Dobbs Park Playground and basketball court renovation presentation will be held this Monday, 7pm at Village Hall, on April 23rd from 2-4pm at St. Augustine Church the Lorriane Hansberry Coalition will hold a presentation by Pauli Murray who was involved in the Civil Rights community. Trustee Simon advised that he attended the Vietnam Veterans ceremony and thanked everyone involved in putting this together, on April 1st the Planning Board met and gave Site Plan approval to a new home on the corner of Grand and Bayview Terrace, talked about some turf treatments at Hudson National Golf Course, and further consideration was given to the Site Plan for 1 Croton Point Avenue, on April 2nd Historic Hudson River Towns held a Rivertown Summit in Tarrytown where the County talked about some of their tourism initiatives as well as the upcoming 250th anniversary celebration of the Revolution, on April 3rd Pace Law School held a forum on housing where the County Executive spoke on some of their initiatives, last Friday he had the opportunity to tour Ossining’s Wastewater Treatment Plant, this past Sunday Welcome Wagon held an event at Village Hall, the New York Planning Federation awarded Adam Decker and Nance Shatzkin the 2024 Levine Community Service Award this past Monday, and this Friday a Bubble Show will take place at Vassallo park, Mayor Pugh advised that he had the opportunity to attend CET’s 2nd grade “Build a Business” tour. Thanked Cub Scout Pack 28 for their clean up at Vassallo Park and encouraged residents to come out to assist the clean-up at Duck Pond this weekend. April 9, 2025 Village Manager Healy, referencing the comments made by Mr. Mamone, advised that the Section regarding Boats has been in our Code for 35 years. Village Manager Healy explained that the Zoning Code requires single family homes to provide two off-street parking spaces for vehicles and parking two boats in your driveway in essence forces cars onto the street, which is prohibited in the winter when you are not allowed to park on the street during snow events. Village Manager Healy advised that Water Bills are due next Tuesday, Village offices are closed next Friday and referred to the Village’s Website regarding some meeting changes. There being no further comments to come before the Board, a motion to close the meeting was made by Trustee Simon. Motion was seconded by Trustee Nicholson and approved with a 5-0 vote.
