To: From: Date: August 13, 2026 Re: Local Law Introductory No. 12 of 2026 As discussed at the work session on June 24, 2026, I am recommending that Chapter 197 of the Village Code be amended to reflect three changes to the areas where property owners are exempt from the duty to clear or make safe the sidewalks adjoining their property. Chapter 197-15(B)(1) exempts sidewalks from the customary 12-hour clearing rule where “imposing the duty to clear or make safe would, due to geographical circumstances and limitations, create an undue burden.” Previous Village Boards have interpreted this clause to primarily mean lots which have street frontage on both sides of their property, and there is no easy access to the sidewalk. I am recommending that the section referencing Radnor Avenue be removed from the law and the area referencing Old Post Road South from Veterans Corners to Croton-Harmon High School be shortened. The Village owns the property abutting the sidewalk on Radnor Avenue, so it is our responsibility to clear it. I am also recommending that two sections on Farrington Road be added to the law. The western section of sidewalk on Farrington Road abuts the Farribank Condos on Bank Street and there is no easy access to this sidewalk. The eastern section on Farrington Road abuts homes on Palmer Avenue, none of which have stairs down to Farrington Road. Please let me know if you have any questions.
