SIDE LETTER OF AGREEMENT BETWEEN THE CROTON-HARMON UNION FREE SCHOOL DISTRICT AND THE AIDES OF CROTON UNITED, NYSUT/AFT/NEA WHEREAS, the Croton-Harmon Union Free School District (“District”) and the Aides of Croton United, NYSUT/AFT/NEA (“Union”) are parties to a Collective Bargaining Agreement (“CBA”) between them covering the term July 1, 2024 to June 30, 2027; and WHEREAS, Alexis Adamski (“Ms. Adamski”) was a teacher aide and a member of the Union during the 2025-2026 school year; and WHEREAS, the Union and Ms. Adamski have alleged that Ms. Adamski did not receive a fifteen (15) minute break on sixty-eight (68) days during the 2025-2026 school year; and WHEREAS, the District and the Union have entered discussions tegatding compensating Ms. Adamski for her alleged missed break time during the 2025-2026 school year; NOW, THEREFORE, IT IS HEREBY AGREED, by and between the Union and the District as follows: 1. The District shall provide Ms. Adamski a lump sum payment of Three Hundred and Thirty One and 50/100 ($331.50) Dollars in full satisfaction of any break time that she missed during the 2025-2026 school year, including, but not limited to, the alleged missed break time on the identified sixty-eight (68) days. Such payment shall be made within -l- thirty (30) calendar days of the effective date of this Side Letter of Agreement, less all applicable taxes, withholdings and/or deductions, in accordance with the payroll practices of the District. 2. Ms. Adamski and the Union hereby waive and release their claims for compensation for any missed breaks by Ms. Adamski during the 2025-2026 school year, and any and all claims related thereto, with prejudice. 3. It is understood and agreed that neither this Side Letter of Agreement, nor the terms and conditions set forth herein, shall constitute an admission by the District of any kind, which has been entered into solely to avoid the time and expense associated with possible litigation. 4. The parties agree that neither this Side Letter of Agreement, nor the terms and conditions set forth herein, shall constitute a precedent with respect to batgaining unit members’ entitlement to breaks, with respect to bargaining unit members’ entitlement to be paid for missed breaks, and/or for any other purposes whatsoever. The parties further agree that neither this Side Letter of Agreement, nor the terms and conditions set forth herein, may be introduced into evidence in any future negotiations, mediations, fact finding proceedings and/or in any administrative or judicial forums, except for the purposes of enforcing the parties’ agreements contained herein. = 5. This Side Letter of Agreement is subject to and contingent upon its approval by the Board of Education of the Croton-Harmon Union Free School District.
