On motion of TRUSTEE -, seconded by TRUSTEE -, the following resolution was adopted by the Board of Trustees of the Village of Croton-on-Hudson, New York with the following vote: Resolution #237-2026 WHEREAS, the Village of Croton-on-Hudson (“Village”) transmitted formal correspondence dated July 22, 2026, to the New York State Department of Transportation (NYSDOT) conveying urgent public safety concerns regarding hazardous trees and the degraded roadway conditions along State Route 129; and WHEREAS, NYSDOT Regional Director Julianne Fuda, P.E., issued a written response dated August 31, 2026, outlining routine maintenance protocols, inspections, and tree removal procedures, but failing to commit to a definitive timetable; and WHEREAS, the Board of Trustees finds the NYSDOT response dated August 31, 2026, to be unsatisfactory in that it does not address the safety hazards threatening motorists; and WHEREAS, numerous dead, damaged, and unstable trees along the corridor pose a direct and imminent danger to the public, particularly in the event of high winds and extreme weather events; and WHEREAS, the period of greatest danger is heightened while foliage remains on the trees, as leaf canopies amplify wind resistance, increase branch failure rates, and escalate the risk of catastrophic tree falls; and WHEREAS, the pavement condition along Route 129 has severely deteriorated, having been rated by NYSDOT in 2021 as being Fair/Poor, and has undergone five additional years of continuous degradation without resurfacing; and WHEREAS, NYSDOT staff have advised the Village that intermediate maintenance measures (e.g., drag-boxing) are no longer viable or effective given the condition of the road base, NOW THEREFORE BE IT RESOLVED: that the Board of Trustees of the Village of Croton-on-Hudson hereby calls upon the New York State Department of Transportation to: 1. Undertake Immediate Tree Remediation: Direct emergency and specialized tree crews to immediately inspect, trim, and remove all hazardous and compromised trees along State Route 129 before seasonal severe weather conditions worsen; and 2. Prioritize Repaving: Program and expedite the complete repaving and structural rehabilitation of State Route 129, allocating the required state capital funding without further delay; and BE IT FURTHER RESOLVED: that the Village Clerk is hereby directed to forward certified copies of this resolution to Governor Kathy Hochul, NYSDOT Commissioner Marie Therese Dominguez, NYSDOT Regional Director Julianne Fuda, P.E., and the Village's state legislative representatives.
