To: Cc: Daniel O’Connor, Village Engineer From: Date: July 19, 2025 Re: Adopted Tree Law As Village staff begin to implement the tree law adopted by the Village Board of Trustees on July 9, 2025, a couple of questions have arisen regarding the Tree Preservation Fund that need direction from the Board. 1. Does the Board wish to have all fees required under this Chapter (include tree removal permits) go into the tree preservation fund (as envisioned in Section 208-24A), or only payments in lieu of replacement, fines and forfeitures (as envisioned in Section 208-24B)? If the former, the Board could set a limit (e.g., up to $5,000 received annually from tree removal permits shall be deposited). 2. Section 208-24C requires the Board to establish a fee for payments in lieu of replanting. However, Section 208-22D states that the payment shall be based on the sum or sums equivalent to the value of the trees which cannot be planted. Which basis does the Board wish to implement for these payments? Once these questions are answered, we can prepare an update to the Code for these two specific items and move forward with publicizing the new law.
