The state Board of Elections’ public filing history contains entries not mentioned in the Croton Chronicle’s October 28 report on judicial candidate Ali Jaffery. Under each of the Croton Democratic Committee’s two disputed pre-primary reporting periods, the portal lists a Notice of Non-Participation entry dated October 21, 2026. The entries cover the 32-day and 11-day periods before the June 23 primary. BOE public reporting portal, filer 13974 The portal also lists two amended-report entries dated October 26 for the committee’s 2025 32-day pre-general report, which the Chronicle identified as deficient. Those entries were not discussed in the article. Their displayed dates are two days before its publication. Croton News examined the portal on October 29. This review could not independently establish when the entries were submitted, entered into the system or first made public. It covered the filing-history entries, not the original notices or the contents of the amended reports. The entries do not establish that BOE accepted the filings as sufficient or approved Jaffery’s resignation. The non-participation entries matter because BOE allows party and certain other committees to notify it that they will not support or oppose candidates in a particular election through contributions or direct expenditures. BOE says it then does not expect the committee’s financial disclosure reports for that election. That procedure does not remove the separate obligation to file periodic reports. This review did not independently verify the committee’s claimed non-participation. BOE filing guidance Michael Balter’s report cited September 14 BOE correspondence rejecting Jaffery’s resignation and identifying two missing 2026 pre-primary reports and a deficient 2025 pre-general report. It questioned why those problems remained unresolved and said Jaffery apparently had violated election law throughout his judicial campaign. The Chronicle’s October 28 report The Chronicle also published Jaffery’s explanation that he had resigned internally and was working with BOE to resolve paperwork problems and register a successor. It included committee vice-chair Andy Levitt’s account that a replacement had been elected and BOE required follow-up from Jaffery. The additional portal entries are consistent with efforts to address filings; they do not establish that the problems were resolved. Other entries warrant attention. The portal labels the original 2025 32-day pre-general entry November 9, 2025, and the original July 2026 periodic entry August 8, 2026. Those displayed dates fall after the October 3, 2025, and July 15, 2026, deadlines in BOE’s calendars. This review does not establish whether earlier submissions or rejected filings existed. 2025 filing calendar, 2026 filing calendar BOE’s public registry still named Jaffery as the committee’s treasurer when checked October 29. Judicial ethics guidance prohibits judicial candidates from holding party officer positions, including treasurer. Judicial ethics Opinion 24-131 The resignation rules require care. For a treasurer whose committee has unspent funds or unpaid liabilities, regulation 6200.7(a) requires written resignation delivered to the chair and filing officer and specifies an effective date five days after delivery to the filing officer, unless a later date is selected. It separately requires a financial report after that effective date. BOE’s published guidance says a treasurer is not officially resigned until receiving its successful-resignation letter. Its guidance also requires all previously required reports to have been filed. This review does not resolve how those provisions apply to Jaffery. Resignation regulation, BOE resignation guidance Croton News has not reviewed his original resignation submission, proof of delivery or complete subsequent BOE correspondence. The additional portal entries provide context absent from the Chronicle’s account, but do not settle Jaffery’s effective resignation date or whether he held party office during his campaign.
