To: From: Date: March 31, 2025 Re: Legislation on Shared Bicycle Systems As you are aware, the Village is planning to roll out the Project Mover shared e-bike system later this year. New York State Vehicle & Traffic Law governs a number of items related to the use of e-bikes (formally called bicycles with electric assist) in cities, towns and villages, including:  E-bikes are not allowed to operate on sidewalks unless expressly authorized by local law;  Children under 16 years of age are not permitted to operate e-bikes;  16- and 17-year-olds must wear helmets when operating e-bikes;  E-bikes cannot exceed a speed of 20 MPH;  Class III e-bikes are prohibited from operating in municipalities with less than a population of 1 million. Section 1243 of the Vehicle & Traffic Law prohibits the operation of shared bicycle with electric assist systems absent the adoption of a local law by the Village Board. Thus, the Board must adopt legislation before Project Mover can begin operation in the Village. The Village Board may also adopt regulations on the time, place and manner for e-bike operations if it chooses to do so. The Village of Ossining has already adopted legislation authorizing the Project Mover shared bicycle system. I recommend that the Village Board refer this legislation to the Bicycle-Pedestrian Committee for their review and comment. Following their report, the Village Attorney and I can draft legislation for the Board to consider. Please let me know if you have any questions.
