On motion of TRUSTEE --, seconded by TRUSTEE --, the following resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New York, with a - vote. Resolution #-2023 WHEREAS, the property owners of 101 Scenic Drive West have notified the Department of Public Works that there is a sinkhole forming on their property; and WHEREAS, upon further investigation, the Department of Public Works has determined that the area of concern is surrounding a manhole that is part of the Village drainage system running through the property; and WHEREAS, repair and maintenance of the stormwater system is the Village’s responsibility; and WHEREAS, each heavy rain storm contributes more to the deterioration of the system, and has the potential to create a very dangerous condition; and WHEREAS, due to the urgent nature of this repair, the Village would require the assistance of an outside contractor to perform this work; and WHEREAS, General Municipal Law Section 103(4) allows for the Board to let a contract without public bidding where necessary due to a public emergency arising out of an unforeseen occurrence or condition; and WHEREAS, Superintendent of Public Works Frank Balbi has received a proposal for the repair and restoration of the system from Green Mountain Pipeline Services of Bethel, VT in the amount of $79,670; and WHEREAS, Superintendent Balbi has estimated the cost of labor to excavate and repair the drainage manhole to be $10,330, NOW THEREFORE BE IT RESOLVED: that the Village Board hereby declares the formation of a sinkhole at 101 Scenic Drive West to be an emergency situation, and BE IT FURTHER RESOLVED: the Village Manager is authorized to accept the proposal from Green Mountain Pipeline Services of Bethel, VT in the not-to-exceed amount of $79,670, and BE IT FURTHER RESOLVED: that the Village Manager is authorized to proceed in the not-to-exceed amount of $10,330 for labor-related costs in this project, and BE IT FURTHER RESOLVED that the funding for such project is available in the following capital line: H5110.2010.24465.
