To: From: Date: March 4, 2022 Re: Local Law Introductory No. 4 of 2022 Local Law Introductory No. 4 of 2022 has been drafted to repeal Chapter 141, Housing Standards, of the Village Code. This section of the Village Code was originally adopted in 1982. Chapter 141 adopted, with some modification, the “Urban County Community Development Program Housing Standards Code," February 1979 Edition. This document has not been updated since that time and is considered outdated. Since this law was adopted, the New York State Uniform Fire Prevention and Building Code was adopted in 1984, which contained property maintenance standards. This was followed in 2003 by the state adopting the International Code Council (ICC) set of codes, which include the New York State Property Maintenance Code. This is the property maintenance code currently enforced in the Village and is applicable to all residential and non-residential structures. Furthermore, Chapter 141 also created a Housing Board of Appeals, which has been dormant for decades. All current “appeals” are handled by the Engineering Department and are referred to the Village Justice Court, if necessary. In discussion with the Village Engineer and Village Attorney, it is recommended that the Village Board of Trustees repeal this section of the code. Such a repeal will not require any change in current practice and will result in clarifying the procedure regarding any property maintenance issues that arise.
