ARTICLE I
General Provisions
§ 215-1. Definitions.
A. The words and phrases used in this chapter shall, for the purposes of this chapter, have the meanings
respectively ascribed to them by Article 1 of the Vehicle and Traffic Law of the State of New York.
B. The following words and phrases, which are not defined by Article 1 of the Vehicle and Traffic Law
of the State of New York, shall have the meanings respectively ascribed to them in this section for
the purposes of this chapter:
CURBLINE — The prolongation of the lateral line of a curb or, in the absence of a curb, the lateral
boundary line of the roadway.
HOLIDAYS — New Year's Day, Martin Luther King Jr. Day, Presidents’ Day, Memorial Day,
Juneteenth, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and
Christmas Day and such other holidays as may be designated by the Village Manager.[Amended

OFFICIAL TIME STANDARD — Whenever certain hours are named herein or on traffic control
devices, they shall mean the time standard which is in current use in this state.
§ 215-2. Authority to install traffic control devices.
The Village Manager shall install and maintain traffic control devices when and as required under the
provisions of this chapter, to make effective the provisions of this chapter, and may install and maintain
such additional traffic control devices as he may deem necessary to regulate, warn or guide traffic under
the Vehicle and Traffic Law of the State of New York, subject to the provisions of §§ 1 and 1 of
that law.
§ 215-3. Schedules; adoption of regulations. [Amended 7-10-2023 by L.L. No. 13-2023]
A. For the purpose of maintaining an accurate record of all regulations adopted under the provisions of
this chapter, there is hereby established a system of schedules, appearing as Article IX of this chapter,
in which shall be entered all regulations after adoption. Such schedules shall be deemed a part of the
section to which they refer. All regulations shall be adopted with reference to the appropriate schedule
as indicated in the various sections of this chapter.
B. The powers of the Board of Trustees to designate places within the Village where parking, stopping
or standing is prohibited, limited or restricted, to designate parking meter zones, to designate places
within the Village where handicapped parking is permitted, to designate through highways, to
designate an intersection as a stop intersection, to designate an intersection as a yield intersection, to
designate intersections where turns are prohibited, to designate streets where trucks are excluded, to
designate the locations of loading zones, bicycle lanes and taxi stands and to order and install signs
implementing such designations are hereby delegated to the Village Manager.
(1) All actions by the Village Manager pursuant to this delegation of authority shall be taken after:
(a) Consideration of the volume and nature of traffic, the needs of the public for parking
facilities and public safety and convenience.
(b) Obtaining the views of the Police Department and consulting with such state, county and
Village departments and agencies and others as he may deem appropriate.
(c) Publication as traffic rules and regulations of the Village of Croton-on-Hudson in the
official newspaper of the Village.
(d) Filing with the Village Clerk on or before publication.
(2) All rules and regulations or amendments thereto so published and filed shall become effective
not less than 30 days after publication on a date stated therein, unless theretofore vetoed or
suspended by resolution of the Board of Trustees; provided, however, that if the Village
Manager determines that an emergency exists, such rules and regulations, or any amendment
thereof shall become effective and the date specified by him therein.
(3) Any order, rule or regulation, or amendment thereof issued by the Village Manager pursuant to
this section shall be subject to revocation or suspension by resolution of the Board of Trustees
on appeal by any aggrieved party to the Board of Trustees at any meeting thereof held prior to
the effective date of any such order, rule or regulation, or on its own motion at any time.
(4) All signs and markings required by the Vehicle and Traffic Law of the State of New York in
connection with parking controls contained in rules and regulations, issued by the Village
Manager pursuant to delegations of authority made in this section, shall be posted by the Village
Manager on or before the effective date of the rules and regulations requiring such signs and
markings. Such signs and markings shall be maintained by the Village Manager for so long as
the rules and regulations requiring them remain in effect.
ARTICLE II
Traffic Regulations
§ 215-4. Traffic control signals.
Traffic control signals shall be installed and operated at the intersection of those streets described in
Schedule I (§ 215-49), attached to and made a part of this chapter.
§ 215-5. Speed limits. [Amended 4-24-2023 by L.L. No. 6-2023]
The maximum speed at which vehicles may proceed on or along any streets or highways within the Village
is hereby established at 25 miles per hour, except that the speed limit for vehicles proceeding on or along
those streets or parts of streets described in Schedule II (§ 215-50) shall be as indicated in said schedule.
§ 215-6. School speed limits.
No person shall drive a vehicle at a speed in excess of that indicated in Schedule Ill (§ 215-51), in the areas
described in said Schedule III, during school days between the hours of 7:0 a.m. and 6:00 p.m.
§ 215-7. One-way streets.
The streets or parts of streets described in Schedule IV (§ 215-52), attached to and made a part of this
chapter, are hereby designated as one-way streets in the direction indicated.
§ 215-8. U-turns.
No person shall make a U-turn on any of the streets or parts of streets described in Schedule V (§ 215-53),
attached to and made a part of this chapter.
§ 215-9. Prohibited turns at intersections.
No person shall make a turn of the kind designated (left, right, all) at any of the locations described in
Schedule VI (§ 215-54), attached to and made a part of this chapter.
§ 215-10. Prohibited right turns on red signal.
No person shall make a right turn when facing a steady red signal (stop indication) at any of the locations
described in Schedule VII (§ 215-55), attached to and made a part of this chapter.
§ 215-11. Through streets.
The streets or parts of streets described in Schedule VIII (§ 215-56), attached to and made a part of this
chapter, are hereby designated as through streets. Traffic control devices shall be installed on each street
intersecting the through street.
§ 215-12. Stop intersections. [Amended 6-4-2001 by L.L. No. 7-2000]
The intersections described in Schedule IX (§ 215-57), attached to and made a part of this chapter, are
hereby designated as stop intersections. Vehicles must come to a full stop unless otherwise directed by a
police officer or signal. Stop signs shall be installed as provided therein.
§ 215-13. Yield intersections.
The intersections described in Schedule X (§ 215-58), attached to and made a part of this chapter, are
hereby designated as yield intersections. Yield signs shall be installed as provided therein.
§ 215-14. Trucks excluded. [Amended 6-11-2021]
Trucks are hereby excluded from the streets or parts of streets described in Schedule XI (§ 215-59), except
for the pickup and delivery of materials on such streets.
ARTICLE III
Parking, Standing and Stopping
§ 215-15. Application of Article.
The provisions of this Article shall apply except when it is necessary to stop a vehicle to avoid conflict
with other traffic or in compliance with the directions of a police officer or official traffic control device.
§ 215-16. General parking regulations and restrictions.
A. Double-parking or parking of cars more than 12 inches from the curb is prohibited in all streets in the
Village of Croton-on-Hudson. All parked cars must be parked parallel to the curb, facing with the
direction of traffic and not more than 12 inches from the curb measured from the curbside wheels.
B. Parking, standing or stopping is hereby prohibited within 20 feet of any intersection, where posted.
C. No person shall park or stand a vehicle of any kind within 20 feet of the driveway entrance of any
firehouse or EMS building, namely Washington Engine Firehouse, Harmon Engine Firehouse, Grand
Street Firehouse and 44 Wayne Street and, when on the side of the street opposite to the entrance of
any firehouse (not including 44 Wayne Street), within 75 feet of said entrance. In addition, the
parking of vehicles is hereby restricted to firefighters only on the following streets or parts of streets

D. Parking of electric and hybrid vehicles. [Added 5-28-2019]
(1) As used in this subsection, the following terms shall have the meanings indicated:
ELECTRIC VEHICLE — Any vehicle that operates exclusively on electrical energy from an
off-board source that is stored on board for motive purpose.
HYBRID-ELECTRIC VEHICLE — A motor vehicle which operates by combining an internal
combustion engine powered by gasoline or diesel fuel with a battery-powered electric motor.

(2) No person shall stop, stand, or park a vehicle other than an electric vehicle or a hybrid-electric
vehicle within any space marked or signed as reserved for "electric vehicle charging."
(3) It shall be unlawful for such electric vehicle or hybrid-electric vehicle to park in such marked
spaces if it is not connected to the charging station.
(4) Electric vehicles or hybrid-electric vehicles may be parked in any space designated for public
parking, subject to the restrictions that would apply to any other vehicle that would park in that
space.
(5) The locations described in Schedule XXIII (§ 215-71), attached to and made a part of this
chapter, are hereby designated as off-street electric vehicle parking spaces at which only the
parking of electric vehicles shall be permitted.

E. Parking restrictions in the Black Rock and Silver Lake municipal lots. [Added 5-22-2020]
(1) It shall be unlawful for any vehicle to park or stand in the Black Rock municipal lot, located at
19 Quaker Bridge Road, and Silver Lake municipal lot, located at the end of Truesdale Drive,
between the hours of 10:00 p.m. and 6:0 a.m.95 [Added 1-6-2024]
(2) Parking is limited to passenger vehicles. Recreation vehicles, commercial vehicles with more
than four wheels and construction equipment are prohibited.

F. Trucks over certain weights excluded. [Added 6-11-2021]
(1) All trucks in excess of five tons are hereby excluded from all named streets in the Village,
except for the pickup and delivery of materials on such streets.
G. Pursuant to § 1640-a of the Vehicle and Traffic Law of the State of New York, parking in the
following areas of the Village of Croton-on-Hudson is hereby prohibited:
(1) In designated areas at the Van Wyck Shopping Center, Croton Commons Shopping Center,
Shop-Rite Shopping Center, Bari Manor private apartment complex and Sky View Nursing
Home.97 [Amended 11-26-1989; 5-1-1996]
H. Use of parking lot for storage of vehicles.
(1) No person shall use any off-street public parking area maintained by the Village or use any
public street for the regular storage of a vehicle.
(2) As used in this subsection, the following terms shall have the meanings indicated:
PUBLIC PARKING AREA — Any off-street parking area open to the general public and
owned or maintained by the Village.
PUBLIC STREET — An official street owned and maintained by the Village as shown on the
Official Village Map.
REGULAR STORAGE — The parking of a vehicle for more than 48 hours.

§ 215-16 VEHICLES AND TRAFFIC § 215-20.1
I. Parking restrictions in the Asbury Methodist, Merwin Oak and South Harmon municipal lots. [Added
6-26-1988; amended 5-1-1996; 8-27-2018]
(1) All vehicles are to be parked for periods of not longer than two hours from 8:0 a.m. to 6:00
p.m., Monday through Saturday, except for those eligible to receive a special parking permit.
Application forms for special parking permits are available in the Village Office.98
(2) Parking is limited to passenger vehicles and those vehicles issued a special permit by the Village
Manager. Recreation vehicles, commercial vehicles with more than four wheels and
construction equipment are prohibited.
§ 215-17. Parking of commercial vehicles on residential streets and in public parking areas.
A. Definitions. As used in this section, the following terms shall have the meanings indicated:
COMMERCIAL VEHICLE — Any motor vehicle used for business or commercial purposes, such as
the transportation of goods, wares and merchandise, including any trailers and semitrailers, tractors,
when used in combination with trailers and semitrailers, and special commercial vehicles registered
as such.
B. No commercial vehicle of over 10,000 pounds' gross vehicle weight or more than 20 feet in length
shall be parked on any public street in a district zoned residential or in any Village-owned, -operated
and -maintained public parking areas, except for a vehicle delivering goods, wares or merchandise or
rendering services to premises in the immediate vicinity thereof.
§ 215-18. Parking prohibited at all times.
No person shall park a vehicle at any time upon any of the streets or parts thereof described in Schedule
XII (§ 215-60), attached to and made a part of this chapter.
§ 215-19. No stopping.
No person shall stop a vehicle upon any of the streets or parts of streets described in Schedule XIII
(§ 215-61), attached to and made a part of this chapter.
§ 215-20. No standing.
No person shall stand a vehicle upon any of the streets or parts of streets described in Schedule XIV
(§ 215-62), attached to and made a part of this chapter.
§ 215-20.1. Restrictions on idling of motor vehicles. [Added 9-29-2019]
A. When the ambient temperature is in excess of 32° F., no person shall cause or permit the engine of a
motor vehicle, other than a legally authorized emergency motor vehicle performing official duties, to
idle for longer than three minutes while parking as defined in § 1 of the Vehicle and Traffic Law,
standing as defined in § 1 of the Vehicle and Traffic Law, or stopping as defined in § 1 of the
Vehicle and Traffic Law, except when the engine is being used to operate a loading or unloading or
processing device. [Amended 11-3-2021]
B. When the ambient temperature is in excess of 32° F., no person shall cause or permit the engine of a

bus, as defined in § 1 of the Vehicle and Traffic Law, to idle while stopping, parking, or standing
unless otherwise required by federal, state, or local regulations to maintain a specific temperature for
passenger comfort, in which case the idling time may be increased to the extent necessary to comply
with such regulations.
C. Penalties for violation of this section shall be found in § 215-30, Parking fines and penalties.
§ 215-21. Parking prohibited certain hours.
No person shall park a vehicle between the hours specified in Schedule XV (§ 215-63) of any day, unless
otherwise indicated, upon any of the streets or parts of streets described in said Schedule XV, attached to
and made a part of this chapter.
§ 215-22. No stopping certain hours.
No person shall stop a vehicle during the times specified in Schedule XVI (§ 215-64) of any day, unless
otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVI, attached to
and made a part of this chapter.
§ 215-23. No standing certain hours.
No person shall stand a vehicle during the times specified in Schedule XVII (§ 215-65) of any day, unless
otherwise indicated, upon any of the streets or parts of streets described in said Schedule XVII, attached to
and made a part of this chapter.
§ 215-24. Time limit parking.
No person shall park a vehicle for longer than the time limit shown in Schedule XVIII (§ 215-66) at any
time between the hours listed in said Schedule XVIII of any day, unless otherwise indicated, upon any of
the streets or parts of streets described in said Schedule XVIII, attached to and made a part of this chapter.
§ 215-25. Angle parking.
No person shall park a vehicle upon any of the streets or parts thereof described in Schedule XIX
(§ 215-67) except at the angle designated and only within the painted stall lines. On all streets or portions
thereof where angle parking is now or shall hereafter be authorized, all vehicles parked thereon shall be
parked with the front thereof nearest the curb.
§ 215-26. Loading zones.
The locations described in Schedule XX (§ 215-68), attached to and made a part of this chapter, are hereby
designated as loading zones.
§ 215-27. Taxi stands.
The locations described in Schedule XXI (§ 215-69), attached to and made a part of this chapter, are hereby
designated as taxi stands.
§ 215-28. Bicycle lanes. [Amended 3-17-2022]
The locations described in Schedule XXII (§ 215-70), attached to and made a part of this chapter, are
hereby designated as bicycle lanes.
§ 215-29. Seasonal parking. [Amended 2-20-1990 by L.L. No. 1-1990; 2-16-1993 by L.L. No. 1-1993;

A. Vehicles shall be allowed to remain standing on any street or public highway within the corporate
limits of the Village of Croton-on-Hudson, except when otherwise prohibited by this chapter or any
other chapter of the Croton-on-Hudson Code, and except when snow accumulates to two or more
inches.
B. Upon an accumulation of two or more inches of snow, no vehicle of any kind shall be allowed to
remain standing on any street or public highway until the snow has ended and the road has been
cleared of snow. Vehicles must be relocated to off-street locations and may be parked on the Village
right-of-way area directly in front of the vehicle owner's residence, except that vehicles may not be
parked on any part of a street, sidewalk, or curb. Vehicles parked in the Municipal Building parking
lot, Asbury Methodist parking lot, Merwin Oak parking lot, and South Harmon parking lot must be
moved within 12 hours after snow has ended.
C. Special hardship permits. In cases where there is no off-street location or right-of-way area which can
be used, the Village Manager shall, upon written application, verification of the applicant's special
hardship and payment of a fee charged in accordance with the fee schedule established by the Village
Board of Trustees,99 issue an annual permit granting permission to park motor vehicles on the street
or public highway except for certain streets designated by the Village Manager, upon
recommendation of the Superintendent of the Department of Public Works, provided that such
parking conforms to all other laws and regulations. No permit parking shall be permitted on those
streets designated by the Village Manager. Hardship permit holders shall move their vehicles to an
area cleared of snow no later than 12 hours after the snow stops.
D. Overnight parking. Overnight parking in certain sections of the Municipal Building parking lot is
prohibited during snow events as designated by signage.
E. Fine prescribed. All vehicles in violation of this section are subject to a fine as prescribed in
§ 215-30B and towing.
§ 215-30. Parking fines and penalties. [Amended 4-1-1991; 4-15-1991; 5-1-2016; 9-29-2019;

A. Fire lanes, fire hydrants and handicapped parking areas. Any person who violates the parking
regulations of the Village pertaining to fire lanes, parking within 15 feet from fire hydrants and
designated areas for handicapped persons shall be liable to a fine of not less than $280.
B. Any person who violates the regulations as prescribed in § 215-29, Seasonal parking, shall be subject
to a fine of not less than $100.
C. Any person who violates the regulations as prescribed in § 215-28, Bicycle lanes, shall be subject to
a fine of not less than $50.
D. Any person who violates the parking regulations in the Croton Harmon Train Station shall be subject
to a fine of not less than $40.
E. Any person who violates the regulations as prescribed in § 215-20.1, Restrictions on idling of motor

vehicles, shall be subject to a fine of not less than $35.
F. Any person who violates any other of the parking regulations of the Village shall be liable to a fine
of not less than $25.
G. Parking fines shall be subject to doubling upon failure to pay within 30 days after the date of issuance;
shall be subject to increase by another $20 upon failure to pay within 60 days after the date of
issuance; and shall be subject to increase by another $20 upon failure to pay within 90 days after the
date of issuance.
ARTICLE IV
Parking for the Handicapped
§ 215-31. Designation of areas; use by unauthorized persons prohibited. [Amended 11-24-1991;
8-29-2007; 7-21-2008; 1-16-2012; 1-14-2013; 8-26-2013; 5-1-2016; 8-27-2018; 8-14-2020; 10-25-2022]
Pursuant to § 1203-c of the Vehicle and Traffic Law of the State of New York, the following areas of the
Village of Croton-on-Hudson are hereby designated as places for parking for handicapped persons; and
parking in said areas by other persons is hereby prohibited:
A. Village facilities and public streets.
(1) Municipal Building parking lot: three spaces. [Amended 9-14-2023]
(2) Croton Harmon Station parking lot: 58 spaces.
(3) Merwin parking lot: two spaces. [Amended 9-14-2023]
(4) Grand Street in front of the Holy Name of Mary Church; nearest intersection: Old Post Road
North: one space.

§ 215-32. Powers and duties of Manager.
The Village Manager shall be the issuing agent for permits to handicapped persons received from the
Commissioner of Motor Vehicles of the State of New York. He shall be empowered to prescribe forms of
application and conditions for the issuance and denial, suspension or revocation of permits.
§ 215-33. Definitions. [Amended 5-1-2016]
As used in this article, the following terms shall have the meanings indicated:
HANDICAPPED PERSON — Any person who has been issued a valid handicapped permit or license
plate from the State of New York, or an equivalent jurisdiction.
ARTICLE V
Parking Lots
§ 215-34. Permit parking in Village-owned parking facilities.
All permit parking in Village-owned parking facilities shall be controlled by the issuance of parking
permits by the office of the Village Manager, Village of Croton-on-Hudson. Permit conditions and rates
shall be set through adoption by resolution of Rules and Regulations for Permit Parking by the Board of
Trustees as authorized by the Vehicle and Traffic Law § 1640, Subdivision (b). These rules and regulations
may be amended from time to time by resolution of the Board of Trustees. Such rules and regulations for
permit parking shall be filed in the office of the Village Manager and shall be available for public scrutiny
during regular office hours of that office.
§ 215-35. Method of parking.
It shall be unlawful to park any vehicle across any line or marking designating a parking space or to park
said vehicle in any way that the same shall not be wholly within a parking space as designated by said lines
or markings.

ARTICLE VI
Parking Meters
§ 215-37. Establishment of zones and rates; installation of parking meters. [Amended 12-23-2004;
12-9-2021]
The Village Manager is hereby authorized to have parking meters and multispace meters installed in such
parking meter zones as established by resolution of the Board of Trustees. Such parking meters shall be
placed in front of, alongside or next to parking meter spaces. Meters serving more than one parking meter
space shall be placed in such locations as to be convenient for users, and signage shall be placed to direct
users for such multispace meters. Such meters shall be equipped to accept payment by United States coin
or currency and, with respect to multispace meters, additionally by credit or debit card. Violations of the
provisions of this article and the rules and regulations implementing this article shall be punishable as
provided in § 215-3 of this chapter.
§ 215-38. Days and hours of operation. [Added 12-9-2021100]
In all off-street parking meter zones, the use of parking meters shall be required 24 hours a day, seven days
a week, except as noted in the rules and regulations adopted by resolution of the Board of Trustees.
§ 215-39. Method of parking.
A. It shall be unlawful to park any vehicle across any line or marking designating a parking space or to
park said vehicle in any way that the same shall not be wholly within a parking space as designated
by said lines or markings.
B. In any street or highway which is a state highway or road, parking shall be permitted only parallel to
the curb.
§ 215-40. Presumption of unlawful parking. [Amended 12-9-2021]
During any period in which the deposit of coins or bills in a parking meter is required to permit parking,
and the timing device on the parking meter indicates no unexpired time, it shall be presumptive evidence
that the operator of such vehicle failed to deposit, or cause to be deposited, the required coin, coins or
bills in the meter or failed to remove the vehicle from the parking space upon the expiration of the lawful
parking time.
§ 215-41. Misuse of meters and meter feeding.
A. It shall be unlawful for any person to deface, tamper with, damage, open or willfully break, destroy
or impair the usefulness of any parking meter installed under the terms of this Article.
B. It shall be unlawful to deposit or cause to be deposited in any parking meter a slug, device or
substitute for a coin of the United States of America.101

ARTICLE VII
Removal and Storage of Vehicles
§ 215-42. Authority to impound vehicles.
A. When any vehicle is parked or abandoned on any highway or public parking lot within this Village
during a snowstorm, flood, fire or other public emergency which affects that portion of the public
highway or parking lot upon which said vehicle is parked or abandoned, said vehicle may be removed
by or under the direction of the Chief of Police.
B. When any vehicle is found unattended on any highway or public parking lot within the Village where
said vehicle constitutes an obstruction to traffic, said vehicle may be removed by or under the
direction of the Chief of Police.
§ 215-43. Storage and charges.
After removal of any vehicle as provided in this Article, the Chief of Police may store or cause such vehicle
to be stored in a suitable place at the expense of the owner. Such owner or person in charge of the vehicle
may redeem the same upon payment to the person with whom stored of the amount of all expenses actually
and necessarily incurred in effecting such removal and storage, such storage charges as set by resolution of
the Board of Trustees.
§ 215-44. Notice of removal.
It shall be the duty of the Chief of Police to ascertain to the extent possible the owner of the vehicle or the
person having the same in charge and to notify him of the removal and disposition of such vehicle and of
the amount which will be required to redeem same. Said Chief of Police shall also without delay report the
removal and disposition of any vehicle removed as provided in this Article to the Village Manager.
ARTICLE VIII
Miscellaneous Provisions
§ 215-45. Penalties for offenses.
Every person convicted of a traffic infraction for a violation of any provision of this chapter which is not
a violation of any provision of the Vehicle and Traffic Law of the State of New York shall, for a first
conviction thereof, be punished by a fine of not more than $5 or by imprisonment for not more than 15
days, or by both such fine and imprisonment; for a second such conviction within 18 months thereafter,
such person shall be punished by a fine of not more than $1 or by imprisonment for not more than 45
days, or by both such fine and imprisonment; upon a third or subsequent conviction within 18 months after
the first conviction, such person shall be punished by a fine of not more than $2 or by imprisonment for
not more than 90 days, or by both such fine and imprisonment.
§ 215-46. When effective.
A. Except those parts, if any, which are subject to approval under § 1 of the Vehicle and Traffic Law
of the State of New York, this chapter and any regulations adopted hereunder shall take effect as
provided by law.
B. Any part or parts of this chapter and any regulations adopted hereunder which are subject to approval
under § 1 of the Vehicle and Traffic Law of the State of New York shall take effect from and after
the day on which approval in writing is received from the New York State Department of
Transportation.
§ 215-47. Towing and booting for outstanding parking violations. [Added 6-19-2017 by L.L. No.
4-2017]
A. Legislative findings and purpose.
(1) The Village Board finds that significant numbers of vehicle owners fail to respond to parking
summonses issued for violations of parking orders, rules, regulations, and local laws; that a
significant number of such owners are persistent violators; and that, by reason of out-of-state
registration of vehicles, transfer of ownership, reregistration of vehicles, and other
circumstances, violators frequently are able to evade existing enforcement measures.
(2) By reason of the foregoing, the Village Board finds that the health, welfare, and safety of the
Village will be served by adoption of a Village local law providing additional means of
enforcing parking orders, rules, regulations, and local laws in the case of vehicle owners who
fail to timely respond to summonses issued for Village parking violations.
B. Definitions. As used in this section, the following terms shall have the meanings indicated:
PARKING VIOLATION DEFAULT — A parking violation default is incurred when an unpaid
parking summons has not been answered by the required appearance date.
TOWING — The moving of a vehicle subject to towing by a tow truck, as herein discussed.
TOW TRUCK — A vehicle that is equipped with a crane, winch, tow bar, push plate, or other device
designed to pull or push a vehicle or to raise a vehicle by the front or rear end thereof.
VEHICLE — Includes a motor vehicle as defined in § 1 of the Vehicle and Traffic Law, as may
be amended from time to time; a tractor as defined in § 151-a of such law; or a trailer as defined in
§ 1 of such law.
VEHICLE IMMOBILIZATION — The clamping, affixing, or locking of a booting device onto the
wheel of a parked vehicle to prevent the wheel from rotating, thereby immobilizing the vehicle.
VEHICLE IMMOBILIZATION DEVICE — A device that is clamped, affixed, or locked onto the
wheel of a parked vehicle to prevent the wheel from rotating, thereby immobilizing the vehicle until
it is unlocked and removed.
C. Vehicle immobilization.
(1) The Chief of Police is hereby authorized, in lieu of towing a vehicle, to provide for vehicle
immobilization with respect to vehicles which have three or more outstanding Village parking
violation defaults against them.
(2) Notice. When a vehicle immobilization device is used, the Police Department or Parking
Enforcement Officer shall attach or cause to be attached to the vehicle, in a conspicuous manner,
in such form as may be directed by the Chief of Police, a notice containing the following
information:
(a) The location and a description of the vehicle.
(b) The date and time of the installation of the vehicle immobilization device and signature of
the installer.
(c) Notice that any person tampering with, defacing, removing, or destroying the vehicle
immobilization device will be subject to criminal prosecution and liable for any loss to the
Village resulting from damage to the device.
(d) The steps which must be taken by the owner of the vehicle to obtain its release.
(e) Notice that the vehicle may be towed if it remains in the same location for 72 hours after
the vehicle immobilization.
(f) Such other information, statements, notices, and warnings as the Chief of Police may, from
time to time, determine to be appropriate.
D. Towing.
(1) Vehicles subject to towing. The Chief of Police is hereby authorized to provide for the towing
and impoundment of vehicles which have three or more outstanding Village parking violation
defaults against them and which, after mailing a notice of the Village parking violation defaults
and stating the vehicle's eligibility to be towed and impounded to the registered owner at the
address provided by the Department of Motor Vehicles records, and not receiving a response
for a period of seven days after having mailed said notice, are found operated or parked on any
public street, public highway, or Village roadway, or in any Village parking lots where towing
may be done. [Amended 4-24-2023 by L.L. No. 5-2023]
(2) Signage. The Village shall provide warning signs, advising of the possibility of towing, on
public streets where towing may be done and at the entrance to any Village parking lots where
towing may be done.
E. Release of vehicle to owner.
(1) Generally.
(a) The individual attempting to redeem a vehicle that has been immobilized or towed must
demonstrate to the satisfaction of the Village Court Clerk that he or she is the owner of
said vehicle or is authorized to act on behalf of such owner.
(b) It shall be a defense that the vehicle in question was stolen and thereafter parked illegally;
however, this defense shall only be available when a bona fide report of the theft has been
filed with a police department. In the event of a theft, the owner of the vehicle shall still
be responsible for paying the towing and storage fees associated with towing and storage
of the vehicle directly to the tow company.
(2) Release of immobilized vehicles.
(a) To obtain the release of an immobilized vehicle, the owner of said vehicle shall visit the
office of the Village Justice Court during normal business hours and provide the Justice
Court Clerk with payment in full of all outstanding Village parking violations relating to
the vehicle. Upon receiving payment for all outstanding Village parking violations, the
Justice Court Clerk shall provide the owner with a certificate as proof of payment.
(b) After obtaining the certificate described above in Subsection E(2)(a), the owner of an
immobilized vehicle shall visit the office of the Police Department during normal business
hours and present said certificate. Thereafter, the Chief of Police, his duly designated
agent, or the Parking Enforcement Officer shall remove the vehicle immobilization device
in a reasonably prompt manner.
(c) New parking summonses may be issued to a vehicle that has been fitted with a vehicle
immobilization device, and penalties will continue to accrue until payment is made.
(3) Release of vehicles subject to towing.
(a) To obtain the release of a vehicle subject to towing, the owner of said vehicle shall visit
the office of the Village Justice Court during normal business hours and provide the Justice
Court Clerk with payment in full of all outstanding Village parking violations relating to
the vehicle. Upon receiving payment for all outstanding Village parking violations, the
Justice Court Clerk shall provide the owner with a certificate as proof of payment. At the
same time, the Justice Court Clerk shall also provide the owner of the vehicle with the
name and contact information of the tow company that towed and is storing the vehicle.
(b) After obtaining the certificate described above in Subsection E(3)(a), the owner of a
vehicle subject to towing shall visit the tow company and present said certificate.
Thereafter, the owner of the vehicle shall pay the tow company the required towing and
storage fees. Towing and storage fees shall be as established by resolution of the Village
Board of Trustees from time to time. Upon payment of the tow company's fees, the
company shall release the vehicle to the owner in a reasonably prompt manner.
F. Tampering with or attempted removal of a vehicle immobilization device. Any person who attempts
to remove, deface, or destroy a vehicle immobilization device, having no lawful right to do so, shall
be in violation of this Village chapter. Notwithstanding any other provision of this chapter, the fine
for such violation shall be $300, plus all actual expenses for replacement and/or repair of the vehicle
immobilization device.

Residential Parking Permit System

§ 215-72. Purpose, intent and findings.
The Board of Trustees hereby finds that a residential parking permit system in certain areas of the Village
of Croton-on-Hudson is necessary in order to preserve the character of the neighborhoods, improving
access to residences and parking for residents, and reducing traffic hazards, congestion, and air and noise
pollution detrimental to the health, safety, and welfare of its residents. The Board of Trustees sought state
legislation authorizing the creation of an on-street parking permit system for residents of Hastings Avenue
and Young Avenue, which legislation was adopted and became effective on October 7, 2020, and codified
in the New York State Vehicle and Traffic Law as § 1640-q. The Board of Trustees sought further state
legislation authorizing the creation of an on-street parking permit system for residents of Cedar Lane,
Nordica Drive, Old Post Road South and Truesdale Drive, which legislation was adopted and became
effective on September 15, 2023, and was added to the New York State Vehicle and Traffic Law as
§ 1640-q.
§ 215-73. Definitions.
As used in this article, the following terms shall have the meanings indicated, unless the context clearly
requires otherwise:
CROTON RIVER RESIDENTIAL PARKING PERMIT AREA — Consisting of the following roadways

§ 215-74. Designation of permit parking areas in Harmon; permit required; hours.
A. A residential parking permit system is hereby established within the Harmon residential parking
permit area, as defined herein.
B. Except as otherwise provided herein, no person shall park a vehicle, nor allow a vehicle to be parked
at any time, Monday through Friday, between the hours of 7:0 a.m. to 7:00 p.m., excluding holidays,
along any street that has been designated as the Harmon residential parking permit area pursuant to
this article, unless the vehicle displays a valid parking permit issued in accordance with this article.
C. A permitted vehicle issued a permit shall have affixed a valid residential parking permit to either its
rear windshield or its rear bumper, or such other location on the vehicle as the Village Manager or
their designee may determine.
§ 215-75. Designation of permit parking areas near the Croton River; permit required; hours.
A. A residential parking permit system is hereby established within the Croton River residential parking
permit area, as defined herein.
B. Except as otherwise provided herein, no person shall park a vehicle, nor allow a vehicle to be parked
at any time, Saturdays, Sundays and holidays, between the hours of 8:0 a.m. to 8:00 p.m., from
Memorial Day through Labor Day, along any street that has been designated as the Croton River
residential parking permit area pursuant to this article, unless the vehicle displays a valid parking
permit issued in accordance with this article.
C. A permitted vehicle issued a permit shall have affixed a valid residential parking permit to either its
rear windshield or its rear bumper, or such other location on the vehicle as the Village Manager or
their designee may determine.
§ 215-76. Issuance of residential parking permits.
A. Upon application and payment of the applicable fee, any person who is a resident and who meets the
applicable requirements of this article shall be issued by the Village Manager or their designee one
valid parking permit for each vehicle registered in the applicant's name. The Village Manager or their
designee shall establish guidelines to issue parking permits, including proof of residency.
B. Permits issued under this article shall be specific to a single vehicle, shall not be transferred, and shall
be displayed only as the Village Manager or their designee prescribes. The permittee shall
immediately notify the Village of any change or amendment from the information contained in the
original application.
C. If the permit or portion of the vehicle to which a permit has been affixed is damaged such that it must
be replaced, the permittee, upon application therefor, shall be issued a replacement. The Manager or
their designee may require display of the damaged permit before a new permit is issued.
§ 215-77. Fees.
A. The fees for residential parking permits shall be set by resolution by the Board of Trustees from time
to time.
B. The fees collected pursuant to this article shall be credited to the general fund of the Village of
Croton-on-Hudson.
§ 215-78. Nonresident parking exception.
A. Notwithstanding anything to the contrary herein, vehicles without a permit issued pursuant to this
article may be parked within the Harmon Residential Parking Permit Area for a period not in excess
of four hours.
B. Notwithstanding anything to the contrary herein, not less than 20% of all spaces within the Croton
River Residential Parking Permit Area will be designated as available to nonresidents as short-term
parking of not less than 90 minutes in duration.
§ 215-79. Temporary parking.
There shall be temporary parking permits available for residents who have a houseguest, babysitter,
caretaker, contractor, service provider, or other visitor come to their home for a temporary period of time.
Temporary parking permits, not to exceed three days in length, shall be issued by the Village Manager or
their designee when sufficient off-street parking is not available at the residence. The temporary parking
permit shall be placed on the vehicle dashboard, or such other location as the Village Manager or their
designee may determine.
§ 215-80. Exemptions.
Motor vehicles registered pursuant to § 404-a of the New York State Vehicle and Traffic Law shall be
exempt from any permit requirement established pursuant to this chapter.
§ 215-81. Conflicts.
To the extent that the provisions in this article conflict with any other provisions in Chapter 215, the
provisions herein control.
§ 215-82. Penalties for offenses.
Any person violating any provisions of this article of this chapter may, upon conviction, be punished by a
fine as detailed in § 215-30.
