Request for Information (RFI) pursuant to issuance of a Request For Proposals (RFP)
for Installation of a Battery Energy Storage System (BESS) on municipal property
owned by the Village of Croton-on-Hudson, New York
Introduction and Background
The Village of Croton-on-Hudson (“the Village”) seeks qualified BESS developers
(“Respondents”) to install, own, and operate BESS at one or more properties it owns. This
RFI is intended to identify qualified organizations interested in receiving a Request for
Proposals (RFP) for the project. Thank you for taking the time to respond.
Responses to the RFI
Responses to this RFI should be submitted as both Word and Excel documents as detailed
below by e-mail to Mr. Lindsay Audin, (laudin@crotononhudson-ny.gov) chair of Croton’s
Sustainability Committee, and copied to Mr. Bryan Healy, Village Manager, at
bhealy@crotononhudson-ny.gov
Submissions must be received no later than 5:00 PM EDT on Monday, August 17, 2026.
Submissions received after that time will not be considered.
If you are not interested in receiving the RFP for this project, we would appreciate the
courtesy of a response to that end. A lack of response will be interpreted as a lack of interest.
Objectives
The objectives of this RFI are:
1. to ascertain your firm’s interest in this project
2. determine your firm’s qualifications for this project
3. to secure the correct contact information for receipt of the RFP for this project.
The Village has prior experience with BESS. A 3.5 MW unit is installed atop the Village-
owned parking lot of the Croton-Harmon Metro-North train station. It receives power from 12
solar canopies installed at the same time by the same developer. The Village does not own,
lease, or operate that system. Instead, it receives rent under a long-term ground lease.
In order to secure additional leasing revenue and other BESS benefits, the Village wishes to
replicate that front-of-the-meter (FTM) arrangement on at least one other of its properties but
without a solar installation of any type. A list of acceptable sites and their addresses will be
provided in a RFP to those Respondents that answer positively to the questions below.
Questions for Respondents
Please provide your response to each of the following questions in a Word document and
using the attached Excel spreadsheet as described below. Qualified organizations will be
those who answer positively to each one.
1. Is your firm presently developing at least one BESS with outputs between 1 MWac and 5
MWac?
2. If your firm is installing, or has already installed, at least one BESS with outputs between 1
MWac and 5 MWac in New York State, provide the name of the municipality in which it is (or
will be) sited, that of the owner of the property, date of installation (or when development
started), and contact information (name, email, and business phone number) for its property
manager.
3. Is your firm interested in installing one or more of such installations on municipally-owned
property?
4. If so, will it utilize Lithium Iron Phosphate (LFP) batteries in a BESS that fully complies with
the New York State Fire Code effective 1/1/2026?
5. Does your firm participate in NYSERDA’s BESS incentive program as outlined in that
agency’s April 2026 “Residential and Retail Energy Storage Incentive Program Manual”?
6. If later chosen via the RFP process to install BESS on Village-owned property, would it do
so under a long-term (20 to 25-year) lease under which the Village incurs no costs, does not
own any part of the system, and instead receives monthly rent from your firm?
If you are able to respond to all of the above positively, please provide the following contact
information in the cells indicated in the Excel spreadsheet that accompanied this RFI:
- business name to be used in any transactions (not just a d/b/a)
- business web site URL
- business mailing address (to receive FedExed materials; PO box number is not acceptable)
- name of the business development or sales manager (or comparable individual to whom the
RFP should be addressed)
- that person’s company title
- that person’s email address
- that person’s office and cell phone numbers.
Questions from Respondents
If you have questions concerning this RFI, please email them to both of the email addresses
noted above under “Responses to the RFI” no later than 5:00 PM EDT, Friday, August 7, 2026.
Answers will be emailed no later than 5:00 PM EDT, Tuesday August 11, 2026 to all
responding parties.
The Village is not responsible for and shall not be bound by any representations, statements,
or explanations made by any individual acting or purporting to act on its behalf, unless it is
provided by email from Mr. Bryan Healy, Village Manager, at bhealy@crotononhudson-ny.gov
General Terms and Conditions
1. By submitting a response to this RFI, Respondent acknowledges that it has read and agrees
to be bound by the terms and specifications and any addenda subsequently issued prior to the
due date for a response.
2. The Village reserves the right to cancel, modify, or amend this RFI, in whole or in part, at
any time through written addenda. Any addendum shall be made available to each person or
firm receiving this RFI. Should such addendum require additional information from a
Respondent not previously requested, failure to address the requirements of such addendum
may result in a Respondent being found non-responsive or not being considered, as
determined in the sole discretion of the Village.
3. The Village reserves the right to reject any and all submittals and to waive irregularities
without explanation.
4. The Village reserves the right to request supplementary or follow-up questions or inquiries to
request clarification of information submitted and to request additional information from any
Respondent.
5. The Village shall not be liable to any Respondent or party in law or equity for any reason
whatsoever for any acts or omissions out of or in connection with this request for submittals.
6. The Village shall not be liable for any costs incurred by any Respondent in preparing any
information for submission in connection with this RFI process or any and all costs resulting
from responding to this RFI. Any and all such costs whatsoever shall remain the sole
responsibility of the Respondent.
7. This RFI does not constitute an offer or promise to buy or create an obligation for
Respondent, or to enter into or promised to engage in any transaction, arrangement,
competitive bid, or solicitation, negotiation, or agreement with any Respondent.
8. The Village reserves the right to re-issue the RFI at a future date.
Public Records
All documents submitted in response to this RFI will become the property of the Village upon
submittal and will be subject to the provisions of the New York State Freedom of Information
Law (FOIL).
