On motion of TRUSTEE -, seconded by TRUSTEE -, the following resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New York with the following vote: Resolution #134-2024 WHEREAS, the Maple Commons development has been constructed at 43-45 Maple Street; and WHEREAS, as part of the construction project, a new water main was required to be installed on the property; and WHEREAS, the Village has taken ownership of the water main in accordance with Westchester County Dept. of Health guidelines; and WHEREAS, an Easement Agreement has been drafted to grant an easement to the Village of Croton-on-Hudson for the installation, replacement, maintenance, operation, and repair of the ductile iron water main and associated appurtenances within the designated Easement Area, as more particularly described in Schedule B attached to the Agreement; and WHEREAS, the terms of the Agreement require the Village of Croton-on-Hudson to maintain the Easement Area and restore any surface disturbances caused by maintenance activities, NOW THEREFORE BE IT RESOLVED: that the Village Manager is hereby authorized to execute the Easement Agreement with 41-51 Maple Housing Development Fund Corporation and 41-51 Maple LLC, subject to the final approval of the Village Attorney.
