I. REPORT OVERVIEW
Tri-State Engineering, P.C., has performed a Phase I Environmental Site Assessment in general
conformance with the scope and limitations of the ASTM Practice E 1527-05 of 1300 Albany
Post Road, Croton-On-Hudson, New York, the subject property. Any exceptions to, or deletions
from, this practice are described in Section VII - Scope of Work and Approach, of this report.
This assessment has revealed no evidence of recognized environmental conditions in
connection with the subject property, except for the following:
1. A 1,000 gallon underground oil storage tank is located on the subject property for the heating
system of the Main House. The tank failed a tightness test on December 27, 2010. Further
investigations are required including isolating and re-testing the tank, or removal in
accordance with the NYSDEC and the WCDH Petroleum Bulk Storage Regulations.
Findings and items of interest that do not meet the requirements to be designated as a
Recognized Environmental Condition (REC):
2. A total of 18 sites were found in response to the ASTM guideline database requirements.
Based on our site inspection and the information as indicated herein, none of these sites
meet the requirements to be designated as a Recognized Environmental Condition.
3. A 275 gallon aboveground oil storage tank is located at the exterior of the Mobile Home
structure for the oil fired heating system. Periodic inspection of the tank by the home
owner and oil service company should be completed as part of routine maintenance.

4. The New York State Department of Environmental Conservation under Regulation 612.2
requires that the owner of any petroleum facility having a total storage capacity over 1,100
gallons must register said facility in accordance with their regulations. The referenced
property has two tanks with a total capacity of 1,275 gallons. Therefore, registration under
these guidelines is required.
5. Based on the age of the Main House, the acoustical ceiling tiles installed at the upper
floor may contain asbestos. Testing the material is recommended to determine asbestos
content. If material is found to contain asbestos, maintaining this material under an
operations and maintenance program is recommended.
6. Based on the age of the buildings, suspect non-friable asbestos containing material may
exist in some of the building materials (roofing, flooring, caulking, etc). This is a non-
scope related item and does not meet the requirements to be designated as a Recognized
Environmental Condition.
7. As a general rule, structures built before 1978 probably contain lead-based paint. The
Main House was constructed prior to 1978, and should be assumed to contain lead based
paint. This is a non-scope related item and does not meet the requirements to be
designated as a Recognized Environmental Condition.
8. The property has on-site septic system for the Main House. Septic must be maintained in
accordance with the requirements of the Westchester County Health Department and
local regulatory agency. Further investigations are required to determine if a separate
septic system has been installed for the Mobile Home.

9. Domestic water for the property is provided by an on-site well. Well water has been
tested (by others) in accordance with the requirements of the Westchester County
Department of Health. Results are included in the appendix of this report.
10. A 2nd well casing exists to the northwest of the Two Car Garage structure. Well casing is
open and should be sealed to protect groundwater from contamination.

III. SITE RECON N AISSAN CE
The property reconnaissance for the Phase I ESA consisted of visual observations of the property
and improvements, adjoining sites as viewed from the property, and the surrounding area based
on visual windshield observations. Unimproved portions of the property were observed along
the perimeter and in a general grid pattern in safely accessible areas. Building exteriors were
observed along the perimeter from the ground, unless described otherwise. Building interiors
were observed as they were made safely accessible, unless described otherwise.
The objective of this site inspection is to obtain information indicating the likelihood of
identifying recognized environmental conditions in connection with the subject property. The
site inspection was conducted on September 7, 2011.
1. Hazardous Material
Current owner/tenant of the property is not associated with hazardous materials. Common
household type hazardous materials exist on the property for maintenance/housekeeping
purposes. These materials are not of a significant environmental concern.
2. Storage Tanks
A 1,000 gallon underground oil storage tank is located on the subject property for the heating system
of the Main House. The tank was tested by American Test and Line Company on December 27,
2010, and failed. Results are included in the appendix of this report. Further investigations are
required and should include isolating and re-testing the tank, or removal in accordance with the
NYSDEC and the WCDH Petroleum Bulk Storage Regulations.

the Mobile Home. Periodic inspection of the tank by the owner and oil service company is
recommended as part of routine maintenance/housekeeping.
In accordance with the New York State Department of Environmental Conservation Regulation
612.2, the owner of any petroleum facilities having a total storage capacity over 1,100 gallons must
register said facilities in accordance with their regulations. The property has a total capacity of
1,275 gallons, therefore requires registration under said guidelines.
3. Asbestos
Based on the age of the Main House, the acoustical ceiling tiles installed at the upper floor may
contain asbestos. Testing material is recommended to determine asbestos content. If material is
found to contain asbestos, maintaining this material under an operations and maintenance
program is recommended.
Based on the age of the present building on site, non-friable ACM may exist in some of the
building materials (roofing, flooring, caulking, etc). Non-friable ACM is not of a major health
risk, however must be maintained: See Section VIII.1 for limitations regarding asbestos material
findings.
4. Lead Paint
As a general rule, structures built before 1978 probably contain lead-based paint. The Main
House was constructed prior to 1978, and is assumed to contain lead based paint. See Section
VIII.2 for limitations regarding LBP findings.

5. Poly Chlorinated Biphenyl (PCB's)
Possible sources of PCB’s evident at the time of the inspection included pole mounted electrical
transformers. Transformers in the area of the subject property were noted to be in good
condition with no signs of leakage.
6. Mold
No evidence of major mold growth was visible in these buildings. Mold growth can be hidden
within walls, ceilings, flooring, and/or behind interior finishes. Tri-State only inspected for
obvious and visible mold. See Section VIII.3 for limitations regarding mold findings.
7. Waste Pits, Ponds and Lagoons
A fresh water pond is located on the subject property. Two streams run through the property
from east to west.
TSE did not observe evidence of waste pits or lagoons on the property.
8. Sumps
TSE did not observe evidence of sumps on the property.
9. Septic Systems
The property has an on-site septic system for the Main House. Septic systems require periodic
maintenance in accordance with the recommendations of the local health department.
Further investigations are required to determine if a separate septic system has been installed for
the Mobile Home.

10. Storm Water Drainage
No major storm water drainage systems have been installed on the property. The following was
noted on the subject property:
• A fresh water pond and streams run through the property.
• The outlet for the pond discharges into a subsurface drainage system. The condition and
outfall location for this system was not evaluated.
• A culvert with headwalls for drainage runs under the entry roadway on the subject
property.
11. Wells
Domestic water for this property is provided by an on-site private well system. Periodic testing
of this well is recommended in accordance with the requirements of the local Health Department.
A 2nd well casing exists to the northwest of the Two Car Garage structure. Well casing is open
and should be sealed to protect groundwater from contamination.

IV. HISTORICAL IN VESTIGATION
1. Environmental Inquiry
a) Federal, State and Local Authorities
Tri-State obtained a computerized environmental report dated September 6, 2011. The purpose
of researching this database is to determine if the site or any surrounding sites are listed with any
Federal or State agencies. The report is a compilation of Federal and State environmental data
which identifies environmental sites and activities of these sites from the records of the United
States Environmental Protection Agency (U.S. E.P.A.).
A total of 18 sites were found in response to the ASTM guideline database requirements.

Based on distance, topography, assumed groundwater gradient, current regulatory status and/or
absence of recently reported releases, none of the sites listed in the federal or state agency
databases are considered to represent a likely past, present and/or material threat of release on
the subject property.
In addition to the above noted sites, several unmapped sites are included in the computerized
environmental report that may be in the area of the subject property. From the limited and
incomplete information available, these sites can not be researched.

The local building department was researched to obtain documentation that might have pertained
to this particular site. This would include, but not be limited to: certificates of occupancy,
records of underground storage tanks, and/or records of any environmental violations.
The Croton-on-Hudson Building Department records received for review are attached herewith.
No environmental issues were noted within these documents.
c) Health Department
The County Health Department was contacted by letter on August 30, 2011 regarding
environmental violations on the screened property. Response time for this department is
typically 4 to 6 weeks. This information shall be added to this report by written amendment if
any violations or an environmental issue exists.

Aerial maps dated 1953 and 1964 show the subject property as vacant land.

indicate any apparent environmental concerns in regard to the subject property.

V. IN TERVIEWS
Interviews were conducted with persons knowledgeable of the inspection property. The purpose
of these types of interviews is to receive first hand information of any potential past or current
environmental conditions of the inspection property.
1. Laurel Gouveia – Property owner. Ms. Gouveia met with Tri-State at the time
of the site inspection. She indicated that she has owned the property since
1984. Ms. Gouveia indicated that she had no knowledge of environmental
conditions on the screened property.
Ms. Gouveia completed the User Questionnaire included in the appendix of
this report.
2. Mr. Daniel O’Connor, P.E. – Village of Croton-on-Hudson, Engineer. Mr.
O’Connor met TSE on site and accompanied us during our inspections of the
buildings and property.

VI. OBJECTIVE
Tri-State Engineering, P.C., was retained by the client to perform a Phase I Environmental
Assessment of the above referenced property.
This report has been performed in general accordance with ASTM 1527-05, Environmental Site
Assessments: Phase I Environmental Site Assessment Process. This report is intended to assist
our client to satisfy one of the requirements to qualify for the innocent landowner defense to
CERCLA liability: that is, report constitutes "all appropriate inquiry into the previous ownership
and uses of the property consistent with good commercial or customary practice" as
recommended by referenced ASTM standard.
The purpose of this Phase I Environmental Assessment is to establish the history of the screened
property to assist in the detection of recognized environmental conditions with respect to the
scope and defined contaminants as indicated by the Comprehensive Environmental Response,
Compensation and Liability Act (CERCLA).
The primary goal of this Phase I Environmental Assessment is to alert interested parties to
existing or potential environmental problems and/or conditions of the screened property.
In most cases, a Phase I Assessment is not designed to 1) identify the extent of any problem
found, 2) make cost estimates for any mitigation, 3) make specific remediation measures, or 4)
make final recommendations. These items must be addressed in a Phase II Environmental Site
Assessment if determined to be required by the User.
Phase I Environmental Assessments do not require any testing. No testing has been included
herein unless otherwise indicated herein.

VII. SCOPE OF WORK AN D APPROACH
Tri-State Engineering, P.C. has followed the general requirements of the ASTM 1527-05,
Environmental Site Assessments: Phase I Environmental Site Assessment Process guidelines to
provide the information herein. This included an investigation of the historical use of the site,
visits to the referenced property, personal interviews conducted with parties knowledgeable of
the site, and a review of available historic documents pertaining to the property.
The objective of the historical use investigation is to develop the history and previous uses of the
screened property and surrounding area, in order to help identify the likelihood of past uses
having led to recognized environmental conditions in connection with the screened property.
The historical investigation of the screened property includes the review of, but not necessarily
limited to, the following where available:
1. Environmental Inquiry Results, including:
a) Federal, State, and Local Authorities
b) Local Building Department
c) Health Department
2. Sanborn Maps
3. USGS Topographic Maps
The site inspection included but was not necessarily limited to:
1. A visual inspection of the property.
2. A visual inspection of the structures on the site.
3. An examination of abutting properties, viewed from the screened property.
4. Personal interview of key individual (s) involved with the screened property.
5. An examination of surrounding site areas within 1000 feet of the screened property.
6. An examination of accessible/available records at local municipal buildings,
including the building department and health department.

Limitations and Deviations
Ü Historical data as defined by the ASTM E1527-05 Standard was not obtained at 5 years
intervals. Based on the historical information discovered herein, this is not of a major
deviation or limitation.
Ü The Health Department was contacted by letter on August 30, 2011 regarding
environmental violations on the screened property. Response time for this department is
typically 4 to 6 weeks. This information shall be added to this report by written
amendment if any violations or an environmental issue exists.

VIII. HEALTH RELATED ISSUES - Limitations
1) ASBESTOS - General
As a general rule, asbestos containing material is a health risk regardless of condition. Please
note that the USEPA has documented that over 3000 building products used in the past may
contain asbestos. As a general rule, all building materials should be assumed to be asbestos until
tested and confirmed otherwise. All asbestos material should be placed in an Operations and
Maintenance Program to minimize exposure to asbestos fibers, and health risks. ACM should be
monitored to assess any changes in condition.
Before demolition or any activity that would disturb possible asbestos containing material, have
the material tested to determine the asbestos content.
Note that this Phase I inspection does not replace a full asbestos survey. This is a limited
asbestos survey, and has not been performed to meet the requirements or recommendations of
the US EPA AHERA Regulations. AHERA Regulations are beyond the scope and intent of this
report. An AHERA Inspection can be provided upon request. Tri-State only noted obvious and
visible suspected ACM.

It should be noted that ACM’s are outside the scope of the ASTM standard for Phase I ESA’s
and, as such, this report contains no recommendations related to ACM’s.

2) LEAD - General
Recent guidance from the U.S. Environmental Protection Agency indicates that lead-based paint
should either be abated or addressed through interim controls if it is found in any of the
following circumstances: (1) if it is deteriorated (in any location); (2) if it is present (in any
condition) on impact or friction surfaces; or (3) if it is present (in any condition) on surfaces that
are accessible for mouthing or chewing by children.
Note that this Phase I Inspection does not replace a full HUD survey. This is a limited LBP
survey, and has not been performed to meet the requirements or recommendations of the US
EPA or HUD Regulations. No testing for lead based paint has been performed herein. HUD
Regulations are beyond the scope and intent of this report. A HUD Inspection can be provided
upon request.

It should be noted that LBP is outside the scope of the ASTM standard for Phase I ESA’s and, as
such, this report contains no recommendations related to LBP.

3) MOLD General
The presence of certain types of mold and mold spores in a building can result in mild to severe
health effects in humans, and can deteriorate the building materials. As humans vary greatly in
their chemical make up, so does the individuals reaction to mold exposure. For some people, a
small number of mold spores can cause ill effects. In others it may take a longer exposure.
See Section III - Site Reconnaissance, for findings regarding mold.
It should be noted that fungi are outside the scope of the ASTM standard for Phase I ESA’s and,
as such, this report contains no recommendations related to fungi/mold.

IX. QUALIFICATION S
