To: From: Date: April 15, 2025 Re: Local Law Intro 6 Local Law Introductory 6 of 2025 has been drafted to clean up certain provisions in Chapter 125, Fire Prevention, and Chapter 197, Streets and Sidewalks, of the Village Code. Chapter 125 was last updated in the 1980s and is being updated to reflect the types of structures that the Fire Inspector is required to inspect under state law. Additionally, a provision is being added to allow the Board to set the fee for such inspection(s) by resolution and to allow such fee to be re-levied onto a property’s tax bill if it is past due. Finally, the code authorizes the Fire Chief to establish fire zones prohibiting standing/parking in the Village and it is proposed that the Chief undertake that authority in consultation with the Village Manager. The updates for Chapter 197 involve updating the provisions related to appealing a bill received for the cleaning or repairing of a sidewalk. This language has already been updated in other areas of the Village Code in recent years such as Alarms and Snow Removal. It is also proposed that this section of the code be updated to allow the Village Engineer to permit the placement of a dumpster or storage unit on a street, lane or alley, sidewalk, or other public grounds, along with authorizing the Board to set a fee for such placement and allowing the Village Engineer to determine the best manner to keep the area safe for pedestrians and vehicles at night.
