Croton-on-Hudson, NY 10520-2501 Secretary KAREN STAPLETON TO: Mayor Brian Pugh and the Village Board of Trustees FROM: Chairman Simon, Waterfront Advisory Committee: Referral from Village Board for a Local Waterfront Revitalization Program (LWRP) Consistency review for Westchester County Parks Department Croton Point Park Bulkhead Wall Coping Replacement Project (NYS Project 2023-0878). DATE: January 4th, 2024 On January 3rd, 2024, the Waterfront Advisory Committee (WAC) reviewed for consistency with the Village’s Local Waterfront Revitalization Program (LWRP) the referral listed above. Based on the Committee’s review of the 44 LWRP policies, the Waterfront Advisory Committee made a recommendation of consistency with the LWRP. The committee reviewed the 44 LWRP policies and also the Federal Consistency Assessment Form completed by Joseph DeSanctis of WSP USA, Inc. and were comfortable accepting their assessment of the following relevant policies: POLICY 7: Significant coastal fish and wildlife habitats will be protedted, preserved, and, where practical, restored so as to maintain their viability as habitats. The repair project does not require any tree cutting or any in-water work. Construction will be performed within the September 1* to October 31° window to not interfere with any potential wildlife habitat. Once completed, the repairs will once again allow the public to safely view these areas from a distance. NYSDEC has sent a notice of no Jurisdiction as it was determined that all work appears to be above the mean high-water level. Any necessary measures requested by the State Agency regarding fish and/or wildlife habitat in the area will be adequately incorporated into the project requirements. POLICY 19: Protect, maintain, and increase the level and types of access to public water- related recreation resources and facilites so that these resources and facilities may be fully utilized in accordance with reasonably anticipated public recreation needs and the protection of historic and natural resources. In providing such access, priority will be given to public beaches, boating facilites, fishing areas and waterfront parks. This project will restore the pre-storm (Hurracaine Ida) access to the County Park. These reapirs will help to also preserve the park for future years to come. POLICY 20: Access to the publicly-owned foreshore and to lands immediately adjacent to the foreshore or the water’s edge that are publicly-owned shall be provided and it should be provided in a manner compatible with adjoining uses. POLICY 23: Protect, enhance and restore structures, districts, areas of sites that are of significance in the history, architecture, archaeology or culture of the state, its communities or the nation. The main purpose of this project is to restore existing structures that are an integral part of the Bulkhead wall along Croton Point Park. Repair will replace damaged elements and reinstate the sturctures to their original function and appearance. Access to other areas of the historic park will once again be restored when the repairs are complete.
