To: From: Date: January 12, 2024 Re: Update on Local Law Introductory No. 23 Village Engineer Dan O’Connor has provided some additional information which the Village Attorney and I feel is worth considering by the Village Board of Trustees before Local Law Introductory No. 23 of 2023 is adopted. The first request is to amend Section 179-1(A)2 to clarify that only developed areas of a premises which is intended to be used by building occupants or the public needs to be maintained free of weeds. Someone who has, for example, a wooded portion of their property and does not use that portion of their land for recreational activities would not be required to remove weeds from that area. The second request is to remove the zoning district provisions for vacant commercial buildings. Since the definition included in this article exempts single-family and two-family homes, it would make sense to just have all other properties fall under this provision. Note that vacant space is defined as “any unoccupied street level building space.” So, if a mixed-use building has an occupied storefront, but a vacant second floor apartment, that would not fall under these regulations. The third request is to require a property owner, lessee or other responsible individual to remove signage not only from the storefront windows, but also from the exterior of a property (e.g., above their entryway).
