SIDE LETTER OF AGREEMENT BETWEEN THE CROTON-HARMON UNION FREE SCHOOL DISTRICT AND THE CROTON TEACHERS’ ASSOCIATION WHEREAS, the Croton-Harmon Union Free School District (“District”) and the Croton Teachers’ Association (“Association”) are parties to a Collective Bargaining Agreement (“CBA”) between them covering the term July 1, 2024 to June 30, 202%; and WHEREAS, Alexandra Agugliaro (“Ms. Agugliaro”), Ryan Callahan (“Mr. Callahan”), Stephen Palenscar (“Mr. Palenscar”); David Xavier (“Mr. Xavier”), and Cassandra Cartaginese (“Ms. Cattaginese”) are teachers and members of the Association bargaining unit; and WHEREAS, Ms. Agugliaro, Mr. Callahan, Mr. Palenscar, Mr. Xavier, and Ms. Cartaginese have each agreed to teach an additional (i.e., a 6th) section of instruction in addition to their current teaching loads in lieu of their preparation periods during the period from April 6, 2026 to May 21, 2026; and WHEREAS, the parties have entered into discussions regarding compensating Ms. Agugliaro, Mr. Callahan, Mr. Palenscar, Mr. Xavier, and Ms. Cartaginese for their additional assignments as set forth above; NOW, THEREFORE, IT IS HEREBY AGREED, by and among the parties as follows: 1. The parties agree, that notwithstanding any language in the CBA to the contrary, as follows: a. Effective April 6, 2026, Ms. Agugliaro, Mr. Callahan, Mr. Palenscar, Mr. Xavier, and Ms. Cartaginese shall each be assigned an additional (ie., a 6') section of instruction in the special education tenure area in addition to their current teaching loads until May 21, 2026; and ei . b. Ms. Agupliaro, Mr. Callahan, Mr. Palenscar, Mr. Xavier, and Ms. Cartaginese shall teach the additional (i.e., a 6") section of instruction as set forth in Paragraph 1.a. above in lieu of their preparation periods; and c. Based upon the assignment of the additional (i.e., a 6t4) section of instruction as set forth above, Ms. Agugliato, Mr. Callahan, Mr. Palenscar, Mr. Xavier, and Ms. Cartaginese shall each be compensated for every additional period of instruction they teach during the period from April 6, 2026 to May 21, 2026 pursuant to this Side Letter of Agreement, in accordance with the following formula, which shall be in addition to their regular pay: annual salary divided by 187, multiplied by 0.20. 2. The parties agree that neither this Side Letter of Agreement, nor the terms and conditions set forth herein, shall constitute a precedent with respect to Ms. Agugliaro, Mr. Callahan, Mr. Palenscar, Mr. Xavier, and Ms. Cartaginese at any other time or for any other assignments, with respect to any other bargaining unit members, with respect to a bargaining unit membet’s entitlement to additional compensation for being assigned additional periods or sections of instruction, with respect to the calculation of a bargaining unit membet’s daily rate and/or for any other purposes whatsoever. The parties further agree that this Side Letter of Agreement, and the terms and conditions set forth herein, shall not be utilized, introduced, or referenced during any subsequent action, administrative proceeding, or arbitration, except to enforce the terms of this Agreement. 3. This Side Letter of Agreement is subject to and contingent upon its approval by the Board of Education of the Croton-Hatmon Union Free School District.
