Work Session of the Board of Trustees of the Village of Croton-on-Hudson, NY, held on Wednesday, July 23, 2025, in the Georgianna Grant Meeting Room at the Stanley H. Kellerhouse Municipal Building, Van Wyck Street, Croton-on-Hudson, NY 10520. 1. Mayor Pugh called the work session to order at 7:00pm. 2. FREEDOM OF INFORMATION LAW APPEAL On motion by Trustee Simon and seconded by Trustee Nicholson, the Board of Trustees of the Village of Croton-on-Hudson upheld the decision of the Village Clerk in a Freedom of Information Law (FOIL) appeal received on July 11, 2025, with a 5-0 vote. Letter sent to Mr. Mark Constantine, Esq., and Mr. Karl Dibble Dear Mr. Constantine and Mr. Dibble: This is to inform you that on July 23, 2025, the Croton-on-Hudson Village Board of Trustees (“Village Board”) met as the FOIL Appeals Board to consider the Village’s June 27, 2025, response to your March 31, 2025 FOIL request. • Your said FOIL sought records of “On behalf of Karl Dibble and River Rock Supply Corp. (“River Rock”), the undersigned pursuant to the NYS Freedom of Information Law (“FOIL”) to the present hereby requests all records communications, memos, specifications, reports, resolutions, legislation, contracts, bonds, and insurance policies in possession of the Village of Croton-on Hudson, New York, with reference to Historic Hudson Valley (“HHV” or “Obligee”), to River Rock Supply Corp. Your request for records was responded to on the basis that Section 87(2)(a) of the Public Officers Law exempts any material deemed confidential by state or federal statute. Attorney client privilege is deemed confidential under Civil Practice Law and Rules Section 4503 and attorney work product is deemed confidential by the Civil Practice Law and Rules Section 3101 and that doctrine has also been deemed to include the common-interest doctrine which would apply to relevant third-party attorneys herein. Please be advised the FOIL Appeals Board hereby upholds that determination. Accordingly, the appeal has been reviewed, and the prior response has been confirmed. CONSENT AGENDA: On motion by Trustee Simon and seconded by Trustee Politi, the Board of Trustees of the Village of Croton-on-Hudson approved the Consent Agenda with a 5-0 vote. a. RESOLUTIONS: Resolution #182-2025 Village Board of Trustees Work Session July 23, 2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE POLITI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS, the Village of Croton-on-Hudson has been working with AT&T Wireless in consideration of a lease agreement and special permit to co- locate a wireless facility at the Stanley H. Kellerhouse Municipal Building, 1 Van Wyck Street; and WHEREAS, this application is considered an Eligible Facilities Request under federal law, which requires the Village Board to render a decision within 60 days of receiving the application; and WHEREAS, a Short Environmental Assessment Form and a Coastal Assessment Form have been drafted in connection with the Proposed Action, NOW THEREFORE BE IT RESOLVED as follows: 1. The Village Board hereby determines that the Proposed Action is an Unlisted Action under SEQRA; 2. The Village Board hereby declares itself Lead Agency for SEQRA purposes; 3. The Village Board hereby refers the necessary documentation to the Village Waterfront Advisory Committee for a recommendation of consistency with the Village’s Local Waterfront Revitalization Program (LWRP). AND BE IT FURTHER RESOLVED: that a public hearing on the special permit application for the co-location of an AT&T Wireless facility at the Stanley H. Kellerhouse Municipal Building be scheduled for August 20, 2025, at 7:00 PM in the Georgianna Grant Meeting Room of the Stanley H. Kellerhouse Municipal Building. Resolution #184-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE POLITI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS, the New York State Legislature has passed three essential bills during the 2025 Legislative Session related to emergency medical services (EMS) in New York State; and Village Board of Trustees Work Session July 23, 2025 WHEREAS, A.2177/S.1515 excludes EMS expenditures from the real property tax cap, giving municipalities the flexibility to properly fund EMS services without compromising other critical needs; and WHEREAS, A.8086-A/S.7501-A requires counties, cities, towns, and villages to collaboratively develop comprehensive county EMS system plans to assess needs, identify service gaps, and guide future investments; and WHEREAS, A.34/S.31 provides toll exemptions on the NYS Thruway for emergency vehicles, enabling faster emergency response times and reducing operational costs for EMS providers; and WHEREAS, the three bills are critical to rescuing and revitalizing EMS across the state; and WHEREAS, the New York Conference of Mayors (NYCOM) has circulated a letter for all municipalities to join as signatories requesting Governor Kathy Hochul to sign these bills into law without delay, NOW THEREFORE BE IT RESOLVED: that the Village of Croton-on-Hudson Board of Trustees authorizes the Village Manager to join as a signatory to the letter circulated by NYCOM. Resolution #185-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE POLITI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. WHEREAS, Westchester County has submitted a letter requesting the waiving of fees related to their wetlands permit application for the replacement of the Quaker Bridge; and WHEREAS, the Village is undertaking a project to install electric vehicle charging stations at the Croton-Harmon Train Station parking lot; and WHEREAS, Lindsay Audin, Sustainability Committee chair, has requested a fee waiver for the project to help keep costs in line with the grant funding provided for the project, NOW THEREFORE BE IT RESOLVED: that the Village Board of Trustees hereby waives any and all fees related to the Quaker Bridge replacement project and Village Board of Trustees Work Session July 23, 2025 the electric vehicle charging station project at the Croton-Harmon Train Station parking lot. Resolution #186-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE POLITI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. RESOLUTION AUTHORIZING SUBMISSION OF A WESTCHESTER COUNTY STORMWATER PROGRAM GRANT APPLICATION FOR DRAINAGE IMPROVEMENTS ALONG BROOK STREET AND TERRACE PLACE WHEREAS, to improve stormwater drainage and reduce flooding, the Village of Croton-on-Hudson is looking to improve the drainage along Brook Street and Terrace Place (“Project”); and WHEREAS, the Village of Croton-on-Hudson is seeking funding under the “Westchester County Flood Mitigation Program”; and WHEREAS, the cost estimate for the Project is $1.402 million, NOW THEREFORE BE IT RESOLVED: that the Board of Trustees of the Village of Croton-on-Hudson hereby authorizes the Village Manager to take all necessary action to submit an application for $701,000 in the Westchester County Flood Mitigation Program to improve the drainage along Brook Street and Terrace Place, and, upon the funding of said amount, commits to provide the match of $701,000. Resolution #187-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE POLITI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. RESOLUTION AUTHORIZING SUBMISSION OF A NY BRICKS GRANT APPLICATION FOR THE ACTIVATION OF GOUVEIA PARK WHEREAS, to increase the recreation facilities available for use by its residents, the Village of Croton-on-Hudson is looking to rehabilitate and restore the existing house to create a multi-purpose recreational community center at Gouveia Park (“Project”); and Village Board of Trustees Work Session July 23, 2025 WHEREAS, the Village of Croton-on-Hudson is seeking funding under the “New York Building Recreational Infrastructure for Communities, Kids & Seniors (NY BRICKS)”; and WHEREAS, the cost estimate for the Project is $2.25 million, NOW THEREFORE BE IT RESOLVED: that the Board of Trustees of the Village of Croton-on-Hudson hereby determines the proposed Project, classified as a Type II action in 6 CRR-NY 617.5 (C)(9), will result in no significant environmental impacts and will require no further environmental review in accordance with the NY State Environmental Quality Review Act (Environmental Conservation Law, Article 8) and its implementing regulations; and BE IT FURTHER RESOLVED: that the Board of Trustees of the Village of Croton- on-Hudson hereby authorizes the Village Manager to take all necessary action to submit an application for $1,750,000 in New York Building Recreational Infrastructure for Communities, Kids & Seniors (NY BRICKS), for financing the activation of Gouveia Park project, and, upon the funding of said amount, commits to provide the match of $500,000. Resolution #188-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE POLITI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York with a 5-0 vote. RESOLUTION AUTHORIZING SUBMISSION OF CFA GRANT APPLICATION FOR THE ACTIVATION OF GOUVEIA PARK WHEREAS, to increase the recreation facilities available for use by its residents, the Village of Croton-on-Hudson is looking to rehabilitate and restore the existing house to create a multi-purpose recreational community center at Gouveia Park (“Project”); and WHEREAS, the Village of Croton-on-Hudson is seeking funding under the “Environmental Protection Fund Grants Program for Parks, Preservation, and Heritage”; and WHEREAS, the cost estimate for the Project is $2.25 million, NOW THEREFORE BE IT RESOLVED: that the Board of Trustees of the Village of Croton-on-Hudson hereby determines the proposed Project, classified as a Type Village Board of Trustees Work Session July 23, 2025 II action in 6 CRR-NY 617.5 (C)(9), will result in no significant environmental impacts and will require no further environmental review in accordance with the NY State Environmental Quality Review Act (Environmental Conservation Law, Article 8) and its implementing regulations; and BE IT FURTHER RESOLVED: that the Board of Trustees of the Village of Croton- on-Hudson hereby authorizes the Village Manager to take all necessary action to submit an application for $675,000 in Environmental Protection Fund Grants Program for Parks, Preservation, and Heritage funds for financing the activation of Gouveia Park project, and, upon the funding of said amount, commits to provide the match of $1.575 million. 5. PROPOSED RESOLUTIONS: Resolution #183-2025 On motion of TRUSTEE SIMON, seconded by TRUSTEE NICHOLSON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New York with a 5-0 vote. WHEREAS, the Village of Croton-on-Hudson has discovered a leak within the sanitary sewer main on Ridge Road; and WHEREAS, the Village is responsible for the maintenance and upkeep of the sanitary sewer system; and WHEREAS, DPW has received an estimate for the relining of the sanitary sewer main in the amount of $42,200; and WHEREAS, General Municipal Law Section 103(4) allows for the Village Board to let a contract without public bidding where necessary due to a public emergency arising out of an unforeseen occurrence or condition; and WHEREAS, the Superintendent of Public Works has recommended that the Village proceed with this work on an emergency basis, NOW THEREFORE BE IT RESOLVED: that the Village Board hereby declares the relining of the sanitary sewer main on Ridge Road to be an emergency; and BE IT FURTHER RESOLVED: the Village Manager is authorized to accept the proposal from Insituform, of Charlton, Massachusetts, in the amount of $42,200 to complete this work; and Village Board of Trustees Work Session July 23, 2025 BE IT FURTHER RESOLVED: that the Village Treasurer is authorized to transfer $22,200 from G1990.4000 (Contingency) and $20,000 from G8997.2000 (Other Services) to G8120.4000. Other topics discussed at the work session included: an update on the Kaplan’s Pond aeration system installation, a possible amendment to Section 230-48, Supplementary standards for the provision of affordable housing units, of the Village Code, a new local law to create an inspection regime for retaining walls in the Village, the administration of fees under the new Tree Law, and a proposed resolution setting a housing unit growth target for the period of 2020- 2030. The work session was closed at 8:50pm.
