New Business Subject 3.1 SEQRA Resolution for the Energy Performance Contract Type Action Recommended Action RESOLVED: That the Board of Education hereby approves the SEQRA resolution as presented. WHEREAS, the Board of Education of the Croton-Harmon UFSD desires to embark upon a District-wide Energy Performance Contract consisting of the supply and installation of the following energy conservation measures at the District’s facilities as follows:  (1) Roof Solar PV Systems on all three school buildings; (2) Carport Solar PV Systems at Pierre Van Cortlandt Middle and Croton-Harmon High School; and (3) Unit Ventilator Replacements at Pierre Van Cortlandt Middle School;  and WHEREAS, said improvements are subject to classification under the State Environmental Quality Review Act (SEQRA);  and WHEREAS, “replacement, rehabilitation, or reconstruction of a structure or a facility, in kind, on the same site, including upgrading buildings to meet building, energy, or fire codes, unless such action meets or exceeds any of the thresholds in section 617.4”;  “retrofit of an existing structure and its appurtenant areas to incorporate green infrastructure”;  installation of solar energy arrays where such installation involves 25 acres or less of physical alteration on the following sites … (vi) parking lots or parking garages;”  and “installation of solar energy arrays on an existing structure …” are classified as Type II Actions under the current Department of Environmental Conservation SEQRA Regulations (Section 6 NYCRR 617.5 (c)(2), (3), (14), and (15);  and WHEREAS, the SEQRA Regulations declare Type II Actions to be actions that have no significant impact on the environment and require no further review under SEQRA;  and WHEREAS, the Board of Education has examined all information related to the Energy Performance Project; NOW, THEREFORE, BE IT RESOLVED that the Board of Education of the Croton-Harmon UFSD hereby determines that the Energy Performance Project is a Type II Action pursuant to Sections 617.5 (c )(2), (3), (14), and (15) of the SEQRA Regulations and as such requires no further review under SEQRA.  Motion & Voting RESOLVED: That the Board of Education hereby approves the SEQRA resolution as presented.
