Alright. Welcome everyone to the Village of Croton on Hudson planning board meeting for Tuesday, 10/27/2026. We have an old business item to start off with. It's best dispensary near me, 370 South Riverside Avenue. Final signage approval with v e d... VEB recommendation.

Speaker 1 0:40 🎥

So

Speaker 0 0:43 🎥

as I... Come on up, guys, please. As I recall last time, we were basically dealing with signage at this point, and we had asked you you to provide some options, and you have. Thank you. You're welcome. And so if you wanna just quickly present those, then then we can have a discussion and hopefully put this guy to bed tonight. Good

Speaker 2 1:15 🎥

evening, mister chairman, members of board, council. Just to jump right into it, we we came back and we provided you with three additional options. One of which was at your request, which aesthetically doesn't work for us. That's number two. But numbers one, three, and four, we're okay with any of them, and we kinda will just leave it up to the board to choose which one you'd prefer the most out of those three options. And and hopefully we can wrap this up. If you have any specific questions as it relates to any of the options, we're happy to we're happy to answer them. Hopefully, the signs and the visual aids sort of speak for themselves.

Speaker 0 1:56 🎥

I just wanna make sure that procedurally that that both screens are on. They are. Yes. Okay. Because last time we had an issue where we only had the screen that we can see on. Yeah. Both of them are on.

Speaker 2 2:08 🎥

That is that option four? So that's that's up there right now on the screen is option four. And so that was the original design with the mindset name spread out a little bit more and the cannabis shop words made smaller. It's not? That says option four. That says option four. Yeah. Option four. That's it. Yeah. So... And then option three is the way in which you requested us, to provide the sign with the cannabis shop underneath the mindset. The stacked layout. With the stacked layout. And then option one was the original option, and then option two, you would ask us to put the cannabis shop with the same size. Yeah. Well, option two, aesthetically, this doesn't look good to us. And so we're requesting that you choose options number one, three, or four.

Speaker 4 3:01 🎥

Could you bring those up to us? Because we only have it Sure. You know, on, like, a map form, not simulated form.

Speaker 2 3:09 🎥

I think on the submission for you and your submission, it's on pages, I think it's six and seven.

Speaker 5 3:16 🎥

Yep. Alright.

Speaker 4 3:21 🎥

So

Speaker 0 3:29 🎥

one of the things that I recall from the sort of recommendations from the VEB was that that the signage... And and one of the things I recall you guys kinda presenting originally was this was gonna be kind of like the store in Tarrytown, and it seems to me that the the flag sign, which we said maybe the main sign can look more like the flag sign in terms of its proportion and design. Maybe the big... The main side could mirror that, which I think is the direction that we were recommended by the by the VEP. So I hear you that although you presented option two, I think mainly because we asked for it, it sounds like, but also the VEB, I think, asked for a sign more in that vein. And and it it seemed to me that... I mean, there's a lot more signage here, it seems, than actually than than the Tarrytown store as well. I mean, we have it on... In multiple places, which is is compliant with our code. And so we're we're not suggesting that there should be less of it. I don't think I'm not anyway. And I'd love to hear my colleague's opinion, but I would be most in favor of the one that you're least in favor of, I guess, option two. It's not an option for us respectfully.

Speaker 2 5:10 🎥

We gave it to you. It... It's just we do not like it. We wanna be proud of the signage we put up. We've made an incredible investment into your community, and we've been... As as you have been, and we appreciate, very accommodating. We tried to work with you, and and make a lot of concessions throughout the process, and we came back here with additional options and and a sign that's in the same vein, which is option three over here. Again, same with the cannabis shop underneath. This aesthetically to us just looks like a much nicer sign proportionally. It fits the windows. It just looks better. And and, like, we're happy to do this sign, and it's, again, similar vein in this. It's a little bit bigger, but it it does get you guys to the design that you requested from us. And so, like, we're we're happy to do this, but we need a little... I'm requesting respectfully a little bit of of a compromise here on the signage,

Speaker 0 6:08 🎥

and that's why we gave... That's why we're also... Again I mean, I'm not sure what you're talking about with all these concessions that you gave us. Yeah. I'm a little puzzled at that myself. And I would have a misstatement in my in my opinion, but regardless. You say he likes this how it frames out the manuscript. I just like how it frames the... You know, the the... This one here was basically a

Speaker 3 6:26 🎥

a copy of the perpendicular sign, which Right. Was just basically illustrated to show how it looks like a peanut on the wall.

Speaker 6 7:42 🎥

They pulled it because when we were... When you had presented to the group, you had used references to the trade at Tarrytown, the look of Tarrytown, that this was your branding, this is what you were gonna go for. And certainly, I know last meeting when I said something, you were like Teri Town is totally different. And that's... And so I I kind of would have hoped that all options presented would have been options that you would do. It's it's sort of hard to get, here's an option, but we're not gonna do it. And I think the issue is the the feeling of relationship between logo and description. You know, certainly when you also put apple in mind, you think it's just a logo. But I understand what you're saying. I just think that it's important to also be... Remember what we said to the group.

Speaker 2 8:35 🎥

I I think what we're talking about the feel is gonna feel like Tarrytown, not the signage necessarily, but we're talking about the interior of the store. And I think we've done the logo. You said logo. Logo and logo and signage are two separate things. The logo is the same. The signs are are are compliant for your code. And so... It's to say you can understand how a board and public might hear that differently. That's all. Well, I get it. Yeah. To address your concern, the reason why we presented is because you requested

Speaker 3 9:04 🎥

to see that option. Right. Yeah. That's why we presented that. And regarding the Teri Town store,

Speaker 6 9:10 🎥

they have since opened other stores, you know. And it was just what was presented as an option for this town for us to feel comfortable, that was what was presented. And when that meeting happened, there was no signage whatsoever presented, it was asked about, and that we weren't given any signage. So the first time we saw signage was last meeting.

Speaker 2 9:32 🎥

Understood. So.

Speaker 4 9:35 🎥

I actually like number two the best. It's closest to what we asked for. As far as concessions, since you opened the door, I would only say that we asked you to have certain store hours which you completely pushed back on. It was all the half hour difference we were asking for. So I don't know that you gave us really any concessions so far. I just want that on the record. I do like number two the best. I think it fulfills what we asked for. That's my opinion. That's my feedback.

Speaker 3 10:03 🎥

Can I can I ask you the question? Sure. The... All all the signs except for number one are kinda centered on the window. Everything else is off to a side. Is is there a reason for that, it's just they came came out? Centered over the window. Yeah. Right. We centered it over the win... We centered all the signs over the window, I think. They'd be centered over the window. No. I'm I'm talking about the the upper window.

Speaker 2 10:30 🎥

Oh, the upper window. We're centering over the storefront. He's talking about he's talking about, like, how these go up to the... They'll go up higher. Okay. Yeah. Rather, he's talking about the height. Right.

Speaker 3 10:40 🎥

I mean, it was done intentionally. It

Speaker 6 10:43 🎥

was done intentionally to match the bottom with the top.

Speaker 0 10:53 🎥

That's an interesting point, John. Think it... No. It's interesting what you're saying because I wonder if it wouldn't be aesthetically more If it was on... If it was under the windows. Actually aligned with the the three window component on the top rather than being centered on,

Speaker 4 11:18 🎥

I don't know what, below. It actually... It's eliminating the door from the width Of the that it's being centered, and the windows above are actually centered over the space. On the width of the door plus the window. So Right. Whatever sign winds up being put up there, I think John actually has an excellent point. I agree. And it ought to be centered between the windows above and the doors below. I don't think that's gonna affect your marketing one way or the other or your traffic. So I I think that's it it does look awkward the way it's presented now.

Speaker 6 11:48 🎥

I understand the logic of why, though.

Speaker 4 11:51 🎥

Yeah. I mean, it just... It's how you look at it. I agree, though. And I think that's one more reason why actually if number two were properly centered the way I'm describing it, the way John raised the issue on, it would actually work much better. It's not as though anybody coming or reading about you online is not going to understand that you're a dispensary in Croton called mindset. You know, how big or small... Well, I guess I don't have the applicant's attention. How big or small the words cannabis shop are, you're you're you're you're making this a hill to die on, and I don't really think you need to do that. So that's my additional feedback. I'll

Speaker 3 12:38 🎥

go one more time. The... Any of the signs. Any. The lighting is within the sign. There's nothing reflecting on it. Correct.

Speaker 4 12:49 🎥

Thank you. You're welcome.

Speaker 0 12:54 🎥

Any more thoughts?

Speaker 5 12:56 🎥

Yeah. I mean, two or three work for me.

Speaker 6 13:03 🎥

I like two or four.

I like the relative... The size relative, the logo to the descriptor. That's what I like. Could you say it again? You say it real of the logo relative to cannabis shop. I like the the matching. That's why I like two and I like four. Right. Okay.

Speaker 0 13:34 🎥

I'm kinda with you, Gabriella. I could go for four, I think. I think four is doable. And and I and I... It does give the window a little more space above. I do think centering it on that upper window would be an improvement. If it was centered under that window, it would look better. I think from a... From the street

Speaker 6 13:54 🎥

because the window overhangs.

Speaker 0 13:56 🎥

Yeah. I didn't even pick that up, John. That was an excellent point. So

Speaker 5 14:03 🎥

anybody else on board with that? And these all conform. With four centered is what we're saying? Yeah.

Speaker 0 14:10 🎥

Signed for centered on the upper window or slid over, you know, so that's Mhmm. There. I think it registers there with... Better with the building. Mhmm.

Speaker 6 14:21 🎥

And it would also still include the... If we think of the frontage of the store from door to corner of windows.

Speaker 0 14:27 🎥

Right? It's not Is that something you guys are agreeable with?

Speaker 2 14:30 🎥

Absolutely.

Speaker 0 14:33 🎥

Okay. Well, I think maybe we can put this to bed. I'd I'd throw one more curve at you, which...

Speaker 4 14:40 🎥

It's up to you. I don't... I'm just raising the idea. You just said you don't mind moving the sign to the left if you went with number four hypothetically. If you're centering things, you might wanna consider centering the word shop under cannabis rather than Oh, I think it's I think it's flush left. Do you? Okay. Yeah. I think flush left It's just something

Speaker 6 15:04 🎥

that you might wanna consider, but that's I from think a design standpoint, locking it up on the left is nice because of the exclamation point and the other. But personally,

Speaker 3 15:13 🎥

I think it works.

Speaker 5 15:17 🎥

Alright. Can we pivot to lighting real quick? If we get... If we're clear on the sign then up here for think so. So the sign itself would be turned off when the shop closes, I guess, is what we're saying. Yes. And when would it come on?

Speaker 2 15:36 🎥

When the shop opens?

Speaker 5 15:38 🎥

09:30 in the morning?

Speaker 3 15:40 🎥

We might... Well, it's gonna be on a timer, most likely. Yeah. But when when is it done? When the sun comes down, we turn the Yeah. Light. Photo eye or a timer that would come on, you know Okay. During Alright. And then

Speaker 5 15:53 🎥

in the eaves, I guess, it would be... You've you've got some some recessed, say, kinda dome lights that are shining down. What about the timing for those lights?

Speaker 2 16:04 🎥

Because they're they're they're actually pretty bright. They are pretty bright. We were over there. Yeah. I think the plan was to change those out for different... Is that... You wanted to change them? I I thought

Speaker 8 16:14 🎥

those dome lights should be a little dimmer because it's just, like, such a bright spot. We were talking about changing them out. Right? That'd great. Yeah. And getting rid of the ATM sign. Yeah.

Speaker 0 16:30 🎥

Alright. And I think we're... We don't have any issue with the color of the light within the box. We've dealt with that. Mhmm. Mhmm. And I don't... I mean, I don't think no matter how many sort of... The brightness factor of of the sign, it's not gonna be that bright given the, I think, saturation of color and the size of the cut letters. So I don't really have an issue with that. I think your point is excellent. So if we can, limit the, amount of light that this this sort of thing is a lantern there now

Speaker 2 17:06 🎥

Yeah. We'll do that. Be helpful. Absolutely.

Speaker 6 17:09 🎥

Do we need to specify what that would be just so everybody's on the same page?

Speaker 0 17:14 🎥

Do you have a suggestion

Speaker 3 17:16 🎥

of what would work there? This aluminum. You're talking about We're talking about the huge white... They're they're very white floodlights almost that shine down. They're incredibly bright. Yeah. There are there are a bunch of, you know, LED options that that can be replaced there, all with dimmable capabilities and Right. Know, or they could just have a Yeah. I mean, if we took the It's it's it's an off the shelf type of product that they... I'm sure that they could, you know, just get it and just And if you guys think it's too bright, just let it... Let us know, and we'll we'll turn it down. I mean that that would be something we would I think that if they if they can be dimmable

Speaker 0 17:50 🎥

as you had suggested and then, you know, at a at a level which is non offensive.

Speaker 4 17:57 🎥

Got it.

Speaker 5 17:59 🎥

And then the timing for those lights that we're we're talking about these... The dome lights that point downward, would they be coming off at closing hours as well? Yeah. I think the lights underneath,

Speaker 8 18:11 🎥

if they were dim enough, would be nice just to keep it lit a little bit just for people walking by. But, you know, if need them off, we could shut them off. Not... It's not a major thing. But what I was gonna say is those... They almost like flood... Three floodlights underneath where if we were able to, one, dim them or two, if we can replace them to just match the hi hats that are already underneath that you really can't see right now because they're getting washed out from those floodlights, we could put those there on a dimmer.

Speaker 0 18:42 🎥

That's where color temperature actually does make a difference. Right. You know, if we were down in the 2,700 or Right. Something like that range, I think it would be helpful. And then if they were on dimmers as well. So, Gabriella, you got some of that stuff?

Speaker 4 18:58 🎥

You wanna make a motion for us? Can I ask a question first? Of course. The stencil on the front door, is that to mimic the sign that's on the river side street side?

Speaker 3 19:13 🎥

Yeah. That is a that is a continuation of their logo. Yep. Okay. Two

Speaker 5 19:20 🎥

resolutions.

Speaker 6 19:21 🎥

So is one resolution on the sign? Yes. Okay. So to resolve that we're gonna go with option four to be centered under the top window. Triple window above. Yeah. Three pane window above the shop that it will turn off with the shop hours.

Speaker 5 19:44 🎥

That's that motion. Right? And the lights would be a separate motion. Well, I think we can Or do we wanna bundle it up? So all the lighting would be in the... In that motion, the motion we're talking about now, then the the conditions for the

Speaker 7 19:56 🎥

the special permit or...

Speaker 0 19:58 🎥

For the for the other conditions of their approval, we could just... That that's a... That'll be a separate motion. Yeah. I already agreed to that, so we can just make that a separate motion. Yep. Okay. That was about grand opening. That's all. Okay. That was separate. So this one, I think, we can go ahead and say that option four centered under the three pane window, turns off when the shop closes,

Speaker 6 20:20 🎥

and the the dome lights Soffit lighting. The soffit lighting will be on a dimmer.

Speaker 0 20:27 🎥

And and at a warm At a warm Temperature. Temperature. Suggested at 2,700 Kelvin.

Speaker 6 20:34 🎥

Do we also wanna say if we have... If we would like adjustments that they are open to the adjustments? Does that need to be in there that we agree to that or no?

Speaker 0 20:44 🎥

Could be.

Speaker 6 20:46 🎥

Sure. I mean, just because he said that if we have an issue, if we feel like it's too bright, that they will turn it down.

Speaker 7 20:57 🎥

Trying to think out of how best process. I'm trying to see how best that would be handled. You would have to At a... Why don't we say at a moderate level, lumen level? Yeah. You could you could do a subject, you know, maybe like future review. Or... Yeah. Or... Yeah. Something like To be evaluated in six months or something like that.

Speaker 6 21:15 🎥

Okay. And if everything's fine, we don't need to have another No. Okay. Does that... Is that acceptable? Please don't bring us back to to evaluate the signs in six months. Please sign. Please don't.

Speaker 4 21:25 🎥

Okay.

Speaker 2 21:26 🎥

Alright. I think that's... I've got a wrap on it. Have everything? Yep. The ATM sign. On the ATM sign. Yeah. You can put it on you can put it on the resolution. We'll take it off. Okay.

Speaker 7 21:35 🎥

Good? Good.

Speaker 0 21:37 🎥

Second that, John? Okay. Second that. All in favor? Aye. And then we have this, second resolution. Jeff, maybe you wanna make a motion on that. Yeah.

Speaker 5 21:52 🎥

Okay. We have a resolution for a change of use for best dispensary near me at 370 South Riverside. Change of use from retail from existing convenience store, and there are a number of conditions that the applicant has largely met already. That's correct. That just requires our approval. So I'll make a motion to approve that resolution.

Speaker 4 22:28 🎥

Okay. Before we vote, can I ask you a question? What did we give them approval on on the original approval? That wasn't a change of use?

Speaker 0 22:37 🎥

I believe it was. And I think, really, the only other item that was It feels like we're approving the same thing. We've already approved. Yeah. I think this this this is really...... Take out the grand opening. That's right. The condition about the grand opening. That's the main reason for this updated resolution is just to talk about... Okay. Well, just something that people aren't aware of, so that's helpful. Yeah. Yeah. Okay. So because they're not having a grand opening, we're not having it. Okay. Okay.

Speaker 7 23:04 🎥

So... Yeah. So if you guys would go with them not having a grand opening plan, that's basically the only thing they haven't done at this point. Alright. Do we need to make a vote on that?

Speaker 0 23:12 🎥

Alright. So let's make a resolution that, we agree to the applicant not doing a grand opening as

Speaker 3 23:19 🎥

they've agreed to. Removing the mod... You're removing the condition.

Speaker 0 23:25 🎥

Resolution. Okay. Resolution to remove that. Alright. Jeff, you want a second, ma'am? Second. Alright. All in favor? Aye. Aye. Okay. Great. Thank you, guys. Thank you so much for your time. Thanks.

Speaker 4 23:36 🎥

Have a good evening. So

Speaker 0 23:48 🎥

our next item is a new business item, Joe Ross. Hopefully, I said that correctly. Rebel Studio Croton, 122 Grand Street. Change of use from retail store to art studio. Hello. Hi.

Speaker 10 24:05 🎥

Yes. You said my name correctly, Joe Hill.

Speaker 0 24:09 🎥

Alright. Why don't you just tell us about your project? And

Speaker 10 24:13 🎥

Okay. So we are an art studio. We're gonna offer classes to kids and adults. We're doing different art classes like painting, pottery, printmaking. So we're gonna be... We're we're doing daytime classes for adults and evening classes for adults that will have about eight people in them. And then we're doing after school classes around 03:30, so kids can walk there from school, and pickup is at five, and there's about eight kids in those classes as well. On the weekends, we are gonna do some drop in classes. Like, those... The ones that I just mentioned are, like, six week sessions mostly or four week sessions. And then, on the weekends, we'll do maybe a drop in class. Like, we'll have, we have one on the website right now for a felting class, and that's gonna be a two hour class on a Saturday from one to three. So we'll have, things like that. So we, you know, we could potentially What's felting? Sorry. Felting. It's like wool,

tempering wool to kind of mesh it together. We're doing a soap felting class, and then you you design a design around the soap, and it kinda like gets tight around the soap and you can actually like rub yourself in it. It's

Speaker 3 25:34 🎥

like... Sounds very cool. You have a fedora, that's how you're like a wolf.

Speaker 10 25:40 🎥

Oh, okay. There's lots of kinds of felting, so this is just one.

Speaker 4 25:45 🎥

But Super fun. Yeah. Super fun. Pottery wheels will you have?

Speaker 10 25:50 🎥

We are not having wheels. So we're gonna be more simple. We're gonna be a hand building pottery studio. So all of our classes right now for clay are hand building, and we do have a kiln in the back. And, yeah.

Speaker 4 26:06 🎥

And you're gonna have a one printmaking press?

Speaker 10 26:11 🎥

We are doing, like, small, like, lino cut things. We don't have a press right now. Right now, we just have an after school class for kids for printmaking. We might do, like, you know, a weekend workshop where kids could come with their parents and do, like, card making or something for the holidays. Like,

Speaker 4 26:30 🎥

yeah. And is there... I'm asking for personal curiosity.

Speaker 10 26:34 🎥

Is there is there no room for a a pottery wheel? Is that why you're not No. Actually, there is. Like, once I got in the space and I put my tables in, I was like, oh, there's, like, room for another table and there's some space over when you walk into the left. There could be some wheels there. I kinda wanted to keep it... Because I wanted to keep the space more dynamic cause I wanna do painting. I wanna do a drawing night once a month. That's on the plan too. You know, different things. So if we have all these wheels and and the clay is taking up so much space, it's kinda hard to do other stuff. Gotcha. It gives you more flexibility. Yeah. And and right now, I have a lot of local artists that, you know, are gonna be, like, doing a class, here and there, like a drop in class, and that's kinda what I want. I wanna, like, get the community involved and

Speaker 4 27:26 🎥

Right. Yeah. Maybe someday down the road. Someday. Okay. Fair enough. Yeah. Thank you. Mhmm.

Speaker 5 27:34 🎥

So I saw some, postings on, I think maybe Croton community. You've opened already? Or Yes. Okay. And there was a... I don't know. I mean, I've...

Speaker 7 27:48 🎥

Technically, I guess it would be a violation. Oh. But, you know, if you give them the approval tonight

Speaker 0 27:56 🎥

It won't get a violation. Won't get a violation.

Speaker 10 27:59 🎥

Kind of an I wasn't aware that that would be a violation. Sorry.

Speaker 7 28:04 🎥

I'm sure you... I'd I'd take your word for that. Okay. This... They they were supposed to probably get this approval first. Definitely.

Speaker 5 28:13 🎥

Yeah. It was on our agenda last meeting. Yes. We had your application before us at our last meeting.

Speaker 10 28:21 🎥

I know. I am sorry. I That's okay. We're not get here. Yeah.

Speaker 4 28:27 🎥

Question, is there... And I don't know anything about it, but you you said you have a kiln, which is great. Yes. Are there any safety considerations that that are associated with the proper ventilation for

Speaker 10 28:39 🎥

diagrams of that. So that's been set up now. And, like, I had an electrician set up the proper voltage and amp, for the plug. It's a two forty volt plug, kind of like a dryer, and it takes 50 amps. And our whole, like, electric panel is a 100, so it can handle the amps.

Speaker 7 29:04 🎥

So I think we're set up on that. So no fire safety inspection required? We were gonna be asking for, like, an electrical certificate at at... After this, for sure. Okay. Regards to that. So they have... Whoever installed that would have to get a third party electrician to inspect that. So Okay. Just don't use that until that's done.

Speaker 10 29:22 🎥

Okay. Got it. Yeah.

Speaker 7 29:25 🎥

That was, yeah, that was part of the reservoir. High temperature. So Yeah. Yeah. Just to make sure that Yeah. We just wanna sure that all the specs are being adhered to and that the electrical is definitely checked. So we try to do it as fast as possible. Mhmm.

Speaker 6 29:39 🎥

But just try to hold off on using that for now. Is it hot on the outside to... Like, with the kids in classes and stuff? Is there a... Is it blocked off?

Speaker 10 29:49 🎥

It is in, like, a back room. So they're not wandering around? They're not wandering around back there. Yeah.

Speaker 3 29:56 🎥

And what what days,

Speaker 10 29:59 🎥

hours... Do you have set days right now? Or I don't have set days right now. Right now, we're just open during class time. So, you know, there's a adult class, and 12:30 to 02:30. So that's... It's open during that time. And then there's after school classes from 03:30 to five on Wednesday, Thursday, Friday. So those are our times right now. And then Wednesday evening, seven to nine.

Speaker 3 30:29 🎥

Oh, hopefully, you'll have to get, more days of the week.

Speaker 10 30:33 🎥

Yes. We... Yes.

Speaker 3 30:36 🎥

Fill up your schedule.

Speaker 0 30:39 🎥

Make some money. Exactly.

Speaker 10 30:41 🎥

We're adding a painting class also starting November 17 on Tuesday night. So, yes, it it... We're adding more classes. Kind of whatever,

Speaker 0 30:51 🎥

the community kind of asked for and what you feel like you have expertise in to be able to teach And Yeah. That's great. Sounds like a really nice thing.

Speaker 3 31:03 🎥

Could you explain to me where is 120?

Speaker 10 31:08 🎥

Where's 122 Grand Street? Yes. It's the old Upper Village Blooms location. The florist shop.

Speaker 7 31:16 🎥

What's that? Take a look at the screen. It's right Well, that's like the dummy light right here, and then it's right here on the corner.

Speaker 10 31:23 🎥

It's right next to 10520.

Speaker 6 31:25 🎥

Yeah. Yeah. The 20520 in that Thank you. Ballet studio.

Speaker 7 31:32 🎥

Do we need to approve the sign too? What's that? Do we need to do the sign as well? So I'll just briefly mention that too. So two points. I didn't ask for a traffic study. You guys are welcome to ask that if you feel that's necessary. And then number two, she provided the sign. It's a window sign. Complies with the code. So we gave in our resolution. We offered either you could approve the sign conditionally on the VB not having a problem with it, or else they'd have to come back here to get the official sign approval.

Speaker 4 32:03 🎥

I have a question because this would help the applicant. So we have one in effect. It's this... What I call a stencil sign on the window, which I'm assuming, you know, fits the parameters of how much... How many feet they're allowed to take up. But aren't they also entitled to a sign above where the brickwork is above the window? They are, but I don't think they proposed that at this time. Okay. So I just wanna let the applicant know that as your business grows and you can afford more promotion and branding, you may wanna consider putting a sign up over the brickwork because I think this is a great thing for Croton. I'm sure everybody agrees.

Is normal... Normally part of his protocol. Mhmm. That's my only hesitation in including it in the resolution.

Speaker 0 34:22 🎥

I would just... I was just referring back to Vinny's Sure. Memo, which basically

Speaker 4 34:28 🎥

brought up the kill It's it's up to you as chair. I'm just And said that,

Speaker 0 34:33 🎥

you know, that the clearance is that they basically demonstrate that they're they're require... They're they're compliant with the code and the manufacturer specifications. Yeah. Right here. So I I I do think it's appropriate Fine. To have that That's fine. Included.

Speaker 10 34:51 🎥

I have a question. Yep. What's that? What's that? If I get the certificate from an electrician... A licensed electrician Mhmm. Can I, like, bring it here in the next few days and get it approved and then use the kiln? Reach out to you tomorrow

Speaker 7 35:06 🎥

Okay. And we'll discuss it. But it's probably gonna have to be a permit for the kiln itself. I need to see the specs, clearances, and Oh. Things of that nature. And then Okay. As well as the electrical certificate. But I'll call you tomorrow and try to make that as easy of a process as possible.

Speaker 10 35:22 🎥

Okay. So then, we would have to wait until the next one of these meetings to get it? No. We're gonna approve it subject to

Speaker 0 35:31 🎥

the engineer's satisfaction.

Speaker 4 35:34 🎥

Okay. Mhmm. Cool. Thank you. Yep. So my motion, the number two for what he said plus the engineer's requirement for film approval. That's my motion. Great. $122.

Speaker 0 35:45 🎥

Okay.

Speaker 5 35:46 🎥

Second. Second.

Speaker 0 35:47 🎥

Alright. Quit. All in favor? Aye. Aye. Alright. Very good luck to you. Alright. Thank you so much. I'll give you a call tomorrow. Okay. Great. Alright.

So the next item on the agenda, Megan Willeman, 8 Daily Drive application for accessory dwelling unit. Hello. Hello Megan. Hello. Are you here on your own? Yes. My brother couldn't make it. The contractor cannot make it tonight. Okay. Okay. So why don't you tell us about your project?

Speaker 1 36:27 🎥

So we're building a one bedroom, 80 unit above our existing garage and adding a staircase on the outer thing, and it's just going to be... I think it's less than... I think it's 350, 400 square feet. I don't have my things with me.

Speaker 0 36:48 🎥

And you presented plans for Yes. The Yep. Addition. And we got a memo from the engineering department which states that the subject property is located within R R A 25 and exist as a single family residence. Mhmm. And then it talks about creation of an accessory dwelling unit in the form of accessory apartment, which requires planning board approval, which we're here for. And the applicant has submitted the necessary plans and photos and also provided proof of Westchester County Department of Health approval since the property is served by a septic system in accordance with village code. And then there was... The applicant has provided all other information in accordance with village code 23 Dash 41 accessory apartments, and the application in the opinion of the engineer is zoning compliant. So that's all good stuff. That's good stuff. And then was a late submission regarding the second paragraph here. A dry stream, which is class... Which may be classified as a wetland under village code is located on the east side of the property. And then the property... The proposed work falls within the associated 150 foot wetland buffer of the Indian Brook Croton Gorge Intermunicipal Watershed Protection Overlay District. Accordingly, a wetlands activity permit is required, and the village engineer is the approving authority as mentioned above. So we don't need to

Speaker 7 38:42 🎥

Yeah. No. I had to provide land approval. That's under your purview. That's correct. Yeah. If you go to that section of the code, it says it's my authority for that, but I still had them give us some contours and show the area where the watercourse is, which I have on the screen right now.

Speaker 0 38:59 🎥

And you... And we have a copy in front of us too. So it appears to be... It's about as far away from that watercourse as one could be. Mhmm. It'd still be Implied with the property. On the property. Yeah. Yeah. Or on the house. Yeah.

Speaker 4 39:21 🎥

So I know that water course does overflow sometimes, during the rainier parts of this year. Don't think we had to be concerned about that. It's No. They corrected that. It hasn't done that in a long time. It it didn't Well, water comes over the road there that leads... You know, the driveway that goes past your house?

Speaker 1 39:44 🎥

Yeah. On the last house for Number 4, the house the house next to me is Number 4. Yes. They they corrected that. They put a big pipe underneath the road, and they put it underneath.

Speaker 6 39:55 🎥

So underneath underneath that one part, the stream. Yeah. But the footprint of the house isn't changing. Right? No. No.

Speaker 7 40:02 🎥

If

Speaker 0 40:03 🎥

anything, that would be affecting a part of the house that we're not We're not even changing. Changing. No. Right. So I I I would consider that a nonissue, but that's, I think, up to you to your Yeah. I I don't see that as too much of an issue. And one of the things that with accessory dwelling units is is that the entrance should be away from the the road and and and privately access private drive. Yeah. And and this, I think, achieves that, The design does. So with the stair on the side and sort of private entrance over there for the for the unit, and the layout looks like works to me. I don't have any I don't have any real issues with the application at all. I don't know if anybody else has comment.

Speaker 3 41:06 🎥

Gonna just ask a question. Sure. I was driving up and down Daly. Do you have a mailbox for Number 8?

Speaker 1 41:14 🎥

Yes. So what we... So... 88 Daly... I mean, Daly Drive has the cul de sac on the top. So when you... There's a bunch of mailboxes, four of them, that when you turn down our little easement, there's the mailboxes right before you turn. So it's right on the right side. So you you hit number 10, and then there's four number six? It it it goes weird. It goes 10?

Speaker 3 41:36 🎥

No. It goes very around three or four times. Well, no. Because you see this little thing. So this this would be six. Right. Then I'm eight,

Speaker 1 41:44 🎥

and then 10 goes there. So this piece of... This is Daly Drive. So the... I actually own that. So I should put gates there to say go around back. Okay. This would be the entrance because that... This hit... Hits Daley Drive, this part. We are a shared drive. Nobody can find me. Nobody can find me. Comes like this. Yeah. Nobody can find me. So Yeah. I had a few people walking up and down the street looking at me when I had my camera out. Oh, no. Yeah.

Speaker 3 42:09 🎥

We're little Next time I could tell them, I I know what I'm doing. We're a tight little we're a tight little neighborhood.

Speaker 1 42:14 🎥

Okay.

Speaker 3 42:15 🎥

That's good, though. That's very good. Yeah. Yeah. Yeah.

Speaker 1 42:17 🎥

That's good. I'm glad they were out there looking for it. Yeah. But you have to go down the side. People... Oh, people can't... Because it's strange. It's 841216. Because after me is 4. So good luck finding 4. I... I'm I'm giving up.

Speaker 3 42:33 🎥

Beeps you, sir. On the road down there and look up. Alright.

Speaker 5 42:39 🎥

I did have a question for Vince. So Vince on the 2nd Floor, is where the apartment's gonna be. The way the ceiling is sloped, one point it's got a clearance of six six, six foot six inches. It just seems kinda tight, but I... I'm just curious if that is I haven't looked into the... That detail yet,

Speaker 7 43:03 🎥

but there are ceiling height requirements that they have to abide by by building code. Their slope ceiling requirements. Generally speaking, six foot six is... If it was flat ceiling six foot six, they would need to get a state variance keep it at that unless it was in a basement.

Speaker 4 43:27 🎥

But I'm trying to see where exactly it shows that six foot six. You have a The six six is right in the corner of the room. It it immediately goes up the roofline above it.

Speaker 5 43:37 🎥

It's a nine. A nine. Draw an a nine page. Yeah.

Speaker 0 43:41 🎥

I think... I mean, my rec... My my recollection of that, it would be if if that up until, I think, seven feet, it wouldn't be considered, quote, unquote, habitable. Something of that nature. Doesn't mean that... Doesn't mean it can't be there.

Speaker 7 43:59 🎥

It just wouldn't count towards the

Speaker 0 44:02 🎥

habitable area habitable area. So Yes. Since we're well within Yeah. The allowable habitable area, it shouldn't really have an effect. But

Speaker 4 44:12 🎥

But even where they showed little stick figure standing above the stick figure's head, it's probably already six ten there. Exactly. Yeah. And quickly rising. Mhmm. In the bedroom Yeah. It's at... It's eight feet in the bedroom. Yeah. Right. Of course, these plants.

Speaker 5 44:25 🎥

Yep. You know? Question, though?

Speaker 7 44:28 🎥

But, yeah, I don't I don't think it's gonna really affect, like, this stage of the approval or anything much because they're below the the allowable square footage as it is with that included. Okay.

Speaker 5 44:43 🎥

So just a couple more things. No trees will be cut down as part of this?

Speaker 1 44:47 🎥

No, no trees and we're not gonna have any heavy equipment coming in because they're gonna do the poles by hand too, like where the staircase is. Okay. So no equipment. Right and then

Speaker 5 44:57 🎥

there's no net increase in the number of bedrooms being created as a result of this because you're gonna change one

Speaker 1 45:04 🎥

One room to an office. Right, so one of my kids I'm kicking out, yeah. Right. Gonna happen, but we'll see. Yes, we're gonna make one into an office. Right, so the reason I asked about that is because it's septic, right, yeah.

Speaker 5 45:18 🎥

You know, we can impose that recreation fee or not for 80 use. And in this case there's no net increase in bedrooms, so my recommendation is to not include, not require the

Speaker 0 45:35 🎥

recreation fee for the CDU. Thank

Speaker 1 45:38 🎥

you.

Speaker 0 46:02 🎥

Alright. So we do have a draft resolution in front of us, which lists out the plans reviewed and the be approved and that there was some colors and materials presented. I don't know that we need to have any other conditions on that That no work can commence without a building permit and that, there's some conditions to be met for a certificate of occupancy as built and some issues with regard to approval of the village engineer obtaining for connections to utilities.

Speaker 7 46:55 🎥

Rob, just one point that we wanna just check before we go through this. Yeah. I think the board of trustees might have changed the rec fee. I'm not sure if you do still have the discretion. So maybe in the resolution, could say, like, so long as we have the discretion, and we can check that on the back end. We do have the discretion. Oh, okay. It's in the local law. Okay. Alright. Nothing

Speaker 5 47:16 🎥

has changed. No. Alright. Alright. Fair enough.

Speaker 4 47:19 🎥

Do we have to put... Since technically it's a separate residence. Right? Does this need to be from eight a and 8 B or some way for the emergency services and then the

Speaker 7 47:33 🎥

There is stuff in pool. Person to be able to know where things go. Yeah. We've been going for the accessory cottages, giving those dash a's, basically. Okay. It would need a separate mailbox as well. Yes. Correct. And then similar for the accessory apartments, they should also have their own separate address as well. Right. That should be established. Good. Does that... Or do we have to add that to the resolution? I don't... Does the resolution... I think it talks about just the general

Speaker 4 48:02 🎥

code section, which that would fall It's in there. It's numbers... You have it, actually. Thank you, Jeff. Yeah. Okay.

Speaker 0 48:08 🎥

Number six. Thanks. And then there are a couple of conditions just to... Which are basically just code conditions. One is that upon a change of ownership, should the new owner decide desire to continue accessory apartment use, the new owner shall notify the building department confirming the new owner will reside on the premises as required, and they are aware that the laws require... Regarding the accessory apartment will remain in compliance, and such notice shall be provided within ninety days of change of ownership. Failure to, timely file will result in revocation of the accessory apartment approval, and the new owner will have to make a new application. So were you to, you know, sell the house, you need to make sure that that is

Speaker 1 49:00 🎥

addressed. Okay.

Speaker 0 49:02 🎥

And then unless a building permit is issued and work is commenced and diligently prosecuted within three years of the date of the resolution, then all the permits become null and void. So there's those two things are just FYI, make sure Okay. Make sure I'm aware of that. Okay. That you know about those.

Speaker 1 49:22 🎥

Thank you.

Speaker 5 49:25 🎥

Alright.

Speaker 3 49:33 🎥

You want The recreation.

Speaker 5 49:37 🎥

You're asking me where it is in the color? Yeah. I mean I don't know where it is. 230 dash 41. So I can make a motion. Yes. So approving the the draft... The resolution before us for an accessory apartment for Megan Willeman, 8 Daily Drive with the additional condition that the planning board waives a recreation fee. That's it.

Speaker 6 50:09 🎥

Is it Megan Croton? Should it be Croton? No, I know.

Speaker 1 50:13 🎥

I'm not the worst yet. Getting there. Oh, I'm

Speaker 6 50:17 🎥

sorry. Oh, I'm sorry. I was just looking at the application. I wanted to make sure we were using your correct last name and then... No. We are. My brother is Croton and I'm... Okay. I just wasn't sure. No. Thank you.

Speaker 1 50:28 🎥

Thank you. Thanks, Jen. Wanted to... Thank you. Alright. Megan, we're done. Thank you. Thank you. We have a good one. Oh, we didn't vote yet.

Speaker 0 50:36 🎥

Yet.

Speaker 5 50:37 🎥

Give me a second. I'll

Speaker 0 50:39 🎥

second. Okay.

Speaker 1 50:41 🎥

Let's all... I'll raise my hand.

Speaker 0 50:44 🎥

All those in favor? All those in favor? Aye. Aye. Alright. Congratulations.

Speaker 1 50:48 🎥

Thank you. Thank you, guys. Thanks. Alright.

Speaker 0 50:57 🎥

That's okay. I can't even what I did on that. Oh, there it is. That one doesn't work. That's why I got left up here. Alright. And our last piece of new business is Lillian Ross, 110 Maple Street, change of use application from one family to two family home. Hi. Hi. So, please tell us about your project.

Speaker 9 51:32 🎥

So, I purchased the house in 2006 as a two family house. It was marked, sold to me that way. When we did the title search, all those things, everything came through as a two family. I'm now selling the house. And when when we, the title company did the search... Was it mic a little closer Yep. It's hard to hear you. When the title company did the search and then I think the village... And Vincent might be able to explain the process a little more than I can because I'm not as as clear on that. But there was a discrepancy. We have we have paperwork that says it's a two family. We have paper... Paperwork that says it's a single family. My understanding is that the village needs certain updates in their files to substantiate the two family status and to make it formally legal as a two family. So that's the hope. I have wonderful people who came in and helped to do drawings, and we had the plumbing inspection and the electrical work that now needs the secondary inspection, but that should happen in the next day or so. So, but I don't think that's pertinent. I think right now we're just talking about the plans, correct? It's all in the soup, so. Yeah, so it's been a two, the apartment has been there since I purchased the house. The apartment's been there since 1995. I purchased the house in 2006.

Speaker 0 52:47 🎥

Okay. So we got a memo from the engineering, and it says, a review of the property file revealed discrepancies between the building department and assessor's records. However, the records indicate that no permits were issued for the conversion of the attached garage to habitable living space for the subsequent conversion of the single family dwelling to a two family dwelling. So, accordingly, the applicant is before the planning board seeking approval to legalize the existing conditions and establish the property as a lawful two family dwelling pursuant to the code.

Speaker 5 53:25 🎥

So that's

Speaker 7 53:26 🎥

pretty clear. So I think that what probably happened was the original plans must have been lost or something. So they were writing pre date letters and stuff saying this is the two family legally existing. And so then they must have found the actual original plans as... In a box or something downstairs, and here they are. And you could see that they show a garage there, and that's not where the apartment is. So with the new information, we basically said you gotta legalize this since we know that it wasn't a two family originally as these letters had been saying in error. So now she's gotten the appropriate plans and whatnot to go through the legalization process of that area. So as you see, they had this garage there. Yeah. We have... We know that it's existed like that. Yeah. So we had to just make sure that it got legalized, basically. Okay. You've done a walk through of some kind. Yeah. Me and Ron took a look over there Right. Three weeks ago or something like that. Good. So you're satisfied garage.

Speaker 0 54:25 🎥

Yeah. It's not garage no more. Understood. But your department satisfied that it will meet the requirements for two family homes and Yes. That Mhmm. Us doing this action will just do what should have been done at some point? Correct. Yeah. Okay. Any other thoughts, questions, guys?

Speaker 5 54:51 🎥

Okay. So there was a 1995 survey, Vince?

Speaker 7 54:55 🎥

A 1995 survey. Is that here somewhere? Did I rep... Where did I... Did I represent that in my memo? Yeah. It was attached.

Speaker 5 55:05 🎥

I think it sets this drawing.

Speaker 6 55:09 🎥

It's this one.

Speaker 7 55:27 🎥

Yes. So that's that's a survey, 1995. I don't know how relevant this is. I mean, it doesn't it doesn't say garage. I'm not sure exactly what. It says residence. Yeah. It just says residence. It doesn't say two two family residents or whatnot, so maybe it got converted right after this survey was done, perhaps.

Speaker 0 55:53 🎥

Okay. Okay.

Speaker 9 56:08 🎥

So in... I guess it was a two family in September 1995. According to the village records. Interesting. And I'm I mean, these are all the records I got when I purchased the house in 2006, so I wish I had more information from prior to that. But I I I have...... Thing. Yeah. Absolutely.

Speaker 4 56:35 🎥

Right. You got a whole team behind you too. I do, and they're wonderful. Well, it's not a two family home district. Better than Suzanne.

Speaker 9 56:46 🎥

No. You can't.

Speaker 4 56:48 🎥

It's in a two family home district, so it makes perfect sense. Actually, it would be an anomaly if it was a single family home there because they're all surrounded by two family homes. Bless.

Speaker 0 57:04 🎥

These old blueprints are cool. Yeah.

Speaker 3 57:10 🎥

This is my easiesTeatown boy. Excellent.

Speaker 10 57:14 🎥

I tried.

Speaker 0 57:25 🎥

Motion?

Speaker 4 57:26 🎥

Yeah. I don't know that we have any additional conditions. I don't think we do except it's already built into the draft resolution.

Speaker 0 57:32 🎥

Great. So if you would like to proceed with the Motion

Speaker 4 57:36 🎥

to approve draft resolution for 110 Maple Street with no additional conditions beyond what's in the draft resolution.

Speaker 0 57:48 🎥

Thanks.

Speaker 7 57:51 🎥

Do you a second? John, second? Okay. All in favor? Aye. Aye. Alright. Thank you, guys. Thank you so much. Awesome. Thank you. We'll follow-up tomorrow with you too. Me and me and Ron will call you tomorrow and follow-up. Excellent. Thank you. Thank you. Have a great evening.

It's always when you go to sell something that it becomes like a The tricky issue. Box appeared. It was in the time he bought it. I had a shed that I didn't know about. Pleasure to meet you. Pleasure to meet you, miss Rowan. Look forward to him while we're with you on the feud. Pleasure to meet you. Take care. Alright.

Speaker 4 58:32 🎥

I think... Alright. Before before we get to the minutes, I rarely do this, but Yep. In my role as liaison to the CAC, I just wanna let everybody know that as it turns out, now I learned we're not meeting on November 10. But the CAC is hosting a leaf blower forum by Zoom on November 10 beginning at 06:30. You know, it's sort of a hot topic discussion in the village. I just wanna make sure my colleagues all know that this is occurring. If you wanna join, there'll be they'll put out Zoom information if you... For you to be able to jump on that and monitor it and provide any input you wanna do. And again, that's November 10 at 06:30. So I filled my role as liaison.

Speaker 6 59:16 🎥

Thank you. That's it. What is CAC?

Speaker 4 59:19 🎥

The conservation advisory committee. Thank you. Okay. Thank you. It's actually the Croton Conservation Advisory Committee. Technically, it's CCAC. Okay. Okay.

Speaker 0 59:31 🎥

It's not Coco. Yeah.

Speaker 4 59:32 🎥

It's not Coco. That's the... I think they use a k if I'm not mistaken. But yeah.

Speaker 6 59:39 🎥

Croton Conservation advisory. When they named that, I was like, are you kidding me? That's a mouthful. I thought it was a mistake. The first one we moved here, was like, what is this? Do they not know?

Speaker 0 59:49 🎥

Right. Croton something on the comedic arts. Yeah. Alright. Minutes of our October 13 meeting.

Speaker 4 60:02 🎥

I reviewed it and had no changes. Karen did a marvelous job. Excellent. I'll second that. I agree.

Speaker 0 60:14 🎥

Yeah. It looks good. Alright. Motion to accept the minutes as presented. So moved. Aye. Second. Aye. Alright. Thank you everybody.

Speaker 6 60:28 🎥

Thank you very much.

Speaker 0 60:29 🎥

We managed to move that... Through that pretty nicely.

Speaker 4 60:32 🎥

And we're not meeting on the tenth, but the next meeting is in the twenty fourth. Hey,. I will I won't be here on twenty fourth. Either, so

Speaker 0 60:45 🎥

I don't know if we're gonna have enough to have a meeting. I don't believe I'll be here. No. Because What? I'll be in

Speaker 4 60:52 🎥

week. Thanksgiving. Tuesday or Thanksgiving week. So Yeah. So with you guys to determine what you wanna do. Sounds good. I'll see. I'll I'll think about that. Probably gonna have to cancel.

Speaker 7 61:02 🎥

We'll see. We'll see if anything even comes in. But Okay. That might. We'll be in touch on that. We have some time to try to Is the temp definitely canceled, if something comes in, would it come It's canceled. And nothing came in? Oh, yeah. Okay. So

Speaker 0 61:17 🎥

So I I brought the...

Speaker 5 61:19 🎥

Wait. So we

Speaker 6 61:21 🎥

here. We can We're done. Turn off our meeting. We can have a If we're still talking, though, shouldn't we have it? No.
