Regular Meeting of the Board of Trustees of the Village of Croton-on-Hudson, NY was held on Monday, June 21, 2022, in the Georgianna Grant Meeting Room at the Stanley Kellerhouse Municipal Building, Van Wyck Street, Croton-on-Hudson, NY 10520. The following official was absent: Village Attorney Whitehead 1. CALL TO ORDER Mayor Pugh called the meeting to order at 7:00pm. Everyone joined in the Pledge of Allegiance. Trustee Gallelli made a motion to approve the following Fiscal Year Vouchers, claims numbered 21226757 through 21227086. The motion was seconded by Trustee Simon and approved with a 5-0 Vote. $202,300.32 Water Fund $23,712.65 Sewer Fund $7,285.55 Capital Fund $26,124.07 Trust Fund $11,947.57 3. PUBLIC HEEARING #1 A Motion to open a Public Hearing regarding Local Law No. 8 to amend various chapters of the Village Code to update provisions related to fees was made by Trustee Simon. Motion was seconded by Trustee Horowitz and approved with a 5-0 vote. Village Manager Healy explained that some of the language in the proposed law regarding “Student Filming Permits” may be somewhat vague and ambiguous, after meeting with the school district to go over some of their concerns, it was determined that the way the law is currently written, it might make it seem that students in the public schools (elementary through high school) might have to get a permit Mayor Pugh Trustee Gallelli Village Manager Bryan Healy Trustee Horowitz Village Treasurer Tucker Trustee Rosales Trustee Simon Village Trustees Board Meeting June 21, 2022 which requires obtaining insurance even if they were just filming a project using a cell phone, this was not the Village’s intent and recommended holding the Public Hearing but not vote on it until we’ve had an opportunity to update the language. Neil Haber, 7 Sunset Drive, Croton on Hudson, member of the Croton Harmon Board of Education, stated that he is pleased that the Board is taking a look at the language, his concern is even if the fee is zero, students would still be required to obtain insurance as well as every other provision in Chapter 157 and asked that the law be re-drafted to take into consideration filming by school age children for class projects or something of that nature. There being no comments to come before the Board a motion to hold over the Public Hearing was made by Trustee Simon. Motion was seconded by Trustee Simon and approved with a 5-0 vote. PUBLIC HEARING #2 On motion to open a Public Hearing on Local Law Introductory No. 9 of 2022 to amend Chapter 204, “Taxation, of the Village Code to institute the Volunteer Firefighter and EMS Tax Exemption was made by Trustee Simon. Motion was seconded by Trustee Horowitz and approved with a 5- 0 vote. Village Manager Healy explained that a new State Law has been adopted and until the Bill is signed by the Governor the Village is unable to adopt the “Volunteer Firefighter and EMS Tax Exemption” and recommended that we withdraw the Local Law. There being no further comments to come before the Board a motion to withdraw Introductory Local Law No. 9 was made by Trustee Gallelli. Motion was seconded by Trustee Simon and approved with a 5-0 vote. 4. RESPONSES TO QUESTIONS SUBMITTED BY EMAIL - none 5. CORRESPONDENCE Village Trustees Board Meeting June 21, 2022 a. Letters from NYS Department of State and Westchester County Department of Planning requesting an “LWRP Consistency Review” for the Grant Street Retaining Wall project. On motion by Trustee Horowitz and seconded by Trustee Simon the Board of Trustees approved the request from the New York State Department of State and Westchester County Department of Planning for an “LWRP Consistency Review” for the Grant Street Retaining Wall project. Motion was approved with a 5-0 vote. b. Letter from John Munson, President of the Croton Fire Council noting membership changes in the Croton Fire Department. c. Draft “Request for Interest” with respect to the Gouveia Park property. https://play.champds.com/ATT/crotononhudsonny/2022- 06/daf892f6767315181e170dcc8a1252b9587022e9.pdf Village Manager Healy stated that this “RFI” is similar to what Tarrytown issued for the “Washington Irving Boat Club” which is also parkland and owned by Tarrytown and thanked the Village Manager of Tarrytown for sharing that document. Trustee Simon stated that he is pleased that we are asking for specific proposals on what could be done with the house, as well as what they would envision how the park may be used consistent with the new uses of the house. Village Manager Healy stated that there are limitations because the property is designated “Parkland,” but a restaurant is one of the few uses that the State has agreed is compatible with “Parkland” use. Trustee Gallelli stated that this can be an evolutionary process, if we get something of interest for the residential piece then we can look at the “Parkland” piece but does not believe it has to be tied together. Village Trustees Board Meeting June 21, 2022 6. PUBLIC COMMENTS ON AGENDA ITEMS: Ed Riely, 110 Truesdale Drive, Croton on Hudson, stated that he believes the Gouveia property is going to be a difficult piece of property to deal with, and suggested a pedestrian bridge connecting it to the river and extending the walkway, he also recommended getting rid of the Village newsletter since it only seems to serve the politicians, and objected to comments made by School Board member Joshua Diamond, 7. RESOLUTIONS: Resolution #93 of 2022 On motion of TRUSTEE GALLELLI, seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS at a Village Board Meeting on October 15, 2007, T-Mobile Northeast LLC, (f/k/a Omnipoint Communications, Inc.), was issued a Telecommunications special permit to collocate a personal wireless facility at 1 Van Wyck Street, and WHEREAS the special permit was renewed by the Village Board on November 25, 2013, and September 17, 2018, and WHEREAS this Telecommunications special permit expires on October 15, 2022, and must be renewed in accordance with the Telecommunications Chapter of the Village Code, and WHEREAS, the Village has received a special permit renewal application from T- Mobile and the associated $2,500 fee, and WHEREAS, renewal of the special permit does not require an environmental review, NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby schedules a public hearing to be held on Tuesday, July 5, at 7 p.m. in the Georgianna Grant Meeting Room of the Stanley H. Kellerhouse Municipal Building, 1 Van Wyck Street, Croton-on-Hudson, New York 10520. Resolution #94 of 2022 Village Trustees Board Meeting June 21, 2022 On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE GALLELLI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS the Village of Croton-on-Hudson adopted a budget of $18,000 for alarm permit revenues, and WHEREAS the alarm permits are now processed by the Village Clerk's Office instead of the Engineering Department, and WHEREAS the Village of Croton-on-Hudson previously allocated alarm permit revenue to revenue code A1440.2550, NOW THEREFORE BE IT RESOLVED: that the Village Board hereby authorizes the Village Treasurer to reallocate $18,000 from A1440.2550 (Public Safety Permit) to the following account: A1410.2550 – Alarm Permits: $18,000 Resolution #95 of 2022 On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. Resolution #96 of 2022 On motion of TRUSTEE SIMON, seconded by TRUSTEE HOROWITZ, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS the Village Board of Trustees is desirous of allowing merchants to set up booths and tables in certain areas of the Village at certain times, and Village Trustees Board Meeting June 21, 2022 WHEREAS the Village Board of Trustees adopted Local Law 8 of 2020, which amended Chapter 172 of the Village Code, Commercial Soliciting permit such activity, and WHEREAS the Street Vendor License Policy was amended on June 22, 2020, and February 28, 2022, to allow for more licenses per location and an earlier start time for each vendor, and WHEREAS the amended Street Vendor License Policy contains a sunset date of June 5, 2022, pending a review of its operation, and WHEREAS this review was conducted at a work session held on May 23, 2022, NOW THEREFORE BE IT RESOLVED that the Board of Trustees hereby readopts the Street Vendor License Policy as previously amended. Resolution #97 of 2022 On motion of TRUSTEE GALLELLI, seconded by TRUSTEE Simon, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. A RESOLUTION AUTHORIZING THE ISSUANCE OF $30,000 BONDS OF THE VILLAGE OF CROTON-ON-HUDSON, WESTCHESTER COUNTY, NEW YORK, TO PAY THE COST OF THE PURCHASE OF A LICENSE PLATE READER SYSTEM FOR THE POLICE DEPARTMENT, IN AND FOR SAID VILLAGE. WHEREAS all conditions precedent to the financing of the object or purpose hereinafter described, including compliance with the provisions of the State Environmental Quality Review Act, have been performed; and WHEREAS, it is now desired to authorize the financing of such capital project, Village Trustees Board Meeting June 21, 2022 NOW, THEREFORE, BE IT RESOLVED, by the Board of Trustees of the Village of Croton-on-Hudson, Westchester County, New York, as follows: The purchase of a license plate reader system for the Police Department, including incidental expenses in connection therewith, for the Village of Croton-on- Hudson, Westchester County, New York, is hereby authorized at a maximum estimated cost of $30,000. Section 2. The plan for the financing of the aforesaid maximum estimated cost is by the issuance of $30,000 bonds of said Village, hereby authorized to be issued therefor pursuant to the provisions of the Local Finance Law. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is five years, pursuant to subdivision 32 of paragraph a of Section 11.00 of the Local Finance Law. It is hereby further determined that the maximum maturity of the serial bonds herein authorized will therefore not exceed five years. Section 4. The faith and credit of said Village of Croton-on-Hudson, Westchester County, New York, are hereby irrevocably pledged for the payment of the principal of and interest on such bonds as the same respectively become due and payable. An annual appropriation shall be made in each year sufficient to pay the principal of and interest on such bonds becoming due and payable in such year. There shall annually be levied on all Village Trustees Board Meeting June 21, 2022 the taxable real property of said Village, a tax sufficient to pay the principal of and interest on such bonds as the same become due and payable. Section 5. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the bonds herein authorized, including renewals of such notes, is hereby delegated to the Village Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Village Treasurer, consistent with the provisions of the Local Finance Law. Section 6. The powers and duties of advertising such bonds for sale, conducting the sale and awarding the bonds, are hereby delegated to the Village Treasurer, who shall advertise such bonds for sale, conduct the sale, and award the bonds in such manner as the Village Treasurer shall deem best for the interests of said Village, however, that in the exercise of these delegated powers, the Village Treasurer shall comply fully with the provisions of the Local Finance Law and any order or rule of the State Comptroller applicable to the sale of municipal bonds. The receipt of the Village Treasurer shall be a full acquittance to the purchaser of such bonds, who shall not be obliged to see to the application of the purchase money. Section 7. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, Village Trustees Board Meeting June 21, 2022 including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Village Treasurer, the chief fiscal officer of such Village. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such form and contain such recitals, in addition to those required by Section 51.00 of the Local Finance Law, as the Village Treasurer shall determine consistent with the provisions of the Local Finance Law. Section 8. The validity of such bonds and bond anticipation notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Village is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 9. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150 - 2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or Village Trustees Board Meeting June 21, 2022 otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 10. This resolution, which takes effect immediately, shall be published in summary form in the official newspaper, together with a notice of the Village Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. Resolution #98 of 2022 On motion of TRUSTEE GALLELLI, seconded by TRUSTEE ROSALES, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS the Village Board of Trustees adopted a social media and email blast policy on June 17, 2019, to govern the use of its social media accounts and e-blast, and WHEREAS changes to this policy were discussed at a board work session held on May 23, 2022, and WHEREAS the only substantial change to the policy is to allow the publicization of Village-sponsored events within the weekly Croton Community Calendar, NOW THEREFORE BE IT RESOLVED that the Board of Trustees hereby adopts the Social Media and Email Blast Policy as amended. Mayor Pugh stated that he understands what we are trying to achieve, but wants to make sure that the Policy reflects that while we want to be able to promote events where businesses might exist, at the same time we also want everyone to understand that the Village is not promoting specific businesses. Village Manager Healy stated that we should not be promoting a specific business or their website, but we can promote an event that happens to have businesses at that event. Village Trustees Board Meeting June 21, 2022 Trustee Simon stated that the Croton Business Council is doing that type of promotion and looks forward to seeing all of the appropriate uses of this new interaction with the public. Resolution #99 of 2022 On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS the Village would like to amend Chapter 135, Garbage, Rubbish and Littering, of the Village Code to detail the billing and appeals processes for excess garbage and rubbish, and WHEREAS the Village Board of Trustees is considering the adoption of Local Law Introductory No. 10 of 2022, which has been drafted for such purposes, NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby calls for a Public Hearing on July 5, 2022, at 7 PM to consider Local Law Introductory No. 10 of 2022 to amend Chapter 135, Garbage, Rubbish and Littering, of the Village Code to detail the billing and appeals processes for excess garbage and rubbish, and BE IT FURTHER RESOLVED that such Public Hearing shall be held in the Georgianna Grant Meeting Room of the Stanley H. Kellerhouse Municipal Building, 1 Van Wyck Street, Croton-on-Hudson, New York 10520. DISCUSSION Village Manager Healy stated that this primarily refers to commercial properties and explained that all businesses in the Village get one free pick up a week, if they need a second pick up, they are required to pay a fee and this law allows the Village to assess an outstanding bill as a Lien on their property if the bill is not paid. Village Manager Healy stated that in the instance that there may be a residential issue, the language is there, but that is not the practice that is occurring right now, Resolution #100 of 2022 Village Trustees Board Meeting June 21, 2022 On motion of TRUSTEE GALLELLI, seconded by TRUSTEE SIMON, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS the Village would like to amend Chapter 86 of the Village Code, Building Construction, to institute the NYStretch Energy Code, and WHEREAS the Village Board of Trustees is considering the adoption of Local Law Introductory No. 7 of 2022, which has been drafted for such purposes, and WHEREAS on May 16, 2022, the Village Board of Trustees declared itself Lead Agency for SEQRA purposes in relation to the Proposed Action, and WHEREAS on May 16, 2022, the Village Board referred the draft law, EAF and CAF to the Waterfront Advisory Committee, and WHEREAS the Village Board has received a recommendation of consistency from the Waterfront Advisory Committee with the Village’s Local Waterfront Revitalization Program, and WHEREAS the Village Board must make its own determination of consistency with the LWRP policy standards and conditions, and WHEREAS on June 6, 2022, the Village Board of Trustees undertook the process of LWRP Consistency Review and EAF Part II Review for Local Law Introductory 7 of 2022 attached hereto, and NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby issues and adopts the EAF Parts 2 and 3 Determination of Significance attached hereto, and adopts a Negative Declaration under SEQRA in connection with this action, and BE IT FURTHER RESOLVED that the Village Board of Trustees hereby finds that the following LWRP policies are applicable to the Proposed Action: POLICY 1A: Existing planning and zoning documents should be reviewed and amended where necessary to ensure development within the community is consistent with adopted goals and policies. Village Trustees Board Meeting June 21, 2022 The remaining policies and conditions of the LWRP not specifically discussed above were reviewed and found to not be applicable, AND BE IT FURTHER RESOLVED as follows: Based upon the above, the Village Board of Trustees confirms its determination that the Proposed Action, the adoption of Local Law Introductory No. 7 of 2022 to amend Chapter 86 of the Village Code, Building Construction, to institute the NYStretch Energy Code, complies with the policy standards and conditions set forth in the Village’s LWRP. Trustee Simon thanked Lindsay Audin, Bernie Yozwiak and Jon Katz for the many hours in preparing the background materials as well as the cooperation from our Village Engineer and Village Manager in helping to move this forward, all indications from other communities is that it is going well and he expects it will evolve overtime and something that we will have to look at periodically, but it is a great move for Croton and is grateful for everyone’s involvement. Trustee Gallelli dittoed Trustee Simon’s comments, and pointed out that this applies to new construction. Mayor Pugh expressed his great appreciation to Lindsay Audin, Bernie Yozwiak and Jon Katz as well as the entire Sustainability Committee for all their efforts. Resolution #101 of 2022 On motion of TRUSTEE SIMON seconded by TRUSTEE HOROWITZ the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS the Village would like to amend Chapter 86 of the Village Code, Building Construction, to institute the NYStretch Energy Code, and WHEREAS the Village Board of Trustees is considering the adoption of Local Law Introductory No. 7 of 2022, which has been drafted for such purposes, and WHEREAS on June 6, 2022, a Public Hearing was opened and closed, and WHEREAS on June 6, 2022, the Village Board conducted its LWRP Consistency Village Trustees Board Meeting June 21, 2022 Review and completed the SEQRA EAF Part II, and WHEREAS on June 21, 2022, the Village Board adopted a resolution of consistency with the LWRP and a Negative Declaration in accordance with SEQRA, NOW THEREFORE BE IT RESOLVED: that the Village Board of Trustees hereby adopts Local Law Introductory No. 7 of 2022 to amend Chapter 86 of the Village Code, Building Construction, to institute the NYStretch Energy Code, which upon adoption becomes Local Law No. 7 of 2022. Resolution #102 of 2022 On motion of TRUSTEE GALLELLI, seconded by TRUSTEE HOROWITZ, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with a 5-0 vote. WHEREAS the onsite audit has been scheduled for the 2021-22 fiscal year end, and WHEREAS the following budget transfers are required as detailed in the attached schedules, NOW THEREFORE BE IT 5-0 vote, with a 5-0 vote. WHEREAS on April 20, 2015, the Village Board of Trustees approved a resolution to enter into an agreement to participate in a Sustainable Westchester Community Choice Aggregation (“CCA”) program for the purpose of procuring an energy supplier who will contract with the Village to supply energy for its residents, and Village Trustees Board Meeting June 21, 2022 WHEREAS on October 19, 2020, the Village Board of Trustees authorized the second iteration of the CCA program for the period beginning January 1, 2021, through June 30, 2022, and WHEREAS on April 4, 2022, the Village Board of Trustees authorized the continued participation in the CCA program beginning July 1, 2022, and WHEREAS due to the volatility of the current energy market, Sustainable Westchester has been unable to come to terms on a successor agreement at this time, and WHEREAS Sustainable Westchester has provided the Village with an updated Memorandum of Understanding (MOU) reflecting a pause in the program and anticipated restart date of November 1, 2022, NOW THEREFORE BE IT RESOLVED that the Village Board of Trustees hereby authorizes the Village Manager to execute the Memorandum of Understanding with Sustainable Westchester confirming the participation by the Village of Croton-on- Hudson in the next CCA iteration. Resolution #104 of 2022 On motion of TRUSTEE HOROWITZ, seconded by TRUSTEE GALLELLI, the following resolution was adopted by the Board of Trustees of the Village of Croton-on- Hudson, New York, with 5-0 vote. WHEREAS in 2009, the Village of Croton-on-Hudson and Historic Hudson Valley (HHV), owner of the Van Cortlandt Manor property located at 525 South Riverside Avenue, executed a Memorandum of Understanding regarding the Van Cortlandt Manor Entrance Improvement Project, and WHEREAS in 2011, the Village agreed to serve as the municipal sponsor with the New York State Department of Transportation (NYSDOT) for the Van Cortlandt Manor Entrance Improvement Project, and WHEREAS this project is to be completed using federal and non-federal funds, the latter of which is to be covered by HHV, and Village Trustees Board Meeting June 21, 2022 WHEREAS the project has continued to be designed since that time, and WHEREAS in 2021, the Water Control Commission conducted a review of the project as lead agency under the State Environmental Quality Review Act (SEQRA), and WHEREAS both the Water Control Commission and Waterfront Advisory Committee have given their approval to the project, and WHEREAS HHV has provided an amended Memorandum of Understanding which documents the work done to date on the project, NOW THEREFORE BE IT RESOLVED that the Village Manager is hereby authorized to execute the amended Memorandum of Understanding with Historic Hudson Valley in regard to the Van Cortlandt Manor Entrance Improvement Project, subject to the final approval of the Village Attorney, and BE IT FURTHER RESOLVED that the draft construction contract to be included in the NYSDOT Construction Manual is approved, pending final approval of the Village Attorney. PUBLIC COMMENTS ON NON AGENDA ITEMS Ed Riely, 110 Truesdale Drive, Croton on Hudson, stated that it is his opinion that Croton has a diversity problem with respect to opinions not race, concerned about inflation and gas prices and once again asked that the Board write a letter asking the current Administration for some relief, suggested that Police Officers work more closely with the High School, and objects to Police Officers on bicycles because they will not be able to respond fast enough in an emergency, and believes that recent advertisements for marijuana might be targeting kids. 9. REPORTS: Trustee Rosales advised that he met with Croton Seniors this past Friday along with Village Manager Healy, they responded to questions and received good feedback. Trustee Simon advised that on June 8th the Zoning Board met and discussed a proposal for two homes on Harrison Street where the discussion focused on parking, attended a Webinar on the “Safe Streets for All” grant last week, on June 13th the Bicycle and Pedestrian Committee and the Trails Committee held a joint meeting, on June 16th the Hudson Valley Gateway Chamber held their annual Scholarship Awards program, Croton on Hudson senior Emma Opel was this year’s recipient, and announced that it is his father’s 99th birthday today. Trustee Gallelli advised that she along with Village Manager Healy, Mayor Pugh and Trustee Simon were present at the Harmon Firehouse where Senator Harckham presented them with a $100,000 check for the purchase of a new fire boat, do to supply chain issues it will take at least two years before the Fire Department receives it, commended all of our emergency services personnel for their quick response in dealing with a recent incident, this highlights what a fantastic emergency service operation we have in Croton, reminded everyone that this Tuesday is Primary voting. Trustee Horowitz advised that last Tuesday the Diversity and Inclusion Committee had a group discussion session entitled “sharing our immigrant stories,” it was well and attended and very moving, thanked Village Manager Healy for the email blast about the Merwin Oak Tree, and looks forward to seeing what responses we receive. Village Trustees Board Meeting June 21, 2022 Mayor Pugh expressed his deep appreciation to the Conservation Advisory Council for organizing a clean-up at the Duck Pond. Village Manager Healy advised that he met with Con Edison, along with our Department of Public Works, Engineering Department, Police Department and Fire Department to go over details regarding a gas main replacement project on Grand Street between Old Post Road South and Harrison Street, the project will start in July and last for approximately six months, this is going to be a high impact project because of its location and Con-Edison as well as the Village will be doing outreach to residents in that area. Village Manager Healy advised that he has received emails regarding the Merwin Oak tree and looks forward to reviewing the community’s recommendations.
