DRAFT Regular Meeting of the Board of Trustees of the Village of Croton-on-Hudson, NY was held on Monday, March 21, 2022, in the Georgianna Grant Meeting Room at the Stanley Kellerhouse Municipal Building, Van Wyck Street, Croton-on-Hudson, NY 10520. 1. CALL TO ORDER Mayor Pugh called the meeting to order at 7:00pm. Everyone joined in the Pledge of Allegiance. Trustee Simon made a motion to approve the following Fiscal Year Vouchers. The motion was seconded by Trustee Gallelli and approved with a 5-0 Vote. $92,547.10 Water Fund $5,689.85 Sewer Fund $89.33 Capital Fund $17,935.18 Trust Fund $1,548.00 3. PUBLIC HEARING Motion to open a Public Hearing to consider a Local Law Introductory No. 4 of 2022, to repeal Chapter 141 of the Village Code entitled “Housing Standards” was made by Trustee Rosales. Motion was seconded by Trustee Horowitz and approved with a 5-0 vote. Village Manager Healy explained that this law was originally adopted in 1982 in conjunction with the “Urban County Community Development Program Housing Standard Code”, in the forty years since this law was adopted, New York State adopted a Statewide “Property Maintenance Code” as well as a “Uniform Fire Prevention and Building Code” and this law is bringing our code up to date to meet those new standards. Motion was seconded by Trustee Simon and approved with a 5-0 vote. RESOLUTION #34 OF 2020 On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE GALLELLI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS the Village would like to repeal Chapter 141 of the Village Code, Housing Standards, as it has become obsolete; and WHEREAS the Village Board is considering the adoption of Local Law Introductory No. 4 of 2022, which has been drafted to reflect such language; and WHEREAS a Public Hearing on Local Law Introductory No. 4 of 2022 was opened and closed on March 21, 2022, NOW THEREFORE BE IT RESOLVED: that the Village Board of Trustees hereby adopts Local Law Introductory No. 4 of 2022 to repeal Chapter 141 of the Village Code, Housing Standards, which upon adoption becomes Local Law No. 4 of 2022. 4. PUBLIC COMMENTS ON AGENDA ITEMS: - none 8. RESOLUTIONS: Resolution #35 of 2022 Village Trustees Board Meeting March 21, 2022 On motion of TRUSTEE GALLELLI, seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS the Village would like to amend Chapter 230 of the Village Code, Zoning, to add provisions related to cannabis shops, and WHEREAS the Village Board is considering the adoption of Local Law Introductory No. 5 of 2022, which has been drafted for such purposes, and WHEREAS the Village has completed Part 1 of the Short Environmental Assessment Form (EAF) and a Coastal Assessment Form (CAF), NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. The Village Board hereby determines that the Proposed Action is an Unlisted Action. 2. The Village Board hereby declares itself to be the Lead Agency for SEQRA purposes in connection with the Proposed Action. 3. The Village Board hereby issues the EAF and CAF which it has before it in connection with the Proposed Action. 4. The Village Board hereby refers to the Village Planning Board the Draft Law for a report back to the Village Board in accordance with Village law. 5. The Village Board hereby refers the Draft Law, the EAF and the CAF to the Village Waterfront Advisory Committee for a recommendation back to the Village Board in accordance with Village Law. 6. The Village Board hereby refers the Draft Law, the EAF and the CAF the Westchester County Planning Board for review in accordance with law. 7. The Village Board hereby directs Village staff to make any other circulations and notifications regarding the Proposed Action as may be required by law. Trustee Simon stated that in the draft Local Law it refers to the “C1” District, but in the “EAF” and “CAF” it also refers to the “C2”, “CIRA” and “CIRB” Districts and asked Village Attorney Whitehead to explain. Village Attorney Whitehead stated that the permitted uses are listed in the “C1” Zoning District, the other three Districts refer back to uses permitted in the “C1” Village Trustees Board Meeting March 21, 2022 District so the change in the Code are only made in the “C1”, but are immediately effective in the other three Districts. Trustee Simon stated that the law requires that these uses be five-hundred feet from a school and two-hundred feet from a religious institution, but on the map, it shows five-hundred feet from our religious institutions, and he is assuming that this is because each of these religious institutions have schools within them. Village Attorney Whitehead stated yes, school grounds are defined in the Education Law which includes pre-schools and nursery schools. 9. PUBLIC COMMENTS ON NON AGENDA ITEMS - none 10. APPROVAL OF MINUTES: Motion to approve the minutes as amended of the Regular Meeting held on February 28, 2022, was made by Trustee Simon. Motion was seconded by Trustee Horowitz and approved with a 5-0 vote. Motion to approve the minutes of the Regular Meeting held on March 7, 2022, was made by Trustee Simon. REPORTS: Trustee Rosales stated that these quarterly reports demonstrate the hard work that our departments are doing and encouraged everyone to take a look at them, last week’s Police Advisory Committee Town Hall meeting went very well, and he was extremely pleased with the level of professionalism and the excellence that everyone brought to this meeting, on Friday he looks forward to meeting with the new Diversity and Inclusion Committee Chairs. Trustee Simon advised that on March 10th he sat in on a Cannabis meeting wherein they established the regulations for licenses and details on how they will be selected, on March 10th, Croton hosted the monthly “Westchester Municipal Officials Association” meeting wherein the Westchester County Commissioner of Mental Health spoke, on March 15th he attended a meeting with the Town of Ossining regarding an electric bike share program, attended Village Trustees Board Meeting March 21, 2022 a meeting with the Bicycle Pedestrian Committee where they discussed the bike share program as well as the dummy light, and had the honor of attending a dinner honoring outgoing Fire Chief Phil Dinkler. Trustee Gallelli advised that the Police Advisory Committee Town Hall meeting held on March 15th was well organized, they covered a lot of territory and Chief Nikolopoulos gave a very thorough overview of what the Police Department has done since the Village adopted the Police Reform resolution, attended the Village’s Tax Lien Sale wherein fourteen parcels were sold, attended the dinner honoring outgoing Fire Chief Phil Dinkler, advised that a “Salute to Seniors” event will be held at Croton Point Park on Wednesday, May 18th, anyone interested in attending must sign up by May 10th by calling 914-218-3968, Westchester County Bee-Line Buses will offer free rides to seniors on three Fridays in May, and reminded everyone that the Vietnam Veteran Day Ceremony will be held next Tuesday at 1:30pm at the Harmon Firehouse. Trustee Horowitz advised that the Conservation Advisory Council will be hosting a Green Living series this Thursday evening, on April 5th the Diversity and Inclusion Committee is hosting their second discussion on the “1619 Project” book, you can register by going to the following COH.DI.Commttee@gmail.com, on April 9th the Little League will be holding their opening day parade, on April 24th the Arboretum is offering an Earth Day Tree Identification Walk” from 12:00-2:00pm, information can be found on the Croton Community Calendar, the Pavilion at Senasqua Park will be available for rental on weekends, for more information you can reach out to the Recreation Department. Mayor Pugh thanked outgoing Fire Chief Phil Dinkler for his service to the Village and was proud to attend the dinner honoring him, and wished the new Chiefs the best of luck. Village Manager Healy advised that the Tentative 22/23 Budget has been filed with the Village Clerk and can be found online, hard copies are also available at the Library and Village Hall, advised that the Residential Parking System “Bill” for Benedict Blvd has been introduced in the Legislature, we are Village Trustees Board Meeting March 21, 2022 waiting for Senator Harckham to introduce the “Companion Bill” in the Senate, once the Village has the “Bill” number the Board can formally adopt the Home Rule request, he along with Village Attorney Whitehead and Lindsay Audin have been working on the solar project at Croton Landing, this is another “Home Rule” request that we hope will make this Legislative session, and advised that all data that was discussed at the Town Hall meeting is now available to review on the Police Advisory Committee’s page: https://www.crotononhudson-ny.gov/police-advisory-committee There being no further business to come before the Board, a motion to close the meeting was made by Trustee Simon.
