Fee Schedule – Addition and Modification of ZBA Application Fees
A resident not satisfied with a ZBA decision is going to make a request for a rehearing under
section 230-164(K) of the Zoning Code. The Village fee schedule does not specifically list a fee
for a rehearing in front of the ZBA.
It is recommended that the VB adopt a fee of $200 for a rehearing. The rehearing requires the
same noticing as the original hearing for the application so the Village has the same legal notice
and homeowner notification and other processing expenses except that the homeowner mailing
list is already developed from the first hearing.
It is also requested that the fee for a ZBA application for an interpretation be reduced to $150.
An application for an interpretation of a provision of the zoning code or an administrative
official’s decision requires no public hearing, legal notice or neighbor notification expenses.
It is requested that this be done at the next available Village Board meeting (regular or work
session) so a specific fee is established for a rehearing.

230-164K. Rehearing. Any member of the Zoning Board of Appeals may make a motion to hold a rehearing on any
order or determination of the Board not previously reheard. A unanimous vote of all members of the Board then
present is required for such rehearing to occur. The rehearing is subject to the same notice provisions as the
original hearing. Upon such rehearing, the Board may reverse, modify or annul its original order, decision or
determination upon the unanimous vote of all members then present, provided the Board finds that the rights vested
in persons acting in good faith in reliance upon the reheard order, decision or determination will not be prejudiced
thereby.
