Meeting of the Board of Trustees of the Village of Croton-on-Hudson, NY, held on Monday, August 14, 2023, in the Georgianna Grant Meeting Room at the Stanley Kellerhouse Municipal Building, Van Wyck Street, Croton-on-Hudson, NY 10520. The following official was absent: 1. CALL TO ORDER Mayor Pugh called the meeting to order at 7:00pm and led everyone in the Pledge of Allegiance. 1. APPROVAL OF VOUCHERS Trustee Horowitz made a motion to approve the following Fiscal Year Vouchers, claims numbered 23241049 through 23241422. The motion was seconded by Trustee Simon and approved with a 4-0 Vote. $180,345.88 Water Fund $40,830.46 Sewer Fund $4,751.15 Capital Fund $76,480.95 Trust Fund $1,400.00 2. Trustee Simon Mayor Pugh Trustee Gallelli Village Manager Bryan Healy Trustee Horowitz Village Attorney Linda Whitehead Trustee Simon Village Treasurer Daniel Tucker Village Board of Trustees August 14, 2023 additionally asked that we waive the Summerfest vendor fee and reallocate the $50.00 to some other function. Trustee Gallelli, Trustee Horowitz and Mayor Pugh stated that they are in support of this and thanked the committee for all their hard work. Village Manager Healy stated that he did not think waiving the fee would be a problem and will put together an agreement. b. Motion was approved with a 4-0 vote. c. Letter from Cynthia Lippolis, Hudson Valley Gateway Chamber of Commerce, dated July 25, 2023, requesting permission to conduct a Scarecrow Contest in the Village. https://play.champds.com/ATT/crotononhudsonny/2023- 08/76dfe78c7d6747956399c7a6a3c543e43c48c7a9.pdf RESOLUTION On motion by Trustee Gallelli and seconded by Trustee Simon the Board of Trustees of the Village of Croton on Hudson approved the request from the Hudson Valley Gateway Chamber of Commerce to conduct a Scarecrow Contest. Motion was approved with a 4-0 vote. 4. PUBLIC COMMENTS ON AGENDA ITEMS Ed Riely, 110 Truesdale Drive, Croton on Hudson, stated that the Fire Department has not received an apology from School Board member Joshua Diamond, concerned that the changes to the Village’s Firearms law does not conform with State law, concerned that the Sealegs Amphibious 6.1 Rigid Inflatable Boat will not be strong enough to handle rapids in certain areas of the river, requested a summary of how our recyclables are handled, and does not support large scale housing in the Harmon parking lot. Kathleen Mamone, 19 Young Avenue, Croton on Hudson, stated that she objects to large scale housing by the railroad station and Village Board of Trustees August 14, 2023 encouraged the Board to look at this type of development in Haverstraw and Ossining before they approve it. 5. RESOLUTIONS: Resolution 175 of 2023 On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. WHEREAS New York State recently enacted legislation relating to the usage of firearms in historical reenactments, military funeral salutes, and other similar activities, and WHEREAS the Village would like to amend Chapter 123, Firearms, of the Village Code to reflect these changes, and WHEREAS the Village Board of Trustees is considering the adoption of Local Law Introductory No. 15 of 2023, which has been drafted for such purposes, NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby schedules a Public Hearing on August 28, 2023, at 7 PM, in the Georgianna Grant Meeting Room of the Stanley H. Kellerhouse Municipal Building, 1 Van Wyck Street, Croton-on-Hudson, New York 10520, to consider Local Law Introductory No. 15 of 2023 to amend Chapter 123, Firearms, of the Village Code. Village Manager Healy explained that New York State recently enacted legislation to allow more exceptions to their Firearms Law that relates to the use of firearms in historical reenactments, military funeral salutes, and other similar activities. Village Manager Healy advised that we are also establishing a process that provides some oversight by the Chief of Police. Village Attorney Whitehead explained that the Village is allowed to create a law that is more restrictive than the State’s law and Croton’s law is more restrictive in the sense that it regulates more types of firearms. Village Attorney Whitehead stated that air guns are not considered firearms within the meaning of the 2nd Village Board of Trustees August 14, 2023 Amendment, they do not have constitutional protections and the Village does have the ability to regulate them. Mayor Pugh stated that the Firearms section of the Village Code has been on the books since 1942 with some amendments and it is not about possession but rather the discharge of any of these types of firearms. Resolution 176 of 2023 On motion of TRUSTEE GALLELLI, seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. WHEREAS the Village of Croton-on-Hudson desires to add a new Chapter 185 entitled “Recycling” to the Village Code to codify the source separation and segregation of recyclable materials, and WHEREAS the Village Board of Trustees is considering the adoption of Local Law Introductory No. 16 of 2023, which has been drafted for such purposes, NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby schedules a Public Hearing on August 28, 2023, at 7 PM, in the Georgianna Grant Meeting Room of the Stanley H. Kellerhouse Municipal Building, 1 Van Wyck Street, Croton-on-Hudson, New York 10520, to consider Local Law Introductory No. 16 of 2023, adding a new Chapter 185 entitled “Recycling” to the Village Code. Village Manager Healy explained that this law comes to us by way of New York State, and while our code talks about garbage, this came to our attention when we were looking at grant applications and found that we did not have our recycling provision codified. Resolution 177 of 2023 On motion of TRUSTEE SIMON, seconded by TRUSTEE GALLELLI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. August 14, 2023 WHEREAS the Village would like to amend and update provisions of Chapter 230, Zoning, of the Code of the Village of Croton-on-Hudson, and WHEREAS the Village Board is considering taking an action to adopt Local Law Introductory No. 17 of 2023 which has been drafted for such purposes, and WHEREAS the Village has completed Part 1 of a Short Environmental Assessment Form (EAF) and a Coastal Assessment Form (CAF), NOW THEREFORE BE IT RESOLVED AS FOLLOWS: 1. The Village Board hereby determines that the Proposed Action is an Unlisted Action. 2. The Village Board hereby declares itself to be the Lead Agency for SEQRA purposes in connection with the Proposed Action. 3. The Village Board hereby issues the EAF and CAF which it has before it in connection with the Proposed Action. 4. The Village Board hereby refers to the Village Planning Board the Draft Law for a report back to the Village Board in accordance with Village law. 5. The Village Board hereby refers the Draft Law, the EAF and the CAF to the Village Waterfront Advisory Committee for a recommendation back to the Village Board in accordance with Village Law. 6. The Village Board hereby refers the Draft Law, the EAF and the CAF the Westchester County Planning Board for review in accordance with law. 7. The Village Board hereby directs Village staff to make any other circulations and notifications regarding the Proposed Action as may be required by law. Village Manager Healy explained that this Local Law updates the definition of Family as well fixing various other references that have changed over time. August 14, 2023 Village Attorney Whitehead explained that there has been a number of cases with respect to what you can have in your code regarding the definition of family, this is one of the issues that General Code had raised during their review, and we have reviewed some of the cases as well as other codes and this is what we have come up with. Resolution 178 of 2023 On motion of TRUSTEE SIMON, seconded by TRUSTEE HOROWITZ, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. WHEREAS the National Rural Water Association (NRWA) has created the PFAS Cost Recovery Program to help water and wastewater systems recoup money spent on treatment and remediation, and WHEREAS systems that register will be eligible to recover costs associated with PFAS testing, treatment, and remediation if a settlement is reached, and WHEREAS utilities may join the NRWA PFAS Cost Recovery Program by retaining Napoli Shkolnik PLLC for participation in the current Multi District Litigation (MDL) proceeding in the Federal District Court for South Carolina (MDL 2873) as well as any other appropriate action in State and Federal Court, NOW THEREFORE BE IT RESOLVED that the Board of Trustees hereby authorizes the Village Manager to execute a retainer agreement with Napoli Shkolnik PLLC, including future documents related to the settlement, subject to the final approval of the Village Attorney. Village Manager Healy explained that this came to us from the National Rural Water Association of which Croton is a member and while we are currently below the maximum allowable levels, we do have some levels of the PFAS in our water systems. Village Manager Healy advised that since there seems to be a movement by the EPA to lower the maximum allowable levels we may be in a position where we will have to do some sort of treatment and remediation, and this is going to allow us to re-coop some of those costs. August 14, 2023 Village Attorney Whitehead explained that that this firm only gets paid if the Village is successful and then they only receive a percentage of what the Village receives. Resolution 179 of 2023 On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE GALLELLI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New York, with a 4-0 vote. WHEREAS the Village Board of Croton-on-Hudson initiated preparation of a Local Waterfront Revitalization Program in cooperation with the New York State Department of State, pursuant to Article 42 of the Executive Law, and WHEREAS a Draft Local Waterfront Revitalization Program and Waterfront Consistency Review Law were prepared and circulated by the Department of State to potentially affected State, Federal, and Local agencies in accordance with the requirements of Executive Law, Article 42, and WHEREAS the Village of Croton-on-Hudson, as lead agency, filed a Negative Declaration-Notice of Determination of Non-Significance on October 5, 2015, for preparation of the Local Waterfront Revitalization Program and Waterfront Consistency Review Law, pursuant to Article 8 of the Environmental Conservation Law State Environmental Quality Review Act, and WHEREAS the Waterfront Consistency Review Law was adopted by the Village Board of Trustees on October 5, 2015, NOW THEREFORE BE IT RESOLVED that the Village of Croton-on-Hudson Local Waterfront Revitalization Program is hereby adopted, and that the mayor is authorized to submit the LWRP to the New York State Secretary of State for approval, pursuant to the Waterfront Revitalization of Coastal Areas and Inland Waterways Act. Village Manager Healy stated that once the State gets notified that we have adopted the resolution we will be able to use the updated Local Waterfront Revitalization Program and Waterfront Consistency Review. August 14, 2023 Trustee Gallelli stated that Croton has benefitted a number of times from having adopted this and cannot imagine where we would be if we did not have a Local Waterfront Revitalization Program. Resolution 180 of 2023 On motion of TRUSTEE SIMON seconded by TRUSTEE HOROWITZ, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. WHEREAS on August 3, 2023, the Village of Croton-on-Hudson advertised Bid 05-2023 for the purchase of a Sealegs Amphibious 6.1 Rigid Inflatable Boat (RIB), and WHEREAS on August 9, 2023, one bid was received and opened, and WHEREAS the sole bidder was Proper Pressure and Performance LLC of Barrington, Rhode Island at the price of $105,000, and WHEREAS the Chief of Police has reviewed the bid and recommends awarding the contract to Proper Pressure and Performance LLC, NOW THEREFORE BE IT RESOLVED that the Board of Trustees hereby authorizes the Village Manager to award the contract for the purchase of a Sealegs Amphibious 6.1 Rigid Inflatable Boat to Proper Pressure and Performance LLC of Barrington, Rhode Island at the price of $105,000, and BE IT FURTHER RESOLVED: that the cost of this purchase shall be charged to H3120.2010.24479 DISCUSSION Village Manager Healy explained that this was included in our Capital Plan, and as part of that limited patrol the State will give Croton money back, we are also getting a good deal because it is certified pre-owned. Resolution 181-2023 On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE GALLELLI the following resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New York, with a 4-0 vote. August 14, 2023 WHEREAS Local Law No. 3 of 2003 was approved at a regular Village Board Meeting held on October 7, 2003, and WHEREAS this Local Law called for the setting of Village fees through Board Resolutions, and WHEREAS the Village wishes to clarify the weekend rate for daily parking, NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby amends the 2023-2024 Master Fee Schedule as follows: Weekend daily rate 4:45 am Saturday – 3:00 am Sunday $10.00 Resolution 182 of 2023 On motion of TRUSTEE HOROWITZ seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. WHEREAS patrol vehicles from the Croton-on-Hudson Police Department have been involved in two separate accidents this summer, and WHEREAS the Village’s insurance company has determined that both vehicles are a total loss and cannot be repaired, and WHEREAS the police department must maintain a minimum number of patrol vehicles for operational reasons, and WHEREAS Chief of Police John Nikitopoulos has requested funding in the amount of $116,000 to purchase and outfit two new patrol vehicles, and WHEREAS these vehicles will be purchased on state contract, and WHEREAS the Village’s insurance company will be providing a loss payment to cover some of the total cost listed above, and WHEREAS funding for this expense was not included in the 2023-2024 General Fund budget, Village Board of Trustees August 14, 2023 NOW THEREFORE BE IT RESOLVED that the Village Board hereby authorizes the Village Treasurer to transfer $116,000 from Contingency Account A1990.4000 to the following account: A3120.2010 – Police Department – Vehicles: $116,000 Resolution 183 of 2023 On motion of TRUSTEE SIMON, seconded by TRUSTEE HOROWITZ, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. WHEREAS the Croton-on-Hudson Fire Department’s Marine 32-a 2013 inflatable boat is no longer holding air, and WHEREAS the manufacturer has advised that the boat is no longer under warranty and should be replaced, and WHEREAS the Fire Department has received a quote from Defender Industries of Waterford, Connecticut for a Defender-430 inflatable boat in the amount of $4,350.95, and WHEREAS funding for this expense was not included in the 2023-2024 General Fund budget, NOW THEREFORE BE IT RESOLVED that the Village Board hereby authorizes the Village Treasurer to transfer $4,350.95 from Contingency Account A1990.4000 to the following account: A3410.2000 – Fire Department – Equipment: $4,350.95 DISCUSSION Trustee Simon stated that the Fire Council had made every effort to try to hang on to the previous boat, but the condition of the boat made it not possible. Resolution 184 of 2023 On motion of TRUSTEE HOROWITZ seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. August 14, 2023 WHEREAS the Village of Croton-on-Hudson utilizes meters for all customers to measure the amount of water being used at each location, and WHEREAS the existing meter at Sky View Rehabilitation & Health Care has reached the end of its functional life, and WHEREAS the Village has received a check from Sky View in the amount of $2,206 to replace the meter, and NOW THEREFORE BE IT RESOLVED that the Village Treasurer is authorized to make the following budget amendment to the 2023-2024 Water Fund budget: WATER FUND EXPENSES Increase F8340.2000 – Equipment $2,206 WATER FUND REVENUES Increase F1000.2770 – Other Unclassified $2,206 Resolution 185 of 2023 On motion of TRUSTEE SIMON, seconded by TRUSTEE HOROWITZ, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. WHEREAS in 2021, the Village of Croton-on-Hudson was awarded grant funding through the New York State Clean Energy Communities (CEC) Program for various clean energy projects, including the installation of solar panels atop the Washington Engine Company firehouse on North Riverside Avenue, and WHEREAS the Village signed an agreement with New York State Energy Research and Development Authority (NYSERDA) outlining the terms and conditions of the implementation of the grant project, dated March 14, 2021, and WHEREAS a modification has been proposed to this Agreement in order to permit the Village of Croton-on-Hudson to purchase a municipal Electric Vehicle, subject to certain terms and conditions, NOW THEREFORE BE IT RESOLVED that the Village Manager is hereby authorized to execute Modification No. 1 to the Clean Energy Communities (CEC) August 14, 2023 Agreement with the New York State Energy Research and Development Authority. Village Manager Healy explained that because the Washington Engine project came in under budget, our Sustainability Chair, Lindsay Audin, has worked with NYSERDA to have some of those funds repurposed so that it can be put towards an electric vehicle. Resolution 186 of 2023 On motion of TRUSTEE SIMON seconded by TRUSTEE GALLELLI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. WHEREAS the Village of Croton-on-Hudson was approved to receive funding from the Federal Emergency Management Agency to purchase a new street sweeper for the Department of Public Works, and WHEREAS the Village has received payment from FEMA totaling $294,924.95, and WHEREAS a portion of these funds will be used to replenish the capital account used to purchase the street sweeper and a portion will be used to fund necessary stormwater improvements, NOW THEREFORE BE IT RESOLVED: that the Village Treasurer is authorized to make the following budget amendment to the 2023-2024 General Fund and Capital Fund budgets: GENERAL REVENUE Increase A1000.4960 – Federal Emerg Disaster - FEMA $179,910.21 GENERAL EXPENSES Increase A9901.9030 – Transfer to Capital Fund $179,910.21 CAPITAL REVENUE Increase Village Board of Trustees August 14, 2023 H1000.5031.24467 – Transfer from General Fund $179,910.21 CAPITAL EXPENSES Increase H5110.2010.23441 – DPW Equipment $89,910.21 H5110.2010.24465 – Village Wide Stormwater $90,000.00 DISCUSSION: Village Manager Healy stated that this dates back to Hurricane Irene (2011), where the Village was allocated funds from FEMA to do work along the Croton River, but between the Hydrilla project, which delayed the work, and further evaluations that determined the work was no longer necessary, the Village did not receive the funds. Village Manager Healy stated that we are grateful that these funds are being reallocated towards purchasing the street sweeper. Mayor Pugh thanked FEMA for their flexibility and also credited former Congressman Mondaire Jones for all his efforts in helping us to secure these funds. Resolution 187 of 2023 On motion of TRUSTEE GALLELLI, seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 4-0 vote. WHEREAS the property owners of 101 Scenic Drive West have notified the Department of Public Works that there is a sinkhole forming on their property, and WHEREAS upon further investigation, the Department of Public Works has determined that the area of concern is surrounding a manhole that is part of the Village drainage system running through the property, and WHEREAS repair and maintenance of the stormwater system is the Village’s responsibility, and WHEREAS each heavy rainstorm contributes more to the deterioration of the system, and has the potential to create a very dangerous condition, and Village Board of Trustees August 14, 2023 WHEREAS due to the urgent nature of this repair, the Village would require the assistance of an outside contractor to perform this work, and WHEREAS General Municipal Law Section 103(4) allows for the Board to let a contract without public bidding where necessary due to a public emergency arising out of an unforeseen occurrence or condition, and WHEREAS Superintendent of Public Works Frank Balbi has received a proposal for the repair and restoration of the system from Green Mountain Pipeline Services of Bethel, VT in the amount of $79,670, and WHEREAS Superintendent Balbi has estimated the cost of labor to excavate and repair the drainage manhole to be $10,330, NOW THEREFORE BE IT RESOLVED that the Village Board hereby declares the formation of a sinkhole at 101 Scenic Drive West to be an emergency situation, and BE IT FURTHER RESOLVED the Village Manager is authorized to accept the proposal from Green Mountain Pipeline Services of Bethel, VT in the not-to- exceed amount of $79,670, and BE IT FURTHER RESOLVED that the Village Manager is authorized to proceed in the not-to-exceed amount of $10,330 for labor-related costs in this project, and BE IT FURTHER RESOLVED that the funding for such project is available in the following capital line: H5110.2010.24465 6. PUBLIC COMMENTS ON NON-AGENDA ITEMS Ed Riely, 110 Truesdale Drive, Croton on Hudson, addressed his concerns with Wells Fargo Bank, immigration issues and bankruptcies of manufacturers of electric busses, and stated that the presentation made by Architect Ethan Lewis who spoke on Accessory Apartments at Croton’s July 17th Work Session was informative. 7. APPROVAL OF MINUTES: Motion to approve the minutes as amended of the Regular held on July 24, 2023, was made by Trustee Horowitz. The motion was seconded by Trustee Simon and approved with a 4-0 vote. August 14, 2023 8. REPORTS: Trustee Simon stated that he attended the Fire Council meeting on July 25th and updated us on equipment and plans for their October 8th Fire Fair, the Telecommunications Master Plan is well underway, the August 5th concert at Senasqua Park was well attended, on July 25th the Board had a tour of the Metro North Harmon yards and got an overview of their day to day operations, on July 9th he participated in a Press Conference where Senator Harckham awarded Croton $100,000 under the CREST Program, we are continuing to work with our Dog Park advocates as well as the neighbors on new measures to ensure proper usage of the park, and thanked Westchester County for addressing issues regarding maintenance of grass at Croton Point Park. Trustee Gallelli stated that the tour of the Metro North Harmon yard was very impressive, the 125 Anniversary Committee will be sponsoring a boat flotilla this Saturday, the 125 Anniversary Logo has been installed in front of Village Hall, reminded everyone that Hudson River Day will be held on September 9th at the Yacht Club, the Village of Croton along with the Village of Buchanan and Town of Cortlandt will be holding its 9-11 ceremony on September 11th at Croton Landing. Trustee Horowitz advised that the Croton Council on the Arts is planning a Hudson River Arts Festival on Saturday, September 2nd, (rain-date September 3rd), the Croton Conservation Advisory Council will hold its first Repair Café in the Community Room on December 9th, for more information you may log onto their website, and congratulated Aaron Lewis for completing his Eagle Scout project for his work at the Arboretum. Mayor Pugh stated that he had the honor of attending the Ecuadorian festival this past Sunday at Croton Point Park, next Saturday a community blood drive will be held at the Croton Library from 10:00am to 4:00pm. Village Manager Healy advised that DPW has been doing some landscaping at the 9-11 Memorial and path and while it may look somewhat bare, new plantings will be going in before the ceremony next month. Village Manager Healy advised that three additional names Village Board of Trustees August 14, 2023 will be added to the memorial year for those who have passed away from 9-11 related illnesses. Village Manager Healy announced that the Halloween Dog Parade and Goblin Walk will be held on October 28th. There being no further business to come before the Board a motion to close the meeting was made by Trustee Simon. The motion was seconded by Trustee Horowitz and approved with a 4-0 vote.
