To: From: Date: April 15, 2025 Re: Local Law Intro 4 and Local Law Intro 5 The Village Board will be starting the process to review Local Law Introductory 4 of 2025 and Local Law Introductory 5 of 2025 on April 23, 2025. Both local laws have been drafted to update the Village Code with new provisions for the protection of trees on public property as well as private property, the replacement of trees removed on private property, and stiffer penalties for the illegal removal of, or injury to, trees. These local laws were based off the Westchester County Model Tree Ordinance, which is the local law adopted by the Town of Greenburgh regarding tree preservation. Last year, the Village Board referred the model ordinance to the Conservation Advisory Council (CAC) and asked them to return an advisory report for the Village Board’s consideration. The Village Board held a number of work sessions where the local law was reviewed and received input from the CAC on the various provisions. All of the changes requested by the Village Board have been incorporated into these two local laws. Among the changes included is the requirement to receive a tree removal permit if a property owner is removing more than three trees in any 12-month period, the requirement for a tree removal permit if the tree is located within a wetland or wetland buffer, the requirement to plant replacement trees or contribute to the Village’s tree fund when removing three or more trees, and higher penalties if trees are injured or removed without following the provisions of the law. Both local laws will now go through the State Environmental Quality Review (SEQR) process, as well as a review of consistency with the Village’s Local Waterfront Revitalization Program (LWRP). Additionally, Local Law Introductory 5 of 2025 will be referred to the Village Planning Board and Westchester County Planning Board for review and comment as it is proposing to amend the Village Zoning Code.
