LOCAL LAW INTRODUCTORY NO. 9 OF 2025 A LOCAL LAW TO AMEND CHAPTER 122, FEES, CHAPTER 215, VEHICLE & TRAFFIC, AND CHAPTER 225, WATERFRONT REVITALIZATION, TO UPDATE VARIOUS PROVISIONS Be it enacted by the Board of Trustees of the Village of Croton-on-Hudson as follows (underlined text shall reference additions and stricken text shall reference deletions): Section One. Section 122-3 of the Code of the Village of Croton-on-Hudson is hereby amended to read as follows: § 122-3. Definitions. As used in this chapter, the following words shall have the following meanings: BOARD — The Board of Trustees of the Village of Croton-on-Hudson. FEE — Any lawful charge pursuant to the General Code of the Village of Croton-on-Hudson, including but not limited to all admission charges, membership fees, dues, permit and special permit fees, license fees or any charge or disbursement required by a duly constituted board, commission or committee of the Village of Croton-on-Hudson. PENALTY — Any monetary assessment imposed as a result of a failure to comply with any local law, rule or regulation within the jurisdiction of the Village of Croton-on-Hudson. Section Two. Section 215-45 of the Code of the Village of Croton-on-Hudson is hereby amended to read as follows: § 215-45. Penalties for offenses. Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first conviction thereof, be punished by a fine of not more than $150 $50 or by imprisonment for not more than 15 days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter, such person shall be punished by a fine of not more than $300 $100 or by imprisonment for not more than 45 days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after the first conviction, such person shall be punished by a fine of not more than $450 $250 or by imprisonment for not more than 90 days, or by both such fine and imprisonment. Section Three. Section 225-8 of the Code of the Village of Croton-on-Hudson is hereby added as follows: § 225-8. Penalties for offenses. A. A person who violates any of the provisions of or who fails to comply with any condition imposed by this chapter shall have committed a violation, subject to penalties as provided by § 1-12 of the Code of the Village of Croton-on-Hudson. punishable by a fine. For the purpose of conferring jurisdiction upon courts and judicial officers, each week of continuing violation shall constitute a separate additional violation. B. The Village Attorney is authorized and directed to institute any and all actions and proceedings necessary to enforce this chapter. Any civil penalty shall be in addition to and not in lieu of any criminal prosecution and penalty. Section Four. Severability If any section, subsection, clause, phrase or other portion of this Local Law is, for any reason, declared invalid, in whole or in part, by any court, agency, commission, legislative body or other authority of competent jurisdiction, such portion shall be deemed a separate, distinct and independent portion. Such declaration shall not affect the validity of the remaining portions hereof, which other portions shall continue in full force and effect. Section Five. Effective Date This local law shall take effect immediately upon filing in the office of the New York State Secretary of State in accordance with section 27 of the Municipal Home Rule Law.
